FA8903-20-R-0015 Section L INSTRUCTIONS, CONDITIONS, AND NOTICES TO RESPONDENTS FOR PROPOSAL PREPARATION USING SUBJECTIVE TRADEOFF SOURCE SELECTION PROCEDURES Base Realignment and Closure (BRAC) Environmental Construction and Optimization Services (BECOS) Midwest Region
1.0 Program Structure and Objective
(a) Under this solicitation “FA8903-20-R-0015”, the Government plans to award one (1) single award indefinite delivery/indefinite quantity (ID/IQ) basic contract for the BECOS program, Midwest Region. In addition, two (2) initial task orders (TOs) are intended to be awarded as a part of this solicitation. As a result, this acquisition includes evaluation of “TO (2)”, described below and in Section C of the solicitation. The BECOS requirements are follow-on contracts to current Base Realignment and Closure (BRAC) environmental remediation activities at BRAC installations. These performance based remediation (PBR) efforts support the AFCEC BRAC mission and enhance BRAC program capabilities within AFCEC/CIB. The requirements support a variety of environmental restoration services and construction necessary to maintain regulatory selected remedies, implement optimization to enhance remedial progress, and advance sites to completion in a cost effective manner. The efforts will be executed in accordance with technical and regulatory requirements to ensure protection of human health and the environment.
(b) The Midwest, region will be solicited as 100% Small Business Set-Aside. Offerors shall clearly indicate the region in which they intend to compete in their proposal on the title page of Volume I “Past Performance” and Volume II “Contract Documentation”. For Volume III “Price”, the region shall be identified on the title page of each volume.
| (c) The Government plans to make award based on the best interests of the Government. This solicitation is one (1) of six (6) similar solicitations for the BECOS program. |
| (d) This will be a single award indefinite delivery/indefinite quantity contract structure. An initial task order is intended to be awarded at the time of basic ID/IQ contract award to support a post award conference. A second task order for initial requirements, is also intended to be awarded. The sequence of awards for the regional IDIQ and subsequent task orders depends upon evaluation timelines and available resources. |
1.1 Budget/Funding Information
Funding will be obligated on each task order awarded under the basic contract. An initial task order is intended to be funded and awarded with the Basic ID/IQ award for a post award conference. A second task order is anticipated to be awarded for the TO (2) Performance Work Statement (PWS) provided as a part of this solicitation. Subsequent task orders will be funded as appropriate.
2.0 General Instructions
| (a) This section of the Instructions to Offerors (ITO) provides general guidance for preparing proposals as well as specific instructions on the format and content of the proposal. The Offeror’s proposal must include all data and information requested by the ITO and must be submitted in accordance with these instructions. Any Offeror who submits an incomplete package may be considered ineligible for award. The offer shall be compliant with the requirements as stated in the PWS, Contract Data Requirements List (CDRL) and entire Request for Proposal (RFP), including attachments. Non-conformance with the instructions provided in this ITO may result in an unfavorable proposal evaluation. |
| (b) The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal should not simply rephrase or restate the Government's requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet these requirements. Offerors shall assume the Government has no prior knowledge of their facilities and experience and will base its evaluation on the information presented in the Offeror’s proposal. |
| (c) Elaborate brochures, documentation, binding, detailed artwork, or other embellishments are unnecessary and are not desired. |
| (d) The proposal acceptance period is specified in Block 9 of the solicitation. The Offeror shall make a clear statement in Block 12 of SF 33, that the proposal is valid for 365 days. |
| (e) In accordance with Federal Acquisition Regulation (FAR) Subpart 4.8, “Government Contract Files”, the Government will retain one copy of all unsuccessful proposals. Unless the Offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals. |
| (f) Offerors should address questions, concerns, or requests for clarification in writing via email only. Questions received via telephone, fax, or letter will not be answered. All questions, concerns, or requests for clarification must be received by the point of contact(s) (POCs) listed below by no later than Thursday March 19, 2020 at 1300 - San Antonio, TX local time. 2.1 General Information
2.1.1 Point of Contact
The Contracting Officer (CO) is the point of contact (POC) for this acquisition. Address any questions or concerns you may have to the CO. Written requests for clarification may be sent to the address located in Block 7 of the solicitation.
2.1.2 Debriefings
Competitive Range: The CO will notify Offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR 15.505. Offerors excluded from the competitive range may request a pre-award debriefing or they may choose to wait until after the source selection decision to request a post-award debriefing.
Unsuccessful Offerors: The CO will notify unsuccessful Offerors in accordance with FAR 15.503. Upon such notification, unsuccessful Offerors may request and receive a debriefing. Offerors desiring a debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable.
2.1.3 Discrepancies
If an Offeror believes the requirements in these instructions contain an error, omission, or are otherwise unsound, the Offeror shall immediately notify the CO in writing with supporting rationale as well as the remedies the Offeror is asking the CO to consider as related to the omission or error. The Offeror is reminded the Government reserves the right to award this effort based on the initial proposal, as received, without discussion. The Offeror is also reminded that this reservation extends to the addition or substitution of pages of the initial proposal after receipt.
2.1.4 Electronic Reference Documents
All referenced documents for this solicitation are available on Contract Opportunities on the SAM.GOV website (https://beta.sam.gov). Potential Offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.
2.1.5 Oral Presentation
Oral presentations will not be accepted for this solicitation.
2.1.6 Amendments to Solicitation
If the RFP is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this request by the date and time specified in the amendment(s) by signing and returning the front page of each.
2.1.7 Submission, Modification, Revision, and Withdrawal of Proposals Proposals and modifications to proposals shall be submitted via email to the POCs located in paragraph 2.5 Distribution, showing the time and date specified for receipt, the solicitation number, and the name and address of the Offeror.
2.1.8 Communications
Exchanges of source selection information between Government and Offerors will be controlled by the CO. Email may be used to transmit such information.
2.2 Organization/Number of Copies/Page Limits
2.2.1 Title Pages
The Title Page of each volume must show solicitation number, region, name, address, and telephone number of the Offeror and e-mail address.
2.2.2 Proposal Organization Table
The Offeror shall prepare the proposal as set forth in Table 2.2.2.1, Proposal Organization. The titles and contents of the volumes shall be as defined in this table, all of which shall be within the required page limits as specified in Table 2.2.2.1. The contents of each proposal volume are described in the ITO paragraph as noted in the table below.

2.2.3 Page Limitations
Page limitations shall be treated as maximums. If exceeded, the excess pages will not be read or considered in the evaluation of the proposal. Page limitations may also be placed on responses to Evaluation Notices (ENs). The specified page limits for EN responses will be identified in the request. Each page shall be counted except the following: blank pages, title pages, tables of contents, tabs, indexes, glossaries, and those noted in the table as unlimited.
2.2.4 Cost or Pricing Information
All cost or pricing information shall be addressed ONLY in the Price Volume and Contract Documentation Volume, as applicable.
2.2.5 Cross Referencing
Each volume shall be written on a stand-alone basis so its contents may be evaluated without cross-referencing to other volumes of the proposal. Information required for proposal evaluation, which is not found in its designated volume, will be assumed to have been omitted from the proposal. Cross-referencing within a proposal volume is permitted when its use would conserve space without impairing clarity.
2.2.6 Table of Contents
Each volume shall contain a detailed table of contents to delineate the subparagraphs within that volume. Tab indexing shall be used to identify sections. Table of Contents do not count against the page limitations for their respective volumes.
2.2.7 Tables and Figures
The Offeror’s proposal shall include an indexed list of tables and figures. Tables and Figures do not count against the page limitations for their respective volumes.
2.2.8 Glossary of Abbreviations and Acronyms
Each volume shall contain a glossary of all abbreviations and acronyms used with an explanation for each. Glossaries do not count against the page limitations for their respective volumes.
2.2.9 Teaming / Subcontractors Lists
The Offeror’s proposal shall include a list of all teaming arrangements and subcontractors (if applicable) that will make up Labor Rates for IDIQ tables (see Price Volume); and/or partners and subcontractors proposed for task order 2. The list shall include company name(s), cage code(s), company location(s), and contact information. This section does not govern and is for information only. See the Contract Documentation Volume and Price Volume for pertinent information regarding teaming arrangements for this acquisition.
2.3 Page Size and Format
A page is defined as each face of a sheet of paper containing information. When both sides of a sheet display printed material, it shall be counted as two pages. Page size shall be 8.5 x 11 inches, not including foldouts. Page line spacing shall be single spaced. Except for the reproduced sections of the solicitation document, the text size shall be Times New Roman, no less than 12 points. Use at least 1 inch margins on the top and bottom and 3/4 inch side margins. Pages shall be numbered sequentially by volume. These page format restrictions shall also apply to responses to ENs.
2.4 Electronic Copies
The Offeror shall submit Volumes I through III in electronic format via email. If files are compressed, the necessary decompression program must be included. The electronic copies of the proposal shall be submitted in a format searchable by Microsoft (MS) Word 2007, 2010, or 2016; MS Excel 2007, 2010 or 2016; MS Power Point 2007, 2010 or 2016; and Adobe Acrobat (PDF).
All offerors intending to submit a proposal in response to this solicitation shall request a DoD SAFE link no later than (insert date/time). The email request shall include the name of the company, point of contact, phone number and email address. It is the Offeror’s responsibility to follow up with the contracting officer, if they do not receive a DoD SAFE link. Although, the DoD SAFE link will be valid be 14 days after receipt, the proposal due date and time for this solicitation is (insert date and time). Proposals received after (insert date and time) will be considered late.
All offerors shall submit a proposal in response to this solicitation no later than (29 April 2020 at 1300 San Antonio, TX local time). The email shall include the name of the company, point of contact, phone number and email address. It is the offeror’s responsibility to follow up with the contracting officer. The proposal due date and time for this solicitation is (29 April 2020 at 1300 San Antonio, TX local time).
Proposal Submission Deadline:
Volume I Past Performance and Volume II Contract Documentation are requested to be submitted by (30 March 2020 at 1300 San Antonio, TX local time).
Volume III Price is required to be submitted no later than (29 April 2020 at 1300 San Antonio, TX local time).
All items required herein must be received no later than (29 April 2020 at 1300 San Antonio, TX local time). Proposals received after (29 April 2020 at 1300 San Antonio, TX local time) will be considered late.
2.5 Distribution
Proposals shall be submitted to the POCs listed below. If applicable, be sure to advise the Administrative Contracting Officer (ACO) and the Defense Contract Audit Agency (DCAA) for prime and subcontractors that the proposal is “For Official Use Only” and “Source Selection Information – See FAR 2/101 and FAR 3.104”. Any formal communication shall be submitted in writing (via e-mail) to the POCs below. It is the Offeror's responsibility to confirm receipt of all formal communications. Late proposals will be excluded from the evaluation.

3.0 Volume I – Factor 1: Past Performance
3.1 Volume Organization
The past performance volume shall consist of the following sections:
a. Title/Introduction Page (Identify region)
b. List of Tables and Figures
c. Glossary of Abbreviations and Acronyms
d. Teaming/Subcontracting Lists
e. Present/Past Performance and Relevant Contract Narrative Information
f. Past Performance Questionnaire Section 1
g. Past Performance Questionnaire (completed and sent directly from third party)
h. CPARS Evaluations
3.2 General Instructions
Each Offeror shall only submit one (1) past performance volume with its proposal, containing past performance information (PPI). PPI submitted shall include at a minimum the company name, cage code, contract or task order number, location of performance, dollar amount, period of performance, project information, and offeror’s role (ie. prime, subcontractor). The Government will use data provided by each Offeror in this volume and data obtained from other sources to evaluate past performance.
3.3 Past Performance Information Submission
3.3.1 Instructions Regarding Recent Contracts
Offerors shall provide recent past performance information (PPI). To be recent, the effort must have been performed during the past five (5) years from the date of issuance of this solicitation. For present or ongoing efforts, the Offeror must have been performing the effort for 365 days from the date of issuance of the solicitation
3.3.2 Instructions Regarding Relevant Contracts
Present/Past Performance Relevant Contract Narrative Information shall not exceed the volume’s established page limit. Each Offeror is requested to submit up to five (5) recent contracts or task orders. Of these five contracts or task orders, a minimum of two (2) must be from Prime Offerors. Joint Venture Partners constitute Prime Offerors for purposes of this section. For a description of characteristics or aspects the Government will consider in determining recency and relevancy, see Section M of the solicitation.
3.3.3 Present/Past Performance/Relevant Contract Narrative Information, Specific Content
(a) Offerors shall explain what aspects of the contracts are deemed relevant to the proposed effort and to what aspects of the proposed effort they relate. This may include a discussion of efforts accomplished by the Offeror to resolve problems encountered on prior contracts as well as past efforts to identify and manage program risk. The Offeror shall clearly demonstrate management actions employed in overcoming problems and the effects of those actions, in terms of improvements achieved or problems rectified.
(b) The Present and Past Performance Information shall clearly indicate the division or corporate organization that performed or is presently performing the contract. Contracts listed may include those with the Federal Government, state and local governments or their agencies, and commercial customers.
3.4 Past Performance Questionnaire Submission
(a) Completed Past Performance Questionnaires (PPQ’s) associated with Volume I “Past Performance” are to be submitted for each relevant contract citation, IAW paragraph 3.3.1.
(b) Each offeror shall complete Section 1 of the Past Performance Questionnaire (PPQ). PPQ(s) shall be e-mailed to all points of contacts (POCs)/references that the Offeror has listed in their PPI. The POCs/references will complete the questionnaires and forward them by e-mail, directly to the POCs listed in this paragraph. Completed questionnaires can be provided as soon as possible. E-mail a completed copy of PPQ Section 1 to gregory.santiago.2@us.af.mil, alicia.kooda@us.af.mil, and 772ESS.PK.BECOS@us.af.mil.
(c) OFFERORS SHALL NOT SUBMIT QUESTIONNAIRES ON BEHALF OF POCs/REFERENCES. QUESTIONNAIRES MUST BE RECEIVED BY THE PPET DIRECTLY FROM POCs/REFERENCES. It is the Offerors responsibility to follow-up with respondents to ensure they have completed the questionnaires and confirm delivery of the questionnaires to the individuals listed herein.
3.5 Contract Performance Assessment Reporting System (CPARS) Evaluations Offeror’s are requested to provide CPARS evaluations for each relevant contract citation IAW paragraph 3.3.1, if available. Offeror’s submission of CPARS evaluations and any signed prime/subcontractor Authorization and Consent Letters (if applicable) shall be placed in Volume I. The prime Offeror may also instruct its partners to submit any CPARS containing proprietary information directly to the contracting officer.
4.0 Volume II – Contract Documentation
4.1 Volume Organization
The Contract Documentation Volume shall consist of the following sections:

4.2 Contact Information
Provide company/division's street address, county and zip code; Commercial and Government Entity (CAGE) code; Data Universal Numbering (DUNS) code; Taxpayer Identification Number (TIN); size of business (large or small); and labor surplus area designation. This same information must be provided if the work for this contract will be performed at any other location(s). List all locations where work is to be performed and indicate whether such facility is a division, affiliate, or subcontractor, and the percentage of work to be performed at each location.
4.3 Master Table of Contents/Proposal Checklist
(a) Provide a Master Table of Contents for the entire proposal (all volumes).
(b) Proposal Checklist – Please provide checklist with the number of documents and their titles that you or any of your partners are intending for the government to receive in your submission. Our team will utilized this to verify receipt of submissions.
4.4 Validity Statement
(a) The cover letter shall include the Offeror’s confirmation that the proposal is valid for 12 months.
(b) The proposal acceptance period is specified in the SF 33, Page 1, Block 12 of the model contract/solicitation.
4.5 OCI Analysis and Mitigation Plan
(a) If your company (including Prime, Teaming Partners, subcontractors, subsidiaries and legacy companies) performed any related work in the past/present at sites identified as part of this requirement, the Offeror shall submit identifying information – scope, applicable sites, specific document titles and descriptions, and contract or task order number in Volume II, Contract Documentation. The Offeror shall identify any potential OCI issues or appearance of any potential OCI your company, (including all Prime contractors, Teaming Partners, subcontractors, subsidiaries and legacy companies) may have with respect to the scope of effort as outlined in the PWS. For example, Offerors should report on any Advisory & Assistant Services (A&AS) support for related projects such as work that supports the BRAC program. OCIs may exist at least in the following three ways:
· Unequal access to information- access to non-public information that gives a contractor an unfair competitive advantage.
· Biased ground rules- when a contractor has in some sense set the ground rules for another procurement action creating the potential that the contractor may have tilted the playing field in the new competition (usually toward its own strengths and away from its weaknesses).
· Impaired objectivity - when the contract requires exercise of judgment and the independence of its judgment may be affected (e.g., when the contractor may be required to evaluate its own work in a way that could be adverse to its economic interests).
(b) If your company did perform past/present related work at the sites for this acquisition, and/or provided consultative services to the BRAC program (e.g. Advisory and Assistance Services contracts), a mitigation plan shall be submitted in Volume II, Contract Documentation Volume to show how your company will either satisfactorily mitigate or eliminate any potential OCI issues or appearance of any potential OCI. If your firm, including all Prime, Teaming Partners, subcontractors, subsidiaries, and legacy companies, has not performed any work on the sites included as part of this requirement, then the Offeror must so state.
(c) Any submitted OCI analysis and plan will not be evaluated unless the Offeror is considered the apparent successful Offeror under the evaluation Factors listed in this RFP. If the OCI analysis and plan needs to be evaluated, the Government will determine if an OCI exists and whether adequate mitigation is proposed. If adequate mitigation is not proposed, the Government may engage in exchanges with the apparent successful Offeror to determine if the problems with the mitigation plan may be resolved. If an OCI exists that cannot be adequately mitigated, the Government may seek waiver of the OCI issue or may award to another Offeror who does not have an OCI, or who has an OCI and has submitted a mitigation plan that is adequate or may be made so after exchanges between the Government and the Offeror.
4.6 Teaming Arrangements and/or Letters of Intent: Letters of Withdrawal
(a) If applicable, Offerors shall provide a Teaming/Subcontracting List. This information is subject to a page limit of five (5) pages (per appropriate volume) as noted in Table 2.2.2.1 Proposal Organization.
(b) If applicable, Offerors shall provide written contract teaming arrangement agreements, subcontracting letters of intent and other necessary agreements associated with joint ventures and mentor-protégés. All associated parties must sign the corresponding agreements. This information will not be counted towards Offerors page limitations (unlimited) as noted in Table 2.2.2.1 Proposal Organization.
4.7 Model Contract
(a) The purpose of this section is to provide information to the Government for preparing the contract document and supporting file.
(b) The Offeror’s proposal shall include a signed copy of the Model Contract (Sections A thru J). Signature by the Offeror on the Standard Form 33 constitutes an offer, which the Government may accept. The "original" copy shall be clearly marked under separate cover.
4.8 Solicitation
Section A - Solicitation/Contract Form Complete blocks 12-18 of the Standard Form 33, Solicitation, Offer and Award (SF33). Signature by the Offeror on the SF33 constitutes an offer, which the Government may accept.
Section B - Supplies or Services and Costs/Prices The Offeror shall not complete Section B, but refer to Section 5 below for instructions for completing the price matrices.
Section H - Special Contract Requirements All Unique Contract Requirements are described in the special clauses in Section H of the RFP. The Offeror shall provide required information to complete special clauses as required.
Section I - Contract Clauses All other contract clauses are listed in Section I of the RFP. The Offeror shall provide required information to complete clauses as required.
Section K - Representations, Certifications, and other Statements of Offerors Complete representations, certifications, acknowledgments and statements. Offeror is required to fill out an online provision FAR 52.204-8, “Annual Representations and Certifications (Oct 2018)”. The Offeror shall insert “none” into FAR 52.204-8(d) [if applicable] to indicate that the fill-in was not missed.
4.8.1 Exceptions to Solicitation Requirements
(a) Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or Subfactor(s). Failure to meet a requirement may result in an offer being ineligible for award. Offerors shall clearly identify any exceptions to Terms and Conditions of the model contract. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being removed from consideration for award.
(b) Exceptions taken to terms and conditions of the model contracts, to any of its formal attachments, or to other parts of the solicitation shall be identified.
(c) Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken.
(d) Provide rationale in support of the exception and fully explain its impact, if any, on the performance, schedule, cost, and specific requirements of the solicitation.
(e) This information shall be provided in the format and content of Table 4.8.2. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being removed from consideration for award.

4.9 Authorized Offeror Personnel
Provide the name, title, and telephone number of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.
4.9.1 Estimating Methodology Utilized in Pricing Proposal-if this section does not apply then include any exceptions to the below items.
Estimating System
Provide a summary description of your standard estimating system or methods. Also, identify any deviations from your standard estimating procedures in preparing this proposal volume. Indicate whether you have a Defense Contract Management Agency (DCMA) determination of adequacy of your system and if so, provide evidence of such adequacy determination.
Purchasing System
Provide a summary description of your purchasing system or methods (e.g., how material requirements are determined, how sources are selected, when firm quotes are obtained, what provision is made to ensure fair and reasonable pricing from subcontractors and vendors as well as other discounts obtained from teaming partners or vendors, including quantity discounts). Also, identify any deviations from your standard procedures in preparing this proposal. Indicate whether you have DCMA determination of adequacy of your system and if so, provide evidence of such adequacy determination.
Accounting System
Provide a summary of your current accounting system. Offerors shall consider FAR 16.301-3(a)(3), FAR 9.104-1(e), DFARS 209.104-1(e) when providing an accounting system summary. Indicate whether you have Government (DCMA) determination of adequacy of your accounting or cost estimating system and if so, provide evidence of such adequacy determination. Offerors that do not currently have an adequate accounting system shall complete a “Pre-award Accounting System Adequacy Checklist” found in DFARS 252.215-7009 “Proposal Adequacy Checklist 2014-01”.
Both small and large businesses shall provide a summary of their accounting system.
If the Offeror is a large business, they shall provide their current Cost Accounting Standard (CAS) Disclosure Statement and discuss any pending revisions applicable to this solicitation.
5.0 Volume III – Factor 2: Price
5.1 Price Volume Organization
Offerors shall submit a Pricing Volume for the region in which they are proposing. On each of the following, Task Oder 2 Model, FFP FBLR Table and Compensation Plan Model, Offerors shall identify the region (Midwest).
The regional price volume shall include all of the following sections:
a. Table of Contents
b. Glossary of Abbreviations and Acronyms
c. Price Assumptions, Exceptions, and Rationale
d. Regional Task Order (2) Model (TO2 Model). Excel is the only acceptable format.
e. Regional FFP Fully Burdened Labor (FBLR) Table (FFP FBLR Table) (prime Offerors may propose up to four (4) team members in the team FFP FBLR Table). Excel is the only acceptable format.
f. Professional Employee Compensation Plan Narrative (one (1) separate Narrative per region per team (one FBLR for entire team) or one (1) for each separate team member (if proposing separate FBLRs)
g. Professional Employee Compensation Plan Model (Compensation Plan Model) (one (1) separate region specific Model per region per team (one FBLR for entire team) or one (1) for each separate team member (if proposing separate FBLRs). Excel is the only acceptable format.
5.2 General Instructions
This section is to assist the Offeror in submitting information required to evaluate the Completeness, Reasonableness, Balance and Professional Compensation Plan realism of Offeror’s proposed prices. Compliance with these requirements is mandatory and failure to comply may result in rejection of Offeror’s proposal.
a. The burden of proof for credibility of proposed prices rests with the Offeror at the time of proposal or during subsequent discussions (if any are held). The price proposal shall not include information beyond that required by this instruction unless the Offeror considers it essential to document or support Offeror’s position.
b. All information relating to the proposed price, including all required supporting documentation and/or assumptions of the proposal must be included in the Price Volume and Contract Documentation Volume, as applicable.
c. For evaluation purposes and establishment of Fully Burdened Firm Fixed Price (FFP) Labor Rates (FBLRs), Offerors are required to submit only FFP pricing. A cost CLIN will be established in the basic contract and if used, will be evaluated at the Task Order level.
d. Adequate price competition is anticipated; and therefore, at this time, Offerors are not required to submit Certified Cost or Pricing Data in accordance with FAR 15.403-1(c). If, after receipt of proposals, the Contracting Officer (CO) determines there is insufficient data to determine price reasonableness or adequate price competition is not established and none of the exceptions in FAR 15.403-1 apply, Offerors may be required to submit additional data in accordance with FAR 15.403-3 or FAR 15.403-4, respectively.
e. Identify any assumptions and exceptions taken to the pricing requirements for each region as stated in this solicitation. Provide complete rationale for each assumption and exception. Do not cross reference to/from any other proposal volume.
f. Annotate “none,” if no assumptions or exceptions apply. Information provided for exceptions and assumptions will assist the price evaluation team in determining completeness, reasonableness, balance, and professional compensation plan realism.
g. All dollar amounts in the proposal shall be rounded to the nearest dollar except labor rates, which shall be rounded to the nearest cent.
h. For evaluation purposes and establishment of Firm fixed prices for Task Order 2 and the FFP FBLR Tables, complete the regional Task Order (2) Model and the regional FFP FBLR Table (the prime and up to four (4) additional team members FBLRs may be included in one FFP FBLR Table ). Follow the instructions on the first tab of each attachment.
i. Price Proposal documents shall not be password protected.
j. All Microsoft Excel spreadsheets shall be submitted in Microsoft Excel format (no PDF).
5.3 Total Proposed Prices (TPPs) and Total Evaluated Price (TEP) Offerors price reasonableness evaluation will be based on the Total Proposed Price (TPP) for the proposed regional Task Order (2) Price Model and the Total Proposed Price (TPP) for the regional FFP FBLR Table. The TPPs shall be combined to develop the Total Evaluated Price (TEP) for each Offeror. The TEP will be evaluated for price reasonableness. Note that an unreasonably high proposed TEP may be grounds for eliminating a proposal from competition either on the basis that the Offeror does not understand the requirement or has made an unreasonable proposal.
5.4 Regional FFP Task Order (2) Price Models
a. Task Oder 2 Model, Offerors shall identify the region (Midwest) in the model.
b. Task Order (2) shall be firm fixed priced (FFP), using the Task Order (2) Price Model. Offerors shall provide a completed Task Order (2) Price Model for the proposed region in the price volume. Offeror shall propose FFP prices for each CLIN identified in the model.
c. The Task Order (2) Price Model includes FFP CLINs for both Non-Severable (NS) and severable performance. NS CLINs are for Performance Based Services. Severable CLINs will be for the base year and Fiscal Years (FY) 1 through nine (9) for the ten (10) year performance period. Performance Based Payment plans (PBPs) i.e. milestones, completion criteria and prices will be negotiated for the region with the successful offeror at the task order level. The FFP totals proposed for each NS CLIN will be the ceiling prices used for development and negotiation of the PBPs.
d. For evaluation purposes only, a six (6) month extension IAW 52.217-8, Option to Extend Services, is included in the regional FFP Task Order (2) Price Model. The six (6) month extension is pre-calculated to ½ of the final year's proposed severable CLINs prices.
e. The CLIN prices proposed for NS CLINs and the base year, each option year and the six month extension will be automatically totaled and the totals moved to the “Roll Up” tab. The Task Order (2) Roll Up tab has a cell for entering each offeror TPP form the FFP FBLR Table. The TPPS for Task Order (2) and the FFP FBLR Table will be combined on the roll up tab and used to develop the Total Evaluated Price (TEP). The TEP resulting from all proposed CLIN prices on all tabs and the FBLRs in each of the proposed FFP Task Order (2) Price Model and the regional FFP FBLR Table will be the TEP that is evaluated in the competition. It is the prime Offeror’s responsibility to confirm receipt of all attachments with the CO.
f. All Microsoft Excel spreadsheets shall be submitted in Microsoft Excel format (no PDF).
5.5 Regional FFP Fully Burdened Labor Table (one (1) region team FFP FBLR Table) (prime Offerors may propose up to four (4) team members (maximum of five (5) members total) in the team FFP FBLR Table)
a. FFP FBLR Table, Offerors shall identify the region (Midwest) in the table.
b. Prime Offerors shall provide a regional FFP FBLR Table for the proposed region in the price volume. The Regional FFP FBLR Table contains FBLR tabs with all Labor Categories (LCATs) anticipated to be used in that region throughout the life of the basic ID/IQ contract and subsequent task orders.
c. Offerors may propose separate labor rates for each team member (prime, teaming partners, and/or joint ventures). If proposing as separate team members the prime shall ensure a separate FBLR tab is included in the team regional FFP FBLR Table for each team member up to four (4) team members (prime and four (4) team members). Each team member proposing FBLRs shall complete a separate FBLR tab in the FFP FBLR Table for that specific region. Prime Offerors shall ensure all team member tabs are included in the team FFP FBLR Table.
d. All labor categories identified in the FFP FBLR Table shall be covered and proposed collectively by the prime and/or team members. The FBLRs proposed by the team shall be Fully Burdened FFP labor rates for each LCAT for the ten (10) year performance period indicated in the each proposed regional FBLR tab. Regional Fully Burdened FFP labor rates shall include hourly base rates, indirect rates and profit, plus out-year escalation, as applicable, for the base year (Fiscal Year (FY) 21 and nine (9) FY option years). Each FY is the same as the Government’s Fiscal Year: 1 October through 30 September. Any performance required prior to FY21 will utilize FY21 rates.
e. FBLR tabs within the FFP FBLR Table will automatically average the proposed base year and all option year FBLRs by LCAT. The LCAT averages will then be automatically copied to the FBLR Table Roll Up tab for each team member. Prime Offerors shall ensure each team member average rates are correctly moved to the Roll Up tab. The government has provided evaluation hours on the Roll Up tab for the regional FFP FBLR Table. The evaluation hours are for evaluation purposes only. Team member average FBLRs will be averaged (average of the average) on the Roll Up tab by LCAT and multiplied by the evaluation hours for each LCAT to develop a price for each LCAT. LCAT prices will be automatically totaled to develop the FFP FBLR Table Total Proposed Price (TPP).
f. The team may propose one (1) FFP FBLR Table for the entire team. If the team is proposing one (1) FFP FBLR Table the FBLRs shall be entered in the prime tab of the table.
g. All proposed FFP FBLR tables will be incorporated into the basic contract should the Offeror be awarded a contract and used on subsequent task orders. All average columns and the FBLR Roll Up tab will be removed (deleted) prior to the FFP FBLR Table being incorporated into the basic contract should Offeror be awarded a contract. It is the prime Offeror’s responsibility to confirm receipt of all attachments with the CO.
h. Enter the Offeror’s labor category nomenclature in the column provided.
i. Labor category qualifications and levels are given on the Qualifications & Experience tab of the FFP FBLR Table.
j. The Regional Fully Burdened FFP labor rates as proposed in the FFP FBLR Table shall be contractually binding ceiling rates should Offeror be awarded a contract. The ceiling rates shall be utilized for task orders, and task order modifications; however, discounted or lower rates may be proposed.
k. Failure to propose one team FBLR or collectively as a team all LCATs for each proposed region will render the proposal incomplete and the entire proposal will be unacceptable.
l. Prime Offerors must copy (move) the FFP FBLR Table Total Proposed Price (TPP) for the proposed region to the corresponding TPP cell on the Roll Up tab of the Regional Task Order (2) attachment for inclusion in Offerors Total Evaluated Price (TEP).
m. All Microsoft Excel spreadsheets shall be submitted in Microsoft Excel format (no PDF).
5.6 Professional Employee Compensation Plan (1) Compensation Plan Narrative and one (1) Compensation Plan Model Excel File for the region.
1. Offerors shall identify the region (Midwest) in their Compensation Plan.
1. In accordance with FAR Subpart 22.11 and FAR 52.222-46, Evaluation of Compensation for Professional Employees, Offerors shall submit a total compensation plan and supporting information setting forth salaries and fringe benefits proposed for the professional employees who will work under the basic contract and subsequent task orders.
1. Each prime Offeror and team members submitting Fully Burdened Labor Rates shall submit a separate Professional Compensation Plan Narrative (Compensation Plan Narrative) and Professional Compensation Plan Model (Compensation Plan Model) for the proposed region.
1. Offerors may propose one (1) Compensation Plan Narrative and one (1) Compensation Plan Model Excel File for the proposed region for the entire team if the team has proposed one (1) team FBLR table. Team base hourly salary support data must clearly link to proposed rates in the Compensation Plan Model.
1. The total compensation plan submitted in the proposal will not become part of the awarded contract.
1. The prime Offeror’s Compensation Plan (Narrative and Compensation Plan Model) shall be included in the prime contractor’s proposal. If needed, team members may submit their Compensation Plans (Narrative and Compensation Plan Model Excel Files) directly to the Contracting Officer.
5.6.1. Compensation Plan (Compensation Plan) Narrative (one (1) for each prime Offeror and team member submitting FBLRs) Provide a narrative of planned compensation, for all professional employee LCATs proposed for each region. Narrative fringe benefit data shall include a description of the benefits offered, and to which professional employee category(ies) the fringe benefits apply.
5.6.2 Compensation Plan Model (one (1) for each prime Offeror and team member submitting FBLRs).
1. Selected Government LCATs have been provided in the Compensation Plan Model. Only some LCATs have been selected for evaluation.
1. The prime Offeror and all team members proposing FBLRs shall provide contractor labor categories, base hourly salaries and fringe rates for each proposed professional LCAT listed in the Compensation Plan Model. Offerors may propose a single team compensation plan model if the team has proposed one (1) team FBLR table. The prime Offeror and/or all team members (if team members are submitting separate FBLRs) shall submit a separate Compensation Plan Model for each team member proposing FBLRs by proposed region.
1. The prime Offeror and all team members shall provide mapping of Offerors proposed base hourly salaries by LCAT to Offerors support documentation as well as mapping of Offerors labor categories to the Government’s anticipated labor categories.
1. If needed, teaming partners may submit their Compensation Plans (Narrative and Compensation Plan Model Excel Files) directly to the contracting officer. The prime shall indicate plans to be submitted and company name(s) on the proposal master index/checklist to facilitate confirmation of receipt. It is the prime Offeror’s responsibility to identify all team members and confirm receipt of all attachments with the CO.
1. Evaluation of compensation plans is intended to ensure the offeror understands contract requirements. Proposed compensation rates may vary by region according to the recruitment and employee retention conditions in the region.
1. Labor category qualifications and level definitions are included on the “Qualifications & Experience” tab.
1. If proposing more than one (1) Offerors labor category for a single Government labor category, provide Offerors categories and the calculations used to develop the base hourly salary for each specific Government labor category.
1. Provide recent surveys and/or studies from professional, public, and private organizations (e.g., Watson & Wyatt, Economic Research Institute, Bureau of Labor Statistics, etc.) used to support the proposed base hourly salaries. Identify the source of the provided surveys and studies (salary support data). If not using one of the sources listed above, explain the credibility of the source providing the surveys and studies.
1. Map all Offeror's labor categories to the Government categories and to Offerors base hourly salary support data.
1. Unrealistically low professional employee salaries may impair Offeror’s ability to attract and retain competent professional employees and may be viewed as evidence of failure to comprehend the complexity of the contract requirements. Unrealistically low approaches may result in a determination that the Offeror’s entire proposal is unacceptable.
