About this file
This document is a Payment Bond template issued by the Kenton County Airport Board for the Ramp Tower Services contract (26-044-RFP) at Cincinnati/Northern Kentucky International Airport (CVG). The bond serves as a financial guarantee mechanism requiring the selected contractor to ensure prompt payment to all claimants, including direct contractors, subcontractors, and material suppliers involved in performing the ramp tower services. The payment bond protects laborers, material suppliers, and other parties who contribute to contract performance by providing a legal remedy if the contractor fails to make timely payments. Claimants are defined as entities with direct or indirect contracts with the contractor for labor, materials, or services used in the contract performance, including utilities and equipment rentals directly applicable to the project.
The payment bond imposes specific conditions and timelines for claims. Claimants must be paid in full within ninety (90) days after completion of their work or material delivery, or they may file suit against the bond. Indirect claimants must provide written notice to any two of three parties—the contractor, owner, or surety—within ninety (90) days of completing their final work or delivery. All claims must be filed within one (1) year following the date the principal ceased work on the contract. Claims may only be pursued in a state court of competent jurisdiction in the county where the project is located or in the appropriate United States District Court. The bond amount shall be reduced proportionally by any good faith payments made under the bond, including payments for any mechanics' liens filed against the airport improvement.
