PERFORMANCE WORK STATEMENT

Educational Services at Hanscom AFB

1. General Information and Scope of Work

1.1 Agency: The Department of Defense Education Activity (DoDEA) is responsible for planning, directing, coordinating, and managing prekindergarten through 12th grade educational programs on behalf of the Department of Defense (DoD). Title 10, Section 2164 of the U.S. Code outlines the authority of the Secretary of Defense to provide educational programs for dependents of military personnel and federal civilian employees. The Secretary of Defense can enter into arrangements to provide elementary or secondary education for dependents residing on military installations if appropriate educational programs are not available through local educational agencies.

1.2 Background: Through Lincoln Public Schools, the Township of Lincoln provides comprehensive education and early intervention services, for students living at Hanscom AFB. The Pre-K-8 students are served at the base’s elementary and middle schools, which are owned by the Federal Government. Grades 9-12 students are served at Bedford High School by Bedford Public Schools. Both school districts have been serving students from Hanscom AFB for over 50 years.

1.3 Scope of Work: DoDEA requires comprehensive Pre-K-12 education program services and special education services to be provided in accordance with federal and state laws and regulations including DoD Instruction

1342.12 Provision of Early Intervention and Special Education Services to Eligible DoD Dependents, June 17, 2015. Services shall include special education programs for eligible Hanscom AFB dependents who are 3-21 years of age in all appropriate settings. There are approximately 525 eligible Pre-K-8 dependents of Department of Defense (DoD) personnel residing on Hanscom AFB, Massachusetts. The requirement includes providing food service, grounds maintenance, building maintenance, and student transportation services.

2 Objectives

Comprehensive Education Services: The Contractor shall provide all necessary labor, services, administration, furniture, supplies, equipment, and transportation to present a comprehensive educational program that meets or exceeds those schools ranked as highly performing, per by the Massachusetts Department of Education School Report Card. Education services shall include both special education services for students with an individual education program (IEP). The Contractor shall provide a multi-tiered system of supports (MTSS), including Tier 1 differentiation for students needing extension and/or enrichment instructional opportunities, that meet or exceed those required by the Commonwealth of Massachusetts.

Supporting Tasks: The tasks below are to help the Contractor gain a better understanding of the requirements to successfully meet the objective. They are not all inclusive, so the Contractor is expected to develop the total solution to meet all the requirements in accordance with a performance-based approach.

2.1 Objective 1, Education Program

2.1.1 Task 1: General——The Contractor shall be recognized by the Massachusetts Secretary of Education to operate schools with grades Pre-K-12 in the state. The proposed solution shall include the following:

2.1.1.1 The required core rigorous curricula that encourage (to the extent practical) students with identified needs to be in core instructional programs, resulting in a school special education identification rate that is closely aligned with state averages and comparable districts as provided by the Massachusetts Department of Education. All core curriculum programs shall be accredited in accordance with the laws of the state of Massachusetts as well as all applicable US laws and regulations.

2.1.1.2 Educational services that (1) maintain a district and school ranking that meets or exceeds the average ranking of all districts and schools in the state, per the Massachusetts Department of Education for federal accountability requirements, (2) comply with state standards as described in the Massachusetts Standards and Instruction by content, and (3) meet all applicable federal law and state laws and regulations.

2.1.1.3 Pre-K-8 education/services at the elementary and middle schools located on Hanscom

AFB.

2.1.1.4 Special education and related services, remedial support, counseling services.

2.1.1.5 Intramural and extracurricular activities consistent with state and federal laws and regulations.

2.1.1.6 Annual updates regarding all educational programs, curriculum scope and sequence, and resources used under this contract for review by the contracting officer’s representative (COR) to assure/verify compliance with federal and state laws and standards.

2.1.1.7 Ensure school starts and stops on a schedule that replicates public schools in Massachusetts.

Provide services that fully comply with the requirements in this PWS and that provide continuity and improve student learning for consistently low performing subgroups with education services currently being provided at Hanscom AFB for all eligible students.

2.1.1.8 Contingency plan to ensure the comprehensive educational program’s quality is maintained during unanticipated decreases or increases in enrollment, which would (1) result in lower or higher contract costs, respectively and (2) require a response from the Contractor in an appropriate, time-sensitive manner. Note: Such enrollment changes might be caused by base realignment or closure.

2.1.1.9 Draft transition plan to assist the smooth transfer of records, educational resources, and physical resources to another school district in the event the award is not made to the Contractor. Finalize the plan based on written feedback from the COR.

2.1.2 Task 2: Staffing and Programs—The Contractor shall:

2.1.2.1 Ensure (1) staffing meets or exceeds the Massachusetts guidelines, (2) pupil-teacher ratios

(PTR) meet or exceed Massachusetts guidelines with no waiver, and (3) staffing both meets or exceeds state guidelines and meets or exceeds the district’s percentage of qualified and experienced teachers. Provide the COR with written information regarding how many teachers have under five years of experience, have 15 or more years of experience, possess master’s and doctoral degrees, and are within three years of retirement eligibility.

2.1.2.2 Provide curricula that:

1) Use up-to-date information, and curriculum resources with publications dates within seven years of the base contract year.

2) Provide appropriate and challenging instruction, incorporating current best practices for instructional approaches, assessment, and differentiation to meet the needs of identified subgroups including accelerated and consistently low achieving students.

3) Include co-curricular/extracurricular activities, including middle school athletics, all of which complement the education programs at all levels.

4) Provide enrichment and remediation programs.

5) Require technology applications in student work to be produced and evaluated utilizing technological skills.

6) Include online assessment administration.

7) Include world language instruction at the middle school.

8) Include alternate/vocation, counseling services, college-and-career-ready academic and work planning beginning in middle school consistent with best practices, Commonwealth of Massachusetts laws/regulations and other applicable federal laws/regulations.

9) Integrate technology into and in support of the curricular program. Include (1) technology plan with computer-student ratios and current technology inventory in classrooms, media centers, and other appropriate school locations using wireless connectivity capability),

(2) technology instruction as an instructional tool and a student work platform and (3) the way the Contractor will respond to the rapid technology developments in 21st century technology. Note: The technology plan shall be included in the QCP, per PWS 4.2.2.

2.1.3 Task 3: Special Education and Related Services—The Contractor shall provide special education and related services, regardless of type or severity of the disability in accordance with federal and state laws and regulations, including DoD Instruction 1342.12. Services shall include special education programs and services for eligible students 3-21 years of age in all appropriate settings.

The Contractor shall provide the following services:

2.1.4

2.1.4.1 Differentiate instruction providing a multi-tiered system of support, including Tier 1, that meet or exceed those required by the Commonwealth of Massachusetts.

2.1.4.2 Special education and related services for eligible Hanscom AFB dependents in all appropriate settings in accordance with the student’s IEP to include but not limited to (1) transportation services for children with disabilities, regardless of the severity of the disabling condition and (2) assistive technology devices and services required for the student to receive a free appropriate public education.

2.1.4.3 Provide the COR with documentation to include the individual education program (IEP) for each student and the associated reports and assessments. For students in day and residential placements, provide the report that determined the placement, and contract award information, including performance work statement, funding documents, and assessment reports.

2.1.4.4 Early intervention services for students with identified needs, as prescribed in the Individuals with Disabilities Education Act (IDEA).

2.1.4.5 Provide, upon request, detailed contingency plans for obtaining services in a timely manner that fall outside of the Contractor’s current capabilities.

2.2 Objective 2, Support Services—The Contractor shall provide medical, food, facilities, custodial, maintenance, and student transportation services in support of the comprehensive education program:

2.2.1 Task 1: Medical Services: Provide a minimum of 1.0 FTE state board-certified nurse to provide medical services to children at school during normal school hours at the Hanscom AFB. Note: For schools with 100 - 349 students a 0.5 FTE nurse in each location is permissible.

2.2.2 Task 2: Food Services: Provide and manage a student food service program for eligible DoD dependent children residing at Hanscom AFB, which meets or exceeds the service provided in local public schools and which complies with federal and state laws and regulations. Free and reduced meals shall follow US Department of Agriculture (USDA) guidelines. All applications shall be completed online with the final determination made at the school district level, per USDA guidelines.

2.2.3 Task 3: Facilities and Equipment—Provide a clean, safe, secure environment for students and staff that complies with DoD, federal, state, and local laws and regulations to include:

2.2.3.1 Secure and maintain facilities, utilities, equipment, furniture, systems and supplies that are comparable to those of local area public schools and that comply with the Commonwealth of Massachusetts laws and regulations for Pre-K-12 schools.

2.2.3.2 Ensure hardware and software and delivery platforms are regularly modernized to support the educational programs, assessments and administrative operations to meet or exceed the guidelines of the Commonwealth of Massachusetts.

2.2.3.3 Ensure the quality, and the cohesive delivery of the comprehensive educational program is maintained during unanticipated decreases in enrollment (resulting in lower total contract costs) as well as unanticipated increases that may require immediate action (resulting in higher contract costs).

2.2.4 Task 4: Custodial and Grounds Maintenance Services: Provide and manage all custodial support and grounds maintenance requirements (trash pickup, landscaping, grass cutting, ice/snow removal, etc.) for school facilities and grounds in a manner that compares favorably to those of local public schools and complies with federal and state laws and regulations.

2.2.5 Task 5: Building Maintenance

2.2.5.1 Provide day-to-day maintenance of the Hanscom AFB schools to include preventive maintenance of the communication systems, mechanical systems and facilities in accordance with the Contractor’s approved property management system and the contract clauses at FAR 52.245-1 “Government Property” contained in this contract.

2.2.5.2 Provide routine maintenance services, parts, and supplies for both Hanscom AFB school buildings and associated maintenance support for school buildings, playgrounds, mechanical systems, and the buildings provided for contractor use. All maintenance and upkeep of these

25 Mar 25 4 facilities with a per project total cost of less than $75,000 (including labor and materials) shall be the Contractor’s responsibility. Bundling of projects to exceed $75,000 is not allowed.

Note: Multi-trade projects (plumbing, carpentry, electric, etc.) shall support a single project scope.

2.2.5.3 Projects Costing Over $75,000: Coordinate and provide notifications for regular and emergency projects costing over $75,000 to the COR in a timely manner. Submit detailed cost estimates of projects with a per project cost over $75,000 to COR for verification and consideration for purchase by DoDEA. Submit planned out-year projects to the COR for inclusion in budget calculations and prioritization. Note: DoDEA will consider projects based on priority ranking with other agency requirements.

2.2.5.4 Emergency Projects Costing over $75,000: Emergencies are considered to be a failure, which if allowed to go unchecked, will result in significant damage to buildings or property. Submit information telephonically to the COR. DoDEA will follow-up by email or fax to confirm telephonic notification. Notification shall include a project description and scope, estimated cost and potential vendor identification. The COR forwards the information to DoDEA’s Facilities Branch that works with its counterpart at Hanscom AFB to coordinate the procurement and work efforts.

DoDEA provides funds for project completion to the base via cost reimbursement.

In no case will approval be requested later than 72 hours after the emergency.

Projects not approved by DoDEA because they are either deemed non-emergency or costing less than $75,000 shall be the Contractor’s responsibility.

2.2.5.5 Provide a comprehensive preventative maintenance program to ensure that facilities and mechanical systems are properly and cost-effectively maintained. Establish/implement written procedures to ensure work is performed in accordance with standard commercial practices, manufacturer’s recommendations, and applicable federal, state, and local rules and regulations.

Submit a file copy of the procedures to the COR.

2.2.5.6 Be responsible for any expenses or damages caused by failure to properly maintain the facilities or systems for which it is responsible.

2.2.6 Task 6: Student Transportation Services: Provide transportation services to all Pre-K-8 eligible students residing in Hanscom AFB, those who have been approved by the COR, and those who reside at FamCamp. Transportation services shall conform to all relevant DoD and Massachusetts laws and regulations.

Currently, only eight Pre-K-8 military-connected students who live near the base have been approved by the COR to attend the base schools. This number will likely vary over the life of the contract.

The Contractor shall only provide transportation services for Pre-K-8 students who have an IEP that mandates it.

2.2.6.1 Provide transportation services for Pre-K-8 students with disabilities as required by their specific needs and in accordance with state and federal laws and regulations. This transportation shall be provided on a “one round trip per child per school day” basis and incorporate any variances in scheduling to include, but not limited to, late morning runs for delayed openings and midday runs for school “half days”.

2.2.6.2 Conduct at least one bus safety drill annually with riders to teach and orient students to emergency bus evacuation, per district guidelines.

2.3 Objective 3: Reports, Quality Control Plan, and Relationship with Hanscom AFB Stakeholders—The

Contractor shall (1) provide required assessments and reporting to meet US Department of Education and the state of Delaware’s laws, regulations, and guidelines, (2) establish and implement a QCP, and (3) establish/ maintain a cooperative relationship with Hanscom AFB and DoDEA HQ stakeholders:

2.3.1 Task 1: Reports: Provide the COR with the following reports each school year:

2.3.1.1 Enrollment report shall include all students, including special education services and out-of-district student placements who are paid for by this contract using the enrollment as of September 30 and January 20 of each contract year. Enrollment data is due to the COR within five business days of each reporting date. If the Contractor participates in a program

(with the Contracting Officer’s approval) that permits enrollment of non-eligible students on a no-cost basis to the Government, these students shall be reported separately.

School of Choice: The School of Choice law, enacted in 1991, allows Massachusetts residents to send their children to public schools outside of their home district. Districts can choose to participate in open enrollment, which allows parents to send their children to any public school in the state. The Contractor is only entitled to receive payment for dependents who meet the eligibility requirements as set forth in this contract.

Enrollment numbers shall be reported by school, by grade, and shall include the following additional information: student name, sponsor name and home address.

Enrollment reports shall be provided to the Hanscom AFB command for verification of all dependents reported as residing on the installation. Note: The Contractor is only entitled to receive payment for dependent students of members of the US Armed Forces serving on active duty and fulltime DoD civilian employees residing in permanent living quarters on Hanscom AFB in accordance with Section 2164 of Title 10, United States Code.

2.3.1.2 Provide digital copies of school and district profiles previously provided to the Commonwealth of Massachusetts to the COR within 15 calendar days of publication.

2.3.1.3 Provide digital copies of report by school and district, as mandated by the US Department of Education and the Commonwealth of Massachusetts to the COR within 15 calendar days of publication.

2.3.1.4 Provide results of statewide student testing administered by the Massachusetts Comprehensive Assessment System (MCAS) for Hanscom AFB students to the COR digitally within 15 calendar days of publication.

2.3.1.5 Provide results of district and schoolwide student testing disaggregated by Every Student Succeeds Act (ESSA) reporting subgroups for Hanscom AFB students to the COR digitally within 15 calendar days of publication.

2.3.1.6 Provide documentation for day and residential placements, i.e., the IEP, report; data that determined the placement; contract award information, including performance work statement; funding documents; and assessment reports to the COR. Update annually.

2.3.1.7 Notification of Changes to State Educational Laws and Regulations: Provide notification to the COR of any proposed changes to the educational program in accordance with the laws of the Commonwealth as well as applicable US laws and regulations within three business days of notification.

2.3.2 Task 2: Quality Control Plan (QCP): Provide a QCP which contains, at a minimum, the information cited below:

2.3.3 Task 3: Relationship with Hanscom AFB Stakeholders: The Contractor shall ensure positive and consistent two-way communications with parents/sponsors, the military, and community leaders.

Establish/maintain a cooperative relationship with Hanscom AFB officials and education representatives, including the Hanscom AFB Exceptional Family Members Program (EFMP) representative, School Liaison Officer, to ensure community understanding for the general education program and to assist in a smooth transition for newly arriving families. The cooperative relationship includes the right for DoDEA to review all IEPs and to be a participating member in IEP meetings involving students who are being considered for day and/or residential placements. Note: Only DoDEA can make changes or modifications to the contract.

2.3.4 Task 4: Meetings: The Contractor shall attend virtual meetings at no additional cost to the

Government and provide the medium through which each meeting occurs, record each meeting’s minutes. Submit the draft minutes to the COR within two business days of the event and finalize the minutes two business days after receipt of written feedback from the COR.

2.3.4.1 Post-Award Conference: Participate in a video- or teleconference with the COR five business days after award IAW FAR Subpart 42.5.

2.3.4.2 Other Post-Award Meetings: Meet with the Contracting Officer (KO), COR, and/or other

Agency personnel, as appropriate, to review Contractor performance, as required by DoDEA.

The KO may discuss the Agency’s view of Contractor performance, and the Contractor shall apprise the Agency of any problems being experienced. The Contractor shall take appropriate action to resolve any outstanding issues the Agency raises.

2.4 Performance Standards and Acceptable Quality Levels

2.4.1 Performance Standard: Tasks shall be completed by the required completion date.

2.4.2 Acceptable Quality Level: See PWS Section 8, Performance Requirement Summary (PRS).

3 Constraints

3.1 Place of Performance: Elementary and middle school instruction shall occur at the Hanscom AFB schools.

Administrative tasks shall be performed at the Contractor’s facilities.

3.2 Key Functions—The Contractor shall provide the following: Project Manager/Alternate Project Manager and Teachers and Administrators.

3.2.1 Program Manager/Alternate: Provide a person to be responsible for the performance of work. The name of this program manager and an alternate who shall act for the Contractor when the program manager is absent shall be designated in writing to the Contracting Officer. The program manager or alternate shall have full authority to act for the Contractor on all contract matters relating to the daily operation of this contract. Provide a program manager with an advanced degree in a relevant area and at least one year of experience in a similar role. Provide an alternate that will be able to speak for the program manager regarding contractual matters. One of them shall be available, from 9AM to 3PM EST, Monday - Friday, except for Federal holidays or when the Government facility is closed for administrative reasons.

3.2.2 All Contractor Personnel: Possess appropriate education and industry-related certifications, licensing and credentials accepted by the Commonwealth of Massachusetts to deliver and support a comprehensive and appropriate instructional program. Staff shall complete annual mandatory training in accordance with state laws and regulations for the education of Pre-K-12 children as well as those DoDEA deems relevant to the education of military-connected students including but not limited to Privacy, Non-Discrimination, Civil Rights, Harassment and Combatting Trafficking in Persons.

3.2.2.1 Provide, upon written request from the COR, complete criminal history background checks and rechecks on each applicable employee working under this contract in accordance with Massachusetts law, DoD instructions, and school district procedures.

3.2.2.2 Notify the COR of the intent to hire senior leaders, for example, a superintendent, chief academic officer, or finance director. Provide a hiring timeline at the time of notification. Reserve two places on the interview committee for DoD. Note: One place is for a Hanscom AFB military-connected parent/sponsor and the other is to be determined by DoD.

3.2.3 Changes: Personnel provided as replacements to key functions after contract award shall meet or exceed the qualifications and experience of those provided upon award of the contract. Notify the COR in writing regarding all personnel changes ten business days in advance of the change.

3.3 Security Requirements—The Contractor shall ensure contractor personnel obtain installation/base passes, which requires the contracted employees to meet all applicable installation/base requirements.

Passes, identification badges, and access are at no cost to the Contractor.

Since turnaround time is unpredictable and varies from location to location, Contractors are encouraged to coordinate installation/base access well in advance of the projected start dates.

Identification badges shall be visible at all times when on the installation/base.

Upon contracted employees no longer require access to the installation/base, they must return their passes and identification badges to the proper installation/base office.

3.4 Safety and Security—The Contractor shall ensure technology, safety and security requirements comply with the regulations and instructions listed below. DoDEA and DoD publications may be found at the following URLs: http://www.dodea.edu or https://www.dtic.mil/whs/directives.

3.5 Privacy: Wherever applicable, the Contractor shall ensure/require individual accounts to possess unique usernames and passwords that do not require personally identifiable information (PII)—first and last name and any other unique personal information—to access online content. Follow the applicable federal, state, and school district rules and regulations governing PII/PHI to include encrypting emails that contain PII/PHI.

4 Government-Furnished Information / Resources

4.1 School Buildings: The Government will provide the facilities for the elementary and middle school educational programs on the Hansom AFB.

4.2 Maintenance: The Government will pay for projects that DoDEA determines are not the responsibility of the

Contractor, per PWS 2.2.3.6 (3) and 2.2.3.6 (4).

5 Subcontracting Requirements

5.1 Scope of Subcontracting: The Contractor may subcontract specific tasks or portions of the work as outlined in this PWS. The Contractor shall ensure that all subcontracted work meets the performance standards and requirements specified herein.

5.2 Subcontractor Approval: The Contractor shall submit a list of proposed subcontractors to the Contracting Officer for approval prior to the commencement of any subcontracted work. The list shall include the subcontractor's qualifications, experience, and a detailed description of the work to be performed.

5.4 Monitoring and Reporting: The Contractor shall implement a monitoring and reporting system to track subcontractor performance. This system must include regular progress reports, performance reviews, and audits. The Contractor shall provide the COR with monthly reports summarizing subcontractor performance.

5.5 Compliance with Regulations: Subcontractors must comply with all relevant federal, state, and local laws, regulations, and standards. This requirement includes, but is not limited to, labor laws, safety regulations, and environmental standards.

5.6 Communication Protocols: The Contractor shall establish clear communication protocols to facilitate effective coordination between the Contractor, subcontractors, and the Contracting Officer. Any issues or concerns related to subcontractor performance shall be promptly reported to the COR and Contracting Officer.

Contract Line Item Number (CLIN): Basic structural element in a procurement instrument describing and organizing the required product or service for pricing, delivery, inspection, acceptance, invoicing, and payment.

The use of the term “line item” includes “subcontract line number”, (SLIN), as applicable.

Contracting Officer (KO) : Only individual with expressed authority to obligate (bind) the Government by means of entering, administering, and terminating contracts within the limits of the authority delegated via a KO’s warrant.

Contracting Officer’s Representative (COR): Qualified and trained Government employee, nominated by the requiring activity (RA) and appointed in writing by a KO primarily to perform specific technical or administrative functions on a specific contract(s); serves as the ‘eyes and ears’ of a KO to assure the Government’s best interests are protected via the terms and conditions of the contract(s) appointed. COR’s do not have authority to obligate (i.e., bind) the Government.

Contractor: Supplier or vendor contracted to provide specific supplies or services to the Government. The term herein refers to the prime.

Deliverable: Usually physically delivered items but may include such items as digital documents/reports.

Performance Requirements Summary (PRS): Tabular listing of performance objectives and standards that provides the basis for a meaningful QASP.

Performance Work Statement (PWS): Statement of work for performance-based acquisitions describing the required results in clear, specific, and objective terms with measurable outcomes.
