Statements in the Offeror’s proposal that exceed the requirements in the Statement of Work and/or the MCWBL UNDERSHIRT TECH PACK 2021E and MCWBL DRAWERS TECH PACK 2021E will become the new standard for the requirement. No statement within the Offeror’s proposal will grant the awardee relief from the existing requirements.
Evaluation Factors for Award This acquisition uses Best Value Tradeoff Source Selection procedures in accordance with FAR 15.101-1. The Government anticipates awarding one 60-month Indefinite Delivery / Indefinite Quantity, Firm Fixed Price (FFP) contract for the MCWBL to an Offeror whose proposal (1) complies with the solicitation’s terms and conditions, (2) meets or exceeds the solicitation’s requirements, and (3) is the most advantageous to the Government, based upon the Government’s assessment of the evaluation factors and elements.
Upon award of the IDIQ contract, the Government will procure 25 MCWBL sets (25 undershirts and 25 drawers) comprising five sets in each of the following five sizes (X-Small, Small, Medium, Large and X-Large) via a Delivery Order to support PPV. Delivery is required within
004-9
30 days of order placement. Upon successful completion of PPV, a second delivery order for a minimum of 3,000 MCWBLs (3,000 undershirts and 3,000 drawers) and a maximum of 6,000 MCWBLs (6,000 undershirts and 6,000 drawers tariff to be determined at time of award) will be issued. Delivery of the MCWBLs is required within 60 days of order placement.
Prior to evaluation, all proposals will be reviewed for compliance with the terms and conditions related to the submission instructions in the Addendum to 52.212-1. The evaluation process consists of two phases:
Phase 1: Go/No Go Criteria Phase 2: Tradeoff Evaluation
Phase 1 – Go/No Go Criteria The Government will evaluate, but not rate, proposals based on the six Go/No Go criterions identified in Table 4. Offerors failing to meet any one of the Go/No Go criterions will not be eligible for award. Proposals that receive a “Go” for all Phase 1 criterions will move on to evaluation Phase 2.
Table 4: Go/No Go Criteria
Criterion 1 Berry Amendment and Buy American compliance certification. The Offeror shall provide self-certification of Berry Amendment and Buy American compliance.
Criterion 2 Production Demonstration Models (PDM)s. The Offeror shall provide three PDMs in Coyote 498 color. One PDM shall be provided in each of the following sizes Small, Medium, and Large. A PDM consists of one undershirt and one drawer in the same size, for six total items.
Criterion 3 Design. The MCWBL sets submitted from the Offeror shall meet the government design. The undershirt shall be constructed with an open net-like mesh knit material and have jersey knit shoulder panels, underarm gussets, and rib knit collar and sleeve cuffs. The drawers shall be constructed with an open net-like mesh knit material and have jersey knit reinforced knee patches, jersey knit inner thigh gussets, a functional fly, an elastic waistband with an integrated drawstring cord, and rib knit ankle cuffs.
Criterion 4 Materials. The MCWBL sets submitted by the Offeror shall use materials that meet the no melt and no drip requirement listed on the Material Properties tab detailed in the MCWBL UNDERSHIRT TECH PACK 2021E and MCWBL DRAWERS TECH PACK 2021E.

004-10
Material Properties tab of the MCWBL UNDERSHIRT TECH PACK 2021E and MCWBL DRAWERS TECH PACK 2021E.
Criterion6 Offerors proposals shall state if they can meet the required PPV and Production delivery dates, quantities, and production rates.
Phase 2 - Tradeoff Evaluation The Government will evaluate, but not rate, proposals receiving a “GO” in all criteria for strengths, weaknesses, significant weaknesses, and deficiencies for compliance with the compatibility performance parameters. When making the best value determination, the Government will evaluate offers using the following factors and elements outlined in Table 5.
Table 5: Evaluation Factors
Factor 1 Technical Performance
- Element 1 Design / finished dimensions
- Element 2 Performance requirements
- Element 3 Delivery schedule Factor 2 Past performance Factor 3 Small business participation Factor 4 Price
The Government will evaluate requirements without a monetized or defined value based on the relative importance to other factors. Factors 1 through 3, when combined, are significantly more important than price. The importance of price as a factor in the final award determination will increase with the degree of equality in the non-price factors of the proposal. The Government will evaluate Past Performance and Small Business Particpation as either “acceptable” or “unacceptable.”
The Government intends to evaluate proposals and award a single contract to the Responsible Offeror with the best value and the ability to provide all CLINs on an "initial offer" without discussions. If discussions are necessary, the Government will establish a competitive range and notify all Offeror of their inclusion or exclusion. The Government will hold discussions with Offerors in the competitive range and also notify Offerors eliminated from the competitive range in writing in accordance with FAR 15.503. The overall proposed price for all CLINs determines the best value evaluation of Factor 4.
Factor 1: Technical Performance This factor consists of three elements, which are listed below:
Element 1: Design, quality and finished dimensions
004-11
Element 2: Performance requirements compliance Element 3: Manufacturing and delivery schedule
Element 1: Design, quality and finished dimensions The Government will verify and evaluate the five product demonstration models submitted in accordance with MCWBL UNDERSHIRT TECH PACK 2021E and MCWBL DRAWERS TECH PACK 2021E. The PDMs submitted will be evaluated for design as described on the Description Tab, using the materials and components listed on Material and Components tab, constructed according to the Construction tab to meet the finished dimensions and quality standards on the TOFM and Defects tabs of the of the MCWBL UNDERSHIRT TECH PACK 2021E and MCWBL DRAWERS TECH PACK 2021E. The product demonstration models may be disassembled for the evaluation as required.
Element 2: Performance requirements compliance The Government will evaluate the required test data submitted in accordance Inspections tabs in the MCWBL UNDERSHIRT TECH PACK 2021E and MCWBL DRAWERS TECH PACK 2021E to verify the submitted product demonstration models meet the physical requirements.
Element 3: Manufacturing and delivery compliance The Government will use the information Offerors submit in response to 52.212-1, Paragraph 2 Technical, to evaluate the Offeror’s capability to manufacture and deliver (1) 25 MCWBLs (25 undershirts and 25 drawers) 30 days after contract award to support PPV; (2) a minimum of 3,000 MCWBLs (3,000 undershirts and 3,000 drawers) and maximum of 6,000 MCWBLs (6,000 undershirts and 6,000 drawers) 60 days after successful completion of PPV, and (3) capable of maintaining a minimum of 6,000 MCWBL production capacity in accordance with delivery orders throughout the period of performance. The Government may visit the Offeror’s manufacturing facility to validate Offeror-provided information.
Manufacturing capacity addressing ability to produce and deliver.
Factor 1 Combined Technical/Risk Rating
The Government will use the following table to apply an adjectival rating in the evaluation of Factor 1. Deficiencies, strengths, weaknesses, and significant weaknesses will be assessed at the Element level under Factor 1.
Table 6: Combined Technical/Risk Rating Method
Color Rating
Adjectival Rating
Description
Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
004-12
Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
DEFINITIONS
1. Deficiency: A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
2. Strength: Any aspect of a proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
3. Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance.
4. Significant Weakness: A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.
Factor 2: Past Performance
The Government evaluates past performance submissions to determine if they are recent. To meet the consideration as recent, the performance must have occurred within three years of the RFP submission deadline.
The Government will evaluate recent past performance submissions for relevancy based on the Offeror’s experience performing tasks similar in size, scope, and complexity. Relevant defined as work similar in scope and magnitude to the work described in this solicitation. The Government will not take into account past performance information regarding predecessor companies. The Government may use information other than that provided by the Offeror in its proposal to evaluate past performance. The Government may use Past Performance information obtained from sources other than those identified by the Offeror such as the Contractor Performance Assessment Reporting System and Federal Awardee Performance and Integrity Information System (FAPIIS).
It is incumbent upon the Offeror to explain the relevance of the data it provides. The Government has no duty to search for data to cure the problems it finds in the information provided by the Offeror. The Offeror has the burden of providing thorough and complete past performance information.
004-13
Recent, relevant past performance submissions evaluation is to determine how well the Offeror performed on those contracts. The Government will establish an overall rating for the Offeror’s past performance in accordance with the ratings and descriptions outlined in Table 5.
Table 7: Past Performance Ratings
ADJECTIVAL RATING DESCRIPTION
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.**
Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort
** In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability or unacceptability, a neutral rating is acceptable.
Factor 3: Small Business Participation
The Government will evaluate the SB Participation Factor as acceptable or unacceptable.
The Government will evaluate the extent to which the Offeror’s SB Participation Plan demonstrates commitment to using SBs, SDBs, WOSBs, HUBZone SBs and SDVOSBs in performance of the contract.
The Government will evaluate the extent to which the Offeror’s proposal and other performance information available to the Government demonstrates a history of successfully supporting Government policies concerning utilization of small business concerns as subcontractors including, when applicable, achievements against established small business subcontracting plan goals for other than small businesses. Offerors will also be evaluated on the levels of small business participation proposed and the degree of commitment to use named sources. The anticipated benefits of proposed initiatives and tools to enhance small business participation and capabilities will be considered. The Government will assess proposal realism and the likelihood of success in achieving the Government’s Small Business Participation objective for this acquisition of 10% using the ratings in Table 4 below.
Table 8: Small Business Participation Ratings
RATING EVALUATION CRITERIA
004-14
Acceptable Proposal indicates an adequate approach and understanding of small business objectives.
Unacceptable Proposal does not meet small business objectives.
Small Business Subcontracting Plan (for other-than-small businesses only). This is NOT an evaluation factor. The Small Business Subcontracting Plan requirement is mandatory for award to a large business. Each large business offeror’s Small Business Subcontracting Plan will be reviewed in accordance with FAR clause 52.219-9 Alt II, Small Business Subcontracting Plan. The plan will be reviewed for acceptability. The plan will be incorporated into any resultant contract.
Factor 4: Price
The Government will evaluate each Offeror’s price for completeness and reasonableness. The Government will calculate price by totaling the sum of all CLINs (CLIN quantity multiplied by CLIN unit price). The Government will not entertain step-ladder pricing. In its evaluation, the Government may use published data, same or similar DOD contracts, government estimates, industry standards, Defense Contract Audit Agency (DCAA) audit information, or other appropriate information to determine reasonableness. All price information shall be in U.S.
dollars. Prices are to be Free On-Board (FOB) Destination.
A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful Offeror within one year from date of the offer, shall result in a binding contract without further action by either party. Before the one year expiration time, the Government may accept an offer (or part of an offer), regardless whether there are negotiations after its receipt, unless the government receives a written notice of withdrawal before award.
52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (AUG 2020)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision-
