Section M - Evaluation Factors for Award
52.212-2 Evaluation-Commercial Products and Commercial Services (NOV 2025)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Factor 1: Technical Capability &Approach
Factor 2: Past Performance
Factor 3: Price
Factor 4: Treasury APU 26-01
Factor 1 is more important than Factor 2. Factors 1 and 2, when combined, are significantly more important than Factor 3.
Factor 4 will be evaluated on an Acceptable/Unacceptable basis and will not be included in the comparative tradeoff.
As quotations become more equal under Factors 1 and 2, Factor 3 will become increasingly important.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
EVALUATION CRITERIA:
1) BASIS FOR CONTRACT AWARD
Unless all quotations are rejected, the Government intends to make a single award to the responsible Offeror whose quotation represents the best value to the Government, considering the evaluation factors identified below.
The Government will conduct a comparative evaluation of quotations. Under Factor 1 - Technical Capability & Approach, the Government will compare the relative advantages and disadvantages of the quotations. Under Factor 2 - Past Performance, the Government will evaluate the Government's confidence in the Offeror's ability to successfully perform the requirement. Factor 3
- Price will be evaluated for fairness and reasonableness and considered in relation to the non-price factors. Factor 4 - Treasury APU 26-01 Compliance will be evaluated on an Acceptable/Unacceptable basis and will not be included in the comparative tradeoff. A quotation rated Unacceptable under Factor 1 or Factor 4 will be ineligible for award.
The Government may select a higher-priced quotation when the comparative advantages of that quotation are determined to warrant the price premium. Conversely, the Government may select a lower-priced quotation when the advantages of a higher-priced quotation are not determined to warrant the additional cost.
The Government reserves the right, but is not obligated, to conduct discussions or exchanges with one or more Offerors in accordance with the solicitation and applicable acquisition procedures.
2) EVALUATION FACTORS
The award decision will be based on the Government's evaluation of quotations under the factors identified below. Offerors shall submit sufficient information in their quotations to permit the Government to evaluate their capability to successfully perform the requirements of the solicitation.
The comparative assessment under Factor 1, together with the Government's evaluation of Factor 2 and Factor 3 will be used to determine the quotation representing the best value to the Government. Factor 4 is not weighted and will be evaluated solely on an Acceptable/Unacceptable basis. A quotation rated Unacceptable under Factor 1 or Factor 4 will be ineligible for award.
The following factors shall be used to evaluate offers:
Factor 1: Technical Capability &Approach
Factor 2: Past Performance
Factor 3: Price
Factor 4: Treasury APU 26-01 Compliance
a. FACTOR 1: TECHNICAL CAPABILITY &APPROACH
The Government will comparatively evaluate quotations to determine the extent to which each Offeror demonstrates a clear, practical, and supportable approach to successfully performing the PWS requirements.
The Government will evaluate:
•Staffing and response capability;
•Availability and adequacy of equipment and resources, including backup resources; and
•The completeness and practicality of the proposed technical approach.
The Government will compare the relative advantages and disadvantages demonstrated by the quotations and the extent to which each approach provides confidence in successful performance.
Quotations that fail to meet the minimum technical requirements of the solicitation will be rated Unacceptable and will not be considered further for award.
b. FACTOR 2: PAST PERFORMANCE
The Government will evaluate the relevance and quality of the Offeror's recent past performance to determine the Government's confidence in the Offeror's ability to successfully perform the required services. The Government may consider information provided by the Offeror, Contractor Performance Assessment Reporting System (CPARS), and other sources available to the Government.
The Government will consider the past performance of the prime contractor and proposed subcontractors, as applicable, based on the relevance of their prior work to their respective proposed roles and responsibilities. The Government will assess this information collectively to determine its confidence in the Offeror's ability to successfully perform the contract. The significance assigned to each past performance reference will depend on its relevance to the entity's proposed role and responsibilities under this requirement.
As part of the best-value tradeoff, the Government may comparatively evaluate the underlying past performance information of Offerors receiving the same or similar confidence ratings.
Offerors without relevant past performance will receive a neutral assessment and will not be evaluated either favorably or unfavorably.
c. FACTOR 3: PRICE
The Government will evaluate the Offeror's firm-fixed unit prices using the estimated quantities identified in the Schedule. The evaluated price for the Base Period and each Option Period will be calculated by multiplying the Offeror's firm-fixed unit prices by the applicable estimated quantities identified in the Schedule.
The Total Evaluated Price (TEP) will consist of the evaluated price for the Base Period, all Option Periods, and the evaluated price of the potential six-month extension under FAR 52.217-8.
For purposes of evaluating the potential extension under FAR 52.217-8, the Government will apply the firm-fixed unit prices proposed for Option Year 4 to the estimated quantities identified for the FAR 52.217-8 evaluation within Attachment 4, Price Sheet. The resulting amount will be included in the TEP solely for evaluation purposes. Evaluation of the potential extension does not obligate the Government to exercise FAR 52.217-8 or order any particular quantity during an extension period.
If FAR 52.217-8 is exercised, services will be ordered and paid at the applicable firm-fixed unit prices in effect during the final Option Period, subject to the terms and conditions of the contract.
As a pre-condition to receiving award, the awardee's pricing must be fair & reasonable. The Government will determine whether pricing is fair & reasonable in accordance with RFO Part 12. The Government may compare quoted prices with other quotations received, historical prices, market research, independent Government costs estimates, or other relevant pricing information.
Note that the Government:
a. Reserves the right to discuss price with offeror(s) found to be technically acceptable to fulfill these requirements and to request a revised quote.
3) RATING METHODS
a. FACTOR 1: TECHNICAL CAPABILITY &APPROACH
Quotations will first be evaluated to determine whether the proposed Technical Capability & Approach meets the minimum requirements of the solicitation.
Acceptable: The quotation demonstrates an adequate understanding of the requirement and a practical approach to performing the required services. The proposed staffing and response capability, equipment and resources, and technical approach demonstrate the Offeror's ability to meet the PWS requirements.
Unacceptable: The quotation fails to demonstrate an adequate understanding of the requirement or a practical approach to performing the required services, or fails to demonstrate the staffing and response capability, equipment and resources, or technical approach necessary to meet the PWS requirements.
A quotation rated Unacceptable under Factor 1 will not be considered further for award.
Among quotations rated Acceptable, the Government will conduct a comparative evaluation of the relative advantages and disadvantages of each Offeror's Technical Capability & Approach. The Government will consider the significance of those differences in determining which quotation represents the best value.
b. FACTOR 2: PAST PERFORMANCE
Table 1. Past Performance Rating Method
Confidence Rating Definition
High Confidence Based on the Offeror's recent and relevant past performance, the Government has a high expectation that the Offeror will successfully perform the required services.
Some Confidence Based on the Offeror's recent and relevant past performance, the Government has a reasonable expectation that the Offeror will successfully perform the required services.
Low Confidence Based on the Offeror's recent and relevant past performance, the Government has a limited expectation that the Offeror will successfully perform the required services.
Neutral Confidence No recent or relevant past performance is available, or the Offeror's past performance record is too limited to permit a meaningful confidence assessment. A Neutral Confidence rating is neither favorable nor unfavorable.
c. FACTOR 3: PRICE
The price factor will not receive a rating, but the evaluated price must be found to be fair and reasonable in order to be eligible for award as indicated in Factor 3 - Price. The pricing evaluation will be based on price analysis techniques found in RFO Part 12 to determine if they are fair and reasonable. The Government reserves the right to communicate with one or more Offerors as permitted under the solicitation and applicable acquisition procedures. If an offeror's price is not found to be fair and reasonable, the offeror will not be eligible for award.
d. FACTOR 4: TREASURY APU 26-01 COMPLIANCE
The Government will evaluate the Offeror's Initial Staffing Plan for realism, balance, subcontract management approach, and compliance with FAR 52.219-14, Limitations on Subcontracting. The Government will verify that the proposed labor mix and prime/subcontractor workshare demonstrate compliance with the applicable limitations on subcontracting for the Base Period and each Option Period.
Acceptable: The Initial Staffing Plan is complete and demonstrates a realistic and compliant staffing arrangement consistent with Treasury APU 26-01 and FAR 52.219-14.
Unacceptable: The Initial Staffing Plan is incomplete or does not demonstrate a realistic and compliant staffing arrangement consistent with Treasury APU 26-01 and FAR 52.219-14.
An Unacceptable rating under this factor will render the Offeror ineligible for award.
