About this file

This document is a Decision Memorandum related to a Categorical Exclusion for a federal contract opportunity to replace the generator, transformer, and associated electrical equipment at building AS211 at Marine Corps Air Station New River.

The proposed project involves replacing the existing primary conductors, transformer, generator, and associated wiring. The project is categorically excluded under NEPA regulations as it involves new construction that is similar to and compatible with the existing land use. The Decision Memorandum documents the environmental review process and outlines specific conditions that must be met, such as ensuring the new generator tank is double-walled, properly labeled, and included in the base's Spill Prevention, Control, and Countermeasure (SPCC) plan. The related federal contract opportunity solicitation number is N4008525R2504 for the "AS211 Generator Replacement" project, which is limited to specific Mechanical MACC contractors within the ROICC Camp Lejeune area of responsibility. The Department of the Navy Naval Facilities Engineering Command is the contracting agency for this opportunity.

(3) Applicable Conditions

1. In response to enclosure (1), this Decision Memorandum satisfies reference (a) National Environmental Policy Act (NEPA) requirements applicable to the proposed action.

Pursuant to reference (b) planning considerations, this Decision Memorandum (DM) also documents the decision to categorically exclude (CATEX) the proposed action from the requirements of preparing an Environmental Assessment (EA) or an Environmental Impact Statement (EIS).

2. As outlined in enclosures (1) and (2), the proposed scope of the project is:

The proposed project will replace the existing primary conductors, transformer, generator, and associated wiring.

3. Pursuant to subparagraph (33) of reference (c), the proposed action qualifies for the following categorical exclusion: " (33) New construction that is similar to or compatible with existing land use (i.e., site and scale of construction are consistent with those of existing adjacent or nearby facilities) and, when completed, the use or operation of which complies with existing regulatory requirements (e.g., a building within a cantonment area with associated discharges and runoff within existing handling capacities). The test for whether this CATEX can be applied should focus on whether the proposed action generally fits within the designated land use of the proposed site.."

The proposed action will not result in any extraordinary circumstances.

4. In accordance with NEPA, this Decision Memorandum (DM)documents the proper level of environmental review for the proposed action to date but may not constitute authority to proceed with the implementation of the project. Please see the enclosures for more information. If the proposed action changes or does not begin within one calendar year after the date of this DM, please coordinate with the Environmental Planning Program

29 Apr 2024

Manager at (910-451-4542) to determine whether this DM continues to apply to the proposed actin or whether an updated environmental impact review will be required to find that a CATEX still applies to the proposed action.
