About this file
This is a Bid Bond form established by the County of Los Alamos Procurement Division in New Mexico for the Jemez Mountain Fire Protection Phase III Project. The bid bond serves as a surety instrument required from bidders submitting proposals for this water infrastructure project, which involves the construction and installation of four separate booster pumping stations housed in concrete masonry unit buildings of approximately 240 square feet each. The project scope includes pre-packaged and pre-ordered booster pumping systems with integrated pumps, valves, meters, fittings, controls, and electrical components installed on skids; fiber-optics line installation in existing conduit for interconnected controls and communications between booster stations; tablet chlorination system installation at Booster Station 4; and cleaning, pigging, and disinfection of the existing water system at Pajarito Ski Area prior to interconnection. The contract also requires cleaning of the existing Pajarito Ski Area tank including associated SCADA systems, tank mixer, backflow preventer, meter, hotbox, and electrical components.
The bid bond is set at five percent of the bidder's total bid amount and requires both the Principal (bidder/contractor) and a surety company authorized to conduct business in New Mexico to execute the instrument jointly and severally. The bond obligates the Principal to either enter into a contract with the County in accordance with the bid terms and provide any required performance and payment bonds, or alternatively, pay the County the difference between the bid amount and any higher amount the County must pay to engage another contractor to complete the work. The surety waives notice of any extensions to the County's bid acceptance period, and the bond remains in full force unless the Principal fulfills all contractual obligations or compensates the County for any increased costs resulting from the Principal's failure to perform.
