About this file
This is a Department of the Army permit issued jointly by the U.S. Army Corps of Engineers, Jacksonville District, and the Northwest Florida Water Management District for a roadway construction project in Walton County, Florida. The permit authorizes Walton County Public Works to construct the Nellie Drive Right-of-Way Extension and Stormwater Infrastructure, extending approximately one mile from Chat Holley Road to U.S. Highway 98 near Santa Rosa Beach. The project includes construction of a two-lane rural roadway with curb and gutter collection systems and two hydraulically separate wet detention ponds for surface water management. The work involves discharging approximately 18,600 cubic yards of clean fill material into 4.43 acres of wetlands and 0.29 acres of ditches. The permit was issued on April 17, 2025, with a completion deadline of April 7, 2030. The permittee must submit a Commencement Notification within ten days of initiating work and as-built drawings with professional engineer certification within 60 days of project completion.
The permit includes multiple special conditions requiring the permittee to purchase 3.39 palustrine forested federal mitigation bank credits from the Nokuse Mitigation Bank prior to work commencement and to maintain erosion control measures throughout construction. Tree clearing is prohibited during May 1 through July 15 to protect the tricolored bat. The permittee must comply with all conditions specified in the Clean Water Act Section 401 water quality certification issued by the Northwest Florida Water Management District on October 3, 2024. No pricing information, set-asides, or incumbent vendor information is applicable to this permit document, as it represents regulatory authorization rather than a competitive procurement. The permit is conditioned upon compliance with federal and state environmental laws, immediate notification of any archaeological discoveries, and adherence to the approved project impact drawings and water quality certification specifications.

General Conditions:
1. The time limit for completing the work authorized ends on April 7, 2030. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area.

We will initiate the Federal and State coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places.
4. If you sell the property associated with this permit, you must obtain the signature and the mailing address of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions (Attachment 2).
6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.
Special Conditions:
1. The required verification shall reference this project's permit number SAJ-2024-01041 (SP–LMF).
2. The Permittee shall use only clean fill material for this project. The fill material shall be free from items such as trash, debris, automotive parts, asphalt, construction materials, concrete block with exposed reinforcement bars, and soils contaminated with any toxic substance in toxic amounts, in accordance with Section 307 of the Clean Water Act.
3. Prior to the initiation of any work authorized by this permit, the Permittee shall install erosion control measures along the perimeter of all work areas to prevent the displacement of fill material outside the work area into waters of the United States. The erosion control measures shall remain in place and be maintained until all authorized work is completed and the work areas are stabilized.
4. No structure or work shall adversely affect, impact, or disturb properties listed in the National Register of Historic Places (NRHP), or those eligible for inclusion in the NRHP. If, during the ground disturbing activities and construction work within the permit area, there are archaeological/cultural materials encountered which were not the subject of a previous cultural resources assessment survey (and which shall include, but not be limited to: pottery, modified shell, human remains, ceramics, stone tools or metal implements, dugout canoes, evidence of structures or any other physical remains that could be associated with native cultures or early colonial settlement), the Permittee shall immediately stop all work and ground-disturbing activities within a 100-meter diameter of the discovery and notify the Corps at the addresses listed in the Reporting Address Special Condition within the same business day (8 hours). The Corps shall coordinate with the Florida State Historic Preservation Officer (SHPO) to assess the significance of the discovery and devise appropriate actions.
5. The action falls within the range for the tricolored bat (Perimyotis subflavus) which is proposed to be federally listed under the Endangered Species Act. To avoid potential adverse effects on this species, the permittee agrees to forego tree clearing during May 1 – July 15. 6. Within 10 days from the date of initiating the work authorized by this permit, the
Permittee shall submit a completed “Commencement Notification” form (Attachment 3).
7. The Permittee shall have available and maintain for review a copy of this permit and approved plans at the construction site.
8. If information in the permit attachments conflict with the special conditions of this permit, the requirements of the permit special conditions shall prevail.
9. Within 60 days of completion of the work authorized by this permit, the Permittee shall submit as-built drawings of the authorized work and a completed “As-Built Certification by Professional Engineer or Surveyor” form (Attachment 5) to the Corps.
The as-built drawings shall be signed and sealed by a registered professional engineer or surveyor and include the following:

NOTICING PUBLICATION INFORMATION
The District’s action regarding the issuance or denial of a permit, a petition or qualification for an exemption only becomes closed to future legal challenges from members of the public (“third parties”), if 1) “third parties” have been properly notified of the District’s action regarding the permit or exemption, and 2) no “third party” objects to the District’s action within a specific period of time following the notification.
Notification of “third parties” is provided through publication of certain information in a newspaper of general circulation in the county where the proposed activities are to occur. Publication of notice informs “third parties” of their right to have a 21-day time limit in which to file a petition opposing the District’s action. However, if no notice to “third parties” is published, there is no time limit to a party’s right to challenge the District’s action. The District has not published a notice to “third parties” that it has taken final action on your application. If you want to ensure that the period of time in which a petition opposing the District’s action regarding your application is limited to the time frame stated above, you may publish, at your own expense, a notice in a newspaper of general circulation. A copy of the Notice of Agency Action the District uses for publication is attached. You may use this format or create your own, as long as the essential information is included.
If you do decide to publish a Notice of Final Agency Action, please provide the District a copy of the Proof of Publication when you receive it. That will provide us notice that action on this permit application is closed after the 21 days following publication.
Notice of Final Agency Action Taken by the Northwest Florida Water Management District
Notice is given that Environmental Resource permit number IND-131-317438-1 was issued on October 03, 2024, to Walton County Public Works for the construction of a new surface water management system for Walton County- Nellie Drive Extension. The project is designed to provide treatment and attenuation for an approximately 7.47-acre project located between U.S. Highway 98 and Chat Holley Road, at the current terminus of Nellie Drive, in southern Walton County. The proposed project consists of a new, 1.00-mile, roadway extension/alignment to the north from Nellie Road to Chat Holley Road. The new alignment will consist of a two-lane rural roadway section equipped with a curb and gutter collection system. The proposed surface water management system consists of two hydraulically separate wet detention ponds located along the eastern portion of the roadway alignment. The ponds have been designed to discharge toward either a mosquito control ditch or toward the northern right-of-way of U.S. Highway 98.
The project includes direct impacts to approximately 4.43 acres of wetlands and 0.29 acres of wet ditches, with approximately 3.52 acres of associated secondary impacts.
Impacts to wetlands will be offset through the purchase of credits from Nokuse Plantation Mitigation Bank.
