About this file
This is a Byrd Anti-Lobbying Certification document required under 31 U.S.C. Section 1352 and 44 C.F.R. Part 18 for federal contracts, grants, loans, and cooperative agreements. The certification requires the contractor to certify that no federal appropriated funds have been paid or will be paid to any person for the purpose of influencing or attempting to influence officers or employees of any federal agency, members of Congress, or congressional staff in connection with the awarding, making, or modification of any federal contract, grant, loan, or cooperative agreement. The contractor must also include identical certification language in all subaward documents at all tiers, including subcontracts and subgrants, and require all subrecipients to certify and disclose accordingly.
If any funds other than federal appropriations have been paid or will be paid for lobbying activities, the contractor is required to complete and submit Standard Form-LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions. This certification constitutes a material representation of fact, and submission is a prerequisite for entering into the transaction. Contractors who fail to submit the required certification are subject to civil penalties ranging from $10,000 to $100,000 for each failure. The contractor's authorized official must sign the certification, affirming the truthfulness and accuracy of all statements, and agrees that the provisions of 31 U.S.C. Chapter 38, Administrative Remedies for False Claims and Statements, apply to the certification and any disclosure filed.
