About this file

This is a Boat Dock Recreational/Commercial Use Agreement issued by the Collier County Board of County Commissioners for slip rental at a county marina facility. The agreement establishes the terms and conditions for individual users to lease a designated slip at one of the County's marinas (referenced in connection with the Cocohatchee River Park marina management solicitation). The agreement permits use of a specific slip, including non-exclusive rights to common facilities such as piers, wharves, and loading platforms. The County reserves the right to reassign users to equal or larger slips with ten days' notice and maintains authority to modify marina operations, make alterations, or terminate the agreement on thirty days' notice. The term runs month-to-month from the execution date until termination by either party with thirty days' written notice. No renewal options are provided, and users have no ownership, leasehold, or tenancy rights in the slip or marina.

Users must pay monthly use fees as established by County Board of County Commissioners resolution, with fees due in advance by the tenth of each month; fees become delinquent if unpaid by that date and subject to automatic termination if unpaid for thirty days. Users must pay the first and last months' fees upon signing and are subject to a five percent monthly late charge on delinquent amounts. Recreational users require minimum public liability and property damage insurance of $300,000 per occurrence, while commercial users must maintain $500,000 per occurrence coverage, naming Collier County as additional insured. Commercial users must also provide workers' compensation coverage. The County retains the right to place liens against users' vessels for unpaid docking fees and other charges. Users are responsible for all repairs and maintenance costs caused by negligence or wrongful acts and must comply with Florida Clean Marina Program requirements and all environmental protection regulations.
