About this file
This Special Conditions document amends the General Conditions for a Unit Price Contract (UPC) for Stormwater Pipeline Infrastructure Rehabilitation between Sarasota County and contractors performing work on the Bee Ridge Water Reclamation Facility. The County operates under a Consent Order with the Florida Department of Environmental Protection (FDEP) and a Stipulated Order with Suncoast Waterkeepers that impose financial penalties for unpermitted wastewater discharges. Contractors are required to immediately control, contain, and stop any discharge of wastewater, promptly repair any damage to County facilities, and immediately notify the County project manager upon discovering such discharges. The contract term spans three years with work focused on stormwater pipeline rehabilitation through Cured-in-Place Pipe (CIPP) lining in three size categories.
The contractor bears full financial responsibility for reimbursing the County for any penalties imposed under the existing environmental orders attributable to the contractor's actions. Daily penalties for unpermitted discharges are tiered by volume: $600 per day for discharges up to 5,000 gallons, $1,200 for 5,001 to 10,000 gallons, $3,000 for 10,001 to 25,000 gallons, $6,000 for 25,001 to 100,000 gallons, and $12,000 per day for discharges exceeding 100,000 gallons. These penalty provisions underscore the County's commitment to environmental compliance and shift financial risk to the contractor for non-compliance during pipeline rehabilitation work.
