COMBINED SYNOPSIS/SOLICITATION

273FCC23Q0008

BROADBAND DATA COLLECTION

FCC DRIVE TESTING SUPPORT SERVICES

ISSUED: June 9, 2023

This combined synopsis/solicitation is prepared in accordance with FAR Part 12.603 – Streamlined Solicitation for Commercial Services, in conjunction with the policies and procedures for solicitation, evaluation and award as prescribed in FAR Subpart 13.5 – Simplified Procedures for Certain Commercial Products and Commercial Services. The following solicitation document, incorporated provisions, and clauses are in effect through Federal Acquisition Circular 2023-04.

This Best Value procurement is unrestricted, full and open. The NAICS Code is 541330 – Engineering Services, with a small business size standard of $22.5 million.

FCC contemplates the award of a firm-fixed-price (FFP) indefinite delivery / indefinite quantity (IDIQ) single award task order contract (SATOC) under FAR Part 16.5 with a total contract capacity of $3M and a minimum guarantee of $20,000. The ordering period will be a base period of one-year with two (2) one-year option periods.

Contract Line Items: This IDIQ contract will contain separate contract line item numbers (CLINs) for labor (by labor category) and material, travel, and special projects. This requirement and associated CLINs are provided in a separate document labeled, “Attachment 2 – FCC Drive Testing IDIQ Pricing Schedule.”

System for Award Management: By submission of a proposal, the Offeror acknowledges the requirement that prospective awardees must be registered in the System for Award Management (SAM) database prior to award, during performance, and through final payment of any contract resulting from this proposal. Lack of registration in the SAM database will make an Offeror ineligible for award.

Period and Place of Performance: The IDIQ contract will contain a three-year ordering period. For planning purposes, work on Task Order One is estimated to begin in August 2023. The location of work performed hereunder shall be stated in the individual Task Orders.

Terms & Conditions: See Attachment 5 – SF1449 for all applicable Terms and Conditions related to this procurement.

Provisions 52.212-1, Instructions to Offerors – Commercial, 52.212-2, Evaluation – Commercial Products and Commercial Services, and 52.212-4, Contract Terms and Conditions -- Commercial Products and Commercial Services apply to this acquisition along with any listed addenda to the provisions.

52.212-1 INSTRUCTIONS TO OFFERORS–COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES – ADDENDUM

Cover Letter or First Page – Quotes shall include the following:

1. Name of Firm

2. Complete Address

3. Unique Entity Identifier (UEI)

4. Taxpayer Identification Number (TIN)

5. Name and contact information for company official with authority to obligate the vendor

6. Any Subcontractor(s) name or Subcontractor’s Vendor

7. RFQ Number

8. Date of Quotation

9. Statement that Quotes are valid for a period of no less than 60 days.

10. Socio Economic Designation(s)

11. Evaluation submittals per 52.212-2 (below)

Representations and Certifications, FAR 52.212-3 - Offerors shall submit one completed copy of all representations and certifications. If the Offeror has completed the Online Representations and Certifications at the System for Award Management (SAM) at https://www.sam.gov/content/home it should submit an electronic printout or screenshot of the Representations and Certifications as part of its quote.

Quote Submissions: Quotes are due no later than July 5, 2023 at 4:00 PM Eastern Time. Offerors are responsible for verifying receipt of their quotes to this office before quote submission due date and time. Any Offeror who submits an incomplete package may be considered ineligible for award.

The quote must be compliant with the requirements as stated in the combined synopsis solicitation and PWS thereto. Non-conformance with the instructions provided in this section may result in unfavorable quotation evaluation.

Quotes shall be emailed to: Teresa.Dailey@fcc.gov and EAC-Proposals@fcc.gov. Include “RFQ Number 273FCC23Q0008, FCC Drive Testing Support Services - QUOTE” in the subject line of the e-mail.

To avoid rejection of an offer, the offeror must make every effort to ensure its electronic submission is virus-free. Quotes, or portions thereof, submitted with the presence of a virus or which are otherwise unreadable will be treated as unreadable pursuant to FAR 15.207(c).

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021)

(a) Basis for Award: The Government will award, without discussions, to a responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government based on technical capability, including response to the IDIQ requirements, response to the sample task order, relevant corporate experience and past performance, and price. The Government reserves the right to award to an offeror providing other than the lowest price offer based on the technical merits of the offeror’s proposal.

See performance work statement (PWS) and evaluation – commercial items specified in FAR 52.212-2 of this solicitation. The following factors shall be used to evaluate quotes:

1. RELEVANT EXPERIENCE

2. TECHNICAL APPROACH – IDIQ

3. TECHNICAL APPROACH FOR SAMPLE TASK ORDER (including proposed labor mix in Attachment 4 Sample Drive Test Pricing Sheet)

4. PRICE IDIQ (Attachment 2)

(b) VOLUME I – Technical [NTE 50 Pages]:

FORMAT AND CONTENT - Use Times New Roman 12-point font, single spaced type with one-inch margins. Text within Figures and Tables cannot be smaller than 9-point font size. Charts, figures, tables, and other exhibits are excluded from the NTE page count for the Technical Proposal narrative. Such additional information shall be included at the end of the proposal and referenced accordingly in the narrative to make it clear that the narrative does not exceed the page limitations.

Include the following information in order to verify credentials. Technical Capability shall demonstrate the vendor’s:

1) Relevant Corporate Experience

Submission Criteria: The offeror shall submit three (3) examples of projects where drive testing services were provided that demonstrate the breadth and depth of the offeror’s experience performing work similar in size, scope, and complexity to the work described in the PWS of this solicitation. To be evaluated, projects must have been performed within three (3) years of the date this solicitation is issued. Projects that are ongoing may be submitted if performance has been underway for at least 1 year. An IDIQ contract or other similar ordering vehicle is not considered a “project;” however, a specific task order issued under that IDIQ or ordering vehicle may be considered a “project” under this evaluation factor.

A maximum of three (3) projects will be evaluated. If an offeror disregards these instructions and submits more than three (3) projects, only the first three (3) projects will be evaluated. Offerors should describe each project in sufficient detail to ensure that the Government can meaningfully assess how each project demonstrates the offeror’s capability and experience in performing the work called for in this solicitation. Offerors must limit the description of these projects to two pages per project submission. If an offeror disregards these instructions and submits more than two pages per project, only the first two pages will be evaluated.

Offerors should use the following format when submitting project information under this factor:

a) Project Title, Contract Number, and Location

b) Customer (company or agency for which work was performed)

c) Total Dollar Amount

d) Start and Completion Dates

e) Description of the Project (Describe the project, the involved entities, size of the teams, and how the services provided relate to the work called for in this solicitation)

f) Customer Point of Contact (name, relationship to project, agency/firm affiliation, city, state, current phone number and email address)

2) Technical Approach/Response to IDIQ Requirements

Submission Criteria: Include the following information in order to verify credentials. Technical Capability shall demonstrate the vendor’s:

a. Understanding of the overall and specific requirements in the PWS Section 4 and technical approach to providing the support described in the IDIQ PWS (Attachment 1). Offeror shall reference and provide a response for IDIQ PWS Sections 4.1 – 4.4. See PWS Section 4.1.1 and Section 5 Deliverables for specific requirements and draft deliverables for inclusion in the technical response.

b. Software Bill of Materials (SBOM), as required by PWS Section 10.8. The offeror’s response to the SBOM requirements is excluded from the page limitations above;

c. Organizational Conflict of Interest (OCI), as required by PWS Section 12. The offeror's OCI statement is excluded from the page limitations above.

Pass/Fail: The following item MUST be included in the offeror’s proposal to determine eligibility for award:

- All Offerors: Software Bill of Materials (SBOM) in accordance with the requirements in the IDIQ PWS Section 10.8.

3) Technical Approach/Response to Sample Task Order

Submission Criteria: Attachment 3 to the solicitation provides a Sample Drive Testing Performance Work Statement (PWS). The sample project is not an actual planned drive test, but rather is a fictitious drive testing project that is representative of work contemplated to be performed by the contractor under this SATOC. The Sample Task Order Technical response shall detail the Offeror’s specific approach to planning and conducting the Sample Drive test based on the parameters provided in the Sample Drive Test PWS. The response shall include evidence of the Offeror’s understanding of the requirements in the IDIQ PWS Sections 4.2 – 4.4 in designing the approach to the Sample Task order. The response should:

Thoroughly describe the Offeror’s plan to fulfill the specific Task Order requirements, including a narrative summary of proposed personnel, level of effort, equipment and materials required to complete the sample task order.

Demonstrate a firm understanding of the Example Project requirements based on the Offeror’s technical approach, disciplines used, the hours proposed, and corresponding risk to the Government.

Provide an explanation of any identified or potential technical/schedule risks and their associated mitigation measures that would ensure successful performance of the Example Project.

Provide a clear and convincing explanation and assessment of how the Offeror would ensure overall project objectives are met.

Please refer to the instructions and information in Attachment 3: Sample Drive Test PWS for additional details.

No pricing information shall be included in the Sample Task Order Technical response – all pricing information for the Sample Task Order shall be submitted separately in the Excel workbook provided as Attachment 4 to the solicitation.

(c) VOLUME II - Price [No page limit]:

The Offeror shall propose pricing information in two separate volumes using the Excel pricing templates provided:

IDIQ Pricing Schedule (Attachment 2)

The offeror shall complete the pricing schedule using the Microsoft Excel template provided in Attachment 2: FCC Drive Testing IDIQ Pricing Schedule, which are binding labor rate ceilings inclusive of profit. The Offeror shall fill in the hourly rates for each of the ordering period years.

Offerors are cautioned that the rates proposed will be legally binding for all periods and the rates proposed will be the maximum rates that the Offeror may use to price all firm-fixed priced task orders issued in either of the ordering period years. The Offeror is responsible for the accuracy of all data input, formulas, and calculations.

Sample Drive Test Pricing Sheet (Attachment 4) Each Offeror must review the sample task order PWS in Attachment 3 of this RFQ and submit a complete price proposal for the work proposed. Offerors shall submit a price proposal for the sample task order to include all labor and materials required to plan and execute the sample task order requirements. Offerors shall utilize Attachment 4 for pricing the Sample Drive Test, however, an accompanying written narrative may be submitted providing additional details and assumptions supporting the costs proposed in Attachment 4. The Offeror is responsible for the accuracy of all data input, formulas, and calculations. Please refer to additional guidance/instructions provided in Attachments 3 & 4 regarding completion of the Sample Drive Test Cost Proposal. The government will not evaluate the total pricing for the Sample Drive Test.

The Government intends to make an award on the basis of initial proposals without conducting discussions in accordance with FAR 52.215-1, however, the Government reserves the right to conduct discussions if the Contracting Officer determines it necessary. Therefore, the initial proposal should contain the Offeror’s best technical and price terms.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

MINIMUM GUARANTEE:

This is a Firm Fixed Price, Indefinite Delivery Indefinite Quantity (IDIQ) Single Award Task Order Contract (SATOC) and the resulting ID/IQ contract includes a three-year ordering period. The minimum guaranteed for this contract shall be $20,000. The Contracting Officer is under no obligation to issue any task orders against this contract in excess of the minimum guarantee amount. Awarded task orders will share an estimated capacity of $3,000,000.
