About this file

This is Addendum No. 1 to an Invitation to Bid (ITB) issued by the School Board of Seminole County, Florida, Purchasing and Distribution Services Department for Uninterruptible Power Supply (UPS) Units under solicitation number ITB25260058B-GNM. The addendum was posted on November 14, 2025, with a solicitation opening date and time of November 25, 2025, at 1:00 P.M. The addendum clarifies that no installation or implementation pricing is required, as School Board personnel will handle all equipment installations. Purchase orders are expected to be issued as soon as possible on or after April 1, 2026. The solicitation is E-Rate eligible and requires bidders to submit pricing that meets all stated specifications and complies with E-Rate rules and regulations. The FCC Form 470 application number is 260003775, and related documentation is available through the USAC website.

The addendum addresses multiple vendor inquiries regarding warranty requirements, clarifying that Section I.7 regarding warranties is for informational purposes rather than establishing a minimum warranty requirement, though manufacturer multi-year warranties of at least two years must be included in pricing if part of the E-Rate eligible equipment. All previous E-Rate UPS equipment ITBs from the School Board where winners were selected resulted in orders being placed and delivered, though some ITBs were rejected and restarted to meet USAC guidelines. The addendum confirms that any qualified reseller may submit bids for manufacturer equipment meeting or exceeding the stated specifications, and bidders are solely responsible for ensuring their participation and supply sources comply with all applicable local, state, and federal laws. Vendors must acknowledge receipt of this addendum and include it with their submission or add it to their submission in Vendorlink.

The following items are updated to reflect the revisions and are hereby incorporated into the bid documents, ITB NO.

25260058B-GNM Uninterruptible Power Supply (UPS) Units.

A. REQUEST FOR INFORMATION

Q1. On page 3 it states warranty must be 2 years, but further down the page it states, “There is no preferred brand or warranty period.’ Can you clarify?

A1. Section I.7 WARRANTIES is for clarification that a manufacturer's multi-year warranty, defined as being a minimum of two years, that is part of the E-Rate eligible equipment, must be included in the pricing. This section is not a minimum warranty requirement.

Q2. Is installation or implementation pricing needed or is this strictly hardware (UPSs)?

A2. No installation is required as part of this ITB. SCSB personnel will handle all equipment installations.

Q3. How soon after April 1, 2026 will the purchase order be sent to the vendor?

A3. The PO will be issued as soon as possible on or after April 1st, 2026.

Q4. In addition to the SPIN #, and the FCC Registration number, what, if any, additional e rate or FCC numbers do you need to place your PO with the winning bidder? A 470?

A4. All required numbers are listed in the ITB documentation.

Q5. Over the past two years, previous ITB's were published and winners were selected by the School Board of Seminole County. Were orders placed and delivered for all of these?

A5. Orders were placed and delivered for all E-Rate UPS equipment ITBs from the past two years where winners were selected. However, there were other E-Rate UPS ITBs within the same period where all bids were rejected and no winners were selected. This occurred because necessary changes were required to the ITB, resulting in the need to restart the process to meet USAC guidelines for E-Rate.

Q6. If not, why were orders not placed?

A6. N/A

Q7. If the manufacturer of one of your three, currently owned UPS brands declines to quote competitive public sector e-rate pricing or any pricing to any but a few, pre-selected resellers, is that a concern for the School Board?

A7. This question is not within the scope of the ITB requirements. A reseller may quote any manufacturer's equipment that meets or exceeds the specifications listed in the ITB.

Q8. If refusal by a manufacturer to quote competitive e rate pricing or any pricing to all except for a few, pre-selected resellers, is not currently a concern, does the Board find this manufacturer's practice is in compliance with the "market segmentation" clause of the US Sherman Antitrust Act?

A8. The determination of compliance with the US Sherman Antitrust Act or any manufacturer's specific business practices regarding its reseller network is not within the scope of this ITB. This ITB requires bidders to submit pricing that meets all stated specifications and is compliant with all E- Rate rules and regulations. Bidders are solely responsible for ensuring their participation and their sources of supply adhere to all applicable local, state, and federal laws.

Q9. Can you please provide a copy of the 470 form?

A9. The 470 forms are available on the USAC website via the E-Rate FCC Form 470 Download Tool:

https://opendata.usac.org/stories/s/ejcg-sjaz The 470 application number is 260003775.
