Instructions To Offerors
1. GENERAL INFORMATION
1.1 Offeror is expected to examine this entire Request for Quotation (RFQ). Failure to do so will be at the
Offeror’s own risk.
1.2 Quotes shall set forth full, accurate, and complete information as required by this RFQ package (including Attachments). The penalty for making false statements is prescribed in 18 U.S.C. 1001.
1.3 In responding to this RFQ, it is the Offeror’s responsibility to provide current, complete, and accurate information in their proposal. If in reviewing the proposal the Government identifies or otherwise learns that the provided proposal information is not accurate or misrepresents the Offeror’s status or capabilities, that information may be used by the Contracting Officer as part of the Offeror’s responsibility determination and could result in the Offeror not being eligible for award.
1.4 The quote must be clear, coherent, and prepared in sufficient detail for effective evaluation. Quote must clearly demonstrate how the Offeror intends to accomplish the work required and must include convincing rationale and substantiation of all claims. Offeror shall assume that the Government has no prior knowledge of their facilities and experience and will base its evaluation on the information presented in the quote. To be eligible for evaluation and award, offerors are required to substantially meet all solicitation requirements, such as terms and conditions, technical factors, and pricing information. Failure to comply with all terms and conditions of the solicitation may result in the offeror being removed from further consideration.
1.5 The Government may award a contract without discussions with offeror (except clarifications as described in
FAR 15.306(a)); therefore, the offeror’s initial quote should be clear and complete and contain the offeror’s best terms from a technical, past performance and cost/price standpoint. The Government reserves the right to conduct discussions if later it is deemed necessary. The Government further reserves the right to reject any or all offers if such action is in the Government's best interest.
2 QUOTE SUBMISSION AND PREPARATION
2.1 Quote Submission
Offerors shall examine and follow all instructions. Failure to do so may result in the quote being determined to be unacceptable, not evaluated further and removed from consideration for award. To aid in the evaluation, quotes shall be clearly and concisely written and well indexed (cross-indexed as appropriate) and logically assembled. Prospective Offerors are asked to bear in mind that all material submitted should be directly pertinent to the requirements of this RFQ. Extraneous narratives, elaborate brochures, uninformative “PR” material and so forth, shall not be submitted. An Unacceptable rating for Factors 1 through 3 will result in the elimination of an Offeror’s quote from consideration for award.
The quote that provides the lowest price and is otherwise technically acceptable in all factors will be selected for award. To be considered technically acceptable, no technical factor in the quote may be determined to be unacceptable. The failure of a quote to meet any of the factors will result in a technically unacceptable rating and preclude award. Offerors shall meet the requirements described in the performance criteria, as well as other solicitation requirements.
• TECHNICAL EVALUATION FACTORS
FACTOR 1 – Technical
The technical approach will be evaluated on how the offeror intends to organize, staff and manage the contract and the means that will be used to accomplish the contract requirements. The degree to which the quote demonstrates an understanding of the contract requirements will be evaluated, as well as the offeror’s planned management of consultants and subcontractors.
Failure to describe capabilities to meet all the technical requirements may deem the offer unacceptable and possible elimination from further consideration for contract award.
FACTOR 2 – Experience
The Offeror’s experience, past performance, and qualifications will be evaluated to determine the likelihood that the offeror can successfully perform the contract requirements and the degree of the risk of non-performance.
Offerors shall identify at least three (3) Federal, State, or Local, contracts that demonstrate recent and relevant experience. Recent is defined as within the last five (5) years. Offerors shall provide the following information:
Project Title Description of the Project Contract Number Contract Amount Point of Contact’s name, address, phone number and email address Contracting Officer’s name, address, telephone number and email address Current status, e.g. completed and/or in progress, start and estimated completion dates A brief narrative of why Offeror believes this reference is relevant to the proposed tasks.
Failure to provide a narrative of three (3) projects that demonstrate recent and relevant experience may deem the offer unacceptable and possible elimination from further consideration for contract award.
FACTOR 3 – Key Personnel
In order for an offer to be considered technically acceptable, the offeror must submit resumes and references of key professionals who will be assigned to this Project. The education, experience, and accomplishments of key personnel will be evaluated to determine the degree to which they possess the qualifications to perform their proposed duties under the contract.
Failure to provide the education, experience, and accomplishments of key personnel may deem the offer unacceptable and possible elimination from further consideration for contract award.
FACTOR 4 - Past Performance
Three (3) References from previously completed projects must be submitted and include a point of contact and phone numbers. These references must be relevant to the work which will be performed in this contract. Relevant work is defined as drug testing services as stated in the PWS. References must be recent within the past five (5) years. The Offeror shall arrange for the reference customer point of contact to fill out the Questionnaire and return directly to Brandy Idemudia, Contracting Officer, via e-mail at brandy.idemudia@bep.gov before the solicitation due date. The questionnaires must be forwarded directly by the references. Detailed instructions are included in a separate attachment Past Performance Questionnaire. The Government will not release the questionnaire forms to the Offeror at any time, in order for the Government to solicit candid, unbiased responses and comments.
The Government will assess the degree of success of Offeror’s recent and relevant past performance.
References will be asked to comment on items such as business relations, timeliness, quality of work, and cost. The Government will give an acceptable rating to documented successful outcomes that are supported by outside source confirmation (e.g. but not limited to telephone interviews with points of contact identified in the quote, agency performance databases such as Contractor Performance Assessment Reports (CPARS), offeror furnished references, or personal knowledge). Successful outcomes are defined as having received a rating of satisfactory or better, or the equivalent. If the Government does not obtain past performance information and cannot establish a past performance record for the offeror through other sources, or if the offeror has no past performance record, past performance will be rated neither favorably nor unfavorably and considered neutral. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.
FACTOR 3 - Cost/Price Quote Evaluation
The principal basis for evaluating cost/price for award under this solicitation will be an evaluation of the fair and reasonableness of the Offeror’s quote price in response to Section 2, Supplies or Services and
Prices/Costs. Cost/price quotes will be evaluated for completeness, accuracy, and reasonableness and to ensure that the Offerors understand the scope of the work included in the solicitation.
Cost/price quotes will not be rated adjectivally or scored. The cost/price that will be evaluated is the Offeror’s “total proposed cost/price.” As such, the Government will use any combination of the quote analysis techniques stipulated under FAR Subpart 15.404 or FAR 13.106-3 to aid in the price evaluation process.
Basis of Award - The Government intends to award a contract resulting from this solicitation to the responsible Offeror(s) whose quote(s) is based on the Lowest Price Technically Acceptable (LPTA) procedures in accordance with FAR 12, 13, and 15 as supplemented. Award will be made to the acceptable Offeror with the lowest evaluated price, which is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), FAR 15.101-2 LPTA Source Selection Process and 13.106-2 Evaluation of Offers, and whose quote conforms to the solicitation requirements. The Government will not award a contract on the basis of an unacceptable offer.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
52.212-3 Offeror Representations and Certifications—Commercial Products and Commercial Services (Feb 2024).
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision— Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
