The purpose of this requirement is to procure at least one (1), and up to six (6) housing projects. The contractor shall provide all supervision, materials, labor, supplies, permits, licenses, transportation, travel, and equipment necessary to construct Cast-in-Place (CIP) houses located in Saipan. Construction consists of 1-, 2-, and 3-bedroom houses using designs, drawings, specifications, and submittal register provided by the Government and services provided in accordance with the Statement of Work (SOW) dated May 5, 2022 - This will be a Firm Fixed Price Contract (FFP). The evaluation Criteria will be specified in the solicitation - the method of selection will be Best Value Trade Off (BVTO) - this means that non-priced factors are approximately equal to price or cost. This Requirement is being restricted by authority of the Stafford Act to Small Businesses that are currently licensed to perform construction of residential homes and located within the Commonwealth of the Marianna Islands (CNMI). The requirement is broken into two (2) phases - Phase one (1) 90 days to complete and obtain all designs and permits.

Phase two (2) will be the physical construction of the homes - a separate NTP will be issued at each Phase. The Site Visit will be on 29 July 8:00AM at the construction site. Questions/RFI's are due by 12:01PM 2 August 2022, Proposals are due on 8 August 2022 at 2:00PM ( all times listed are local CNMI Time) The Government also reserves the right to Not Exercise, or just Partially Exercise the option, during the Period of Performance

PERMANENT HOUSING CONSTRUCTION (PHC) – New Construction STATEMENT OF WORK (SOW), May 5, 2022

CONTRACT: 70FBR922CXXXXXXXX

1. Background

On October 24, 2018, Super Typhoon Yutu, the strongest typhoon to impact the Commonwealth of Northern Marianas Islands (CNMI) on record caused catastrophic damage to the islands of Saipan and Tinian. Super Typhoon Yutu caused three deaths, downed power poles and damaged vehicles, schools, hotels, businesses, airports, and hundreds of homes on both islands.

The U.S. President signed a Disaster Declaration on October 26, 2018, making funds available to the Federal Emergency Management Agency (FEMA), to provide disaster assistance to eligible applicants on Rota, Saipan, and Tinian. Approved assistance included Stafford Act Section 408 authorizing the Individuals and Households Program. Additionally, pursuant to Stafford Act Section 408 and 44 C.F.R. 206.117(b)(4), Permanent Housing Construction (PHC) was also authorized for FEMA-DR-4404-MP. Accordingly, the Office of Response and Recovery (ORR), Recovery Directorate is seeking to replace eligible applicant’s housing affected by the disaster through the PHC program.

2. General Scope of Work The purpose of this procurement is to acquire construction services to construct up to 6 eligible PHC applicants’ dwellings for FEMA-DR-4404-MP in accordance with applicable Federal, State, and local laws, building codes and standards. The Contractor shall utilize the Architectural and Engineering (A&E) drawings and Specifications listed as Attachments 08(a) through 08(d) and 09 and any Delta drawings provided after contract award. A&E drawings are designed for a 1, 2, and 3-bedroom home under the PHC New Construction requirement. The A&E drawings are intended for Cast-In-Place (CIP) units. If any construction method other than CIP is to be proposed for use for this requirement, the Offeror shall identify in their proposal each type and where the method is to be used and justify why the method is a benefit to the U.S.

Government (USG). The Contractor shall have on-site at each house project for viewing, all updated applicable project documents for each Division of work per the USG provided Specifications to include, but not limited to design drawings, manufacturer data, project schedule, and approved shop drawings. The on-site shop drawings shall be a minimum size of 11” x 17”. This will ensure the documents used for construction in the field are the most current version approved by FEMA and helps to mitigate any delays and rework.

PHC shall be performed by a licensed contractor with the appropriate authorization(s) to work in the CNMI and more specifically Saipan and Tinian. The Contractor shall provide all supervision, materials, permits, licenses, equipment, and labor categories necessary to perform new construction as determined via this Statement of Work (SOW) and attached documents, and the terms and conditions of the contract. In accordance with FAR clause 52.225-11, the contractor is required to adhere to the Buy American Act (BAA) using BAA compliant construction materials, of average quality for the lowest price (“builder grade”), for the prescribed International Building Code (IBC) level determined for the PHC New Construction program. The Contractor is required to employ at a minimum 30% local labor, to the greatest extent practicable. With the Offeror’s proposal and throughout the contract performance, the Contractor shall identify all its Subcontractors and major material supplier(s) it plans to use in the performance of this contract.

STATEMENT OF WORK (SOW)

3. Tasks

a) The Contractor shall utilize the A&E drawings to develop a technical proposal for all construction which will be Cast-In-Place (CIP) for the construction of a 1, 2, and 3-bedroom homes located in Saipan and Tinian. The Contractor shall not deviate at any time from the Government provided specifications and drawings without prior Contracting Officer approved revisions.

b) The intent of the PHC – New Construction program is to place the new construction house on the same footprint as the damaged dwelling. If this cannot be done for reasons such as set-back requirements, location of septic systems, or other issues identified in the geo-technical report, the contract must provide an explanation of the reasons when the Civil Design is submitted for approval. In addition, any time a new location is approved, the damaged dwelling and slab must be demolished.

c) The Contractor shall obtain all required permits and comply with all applicable U.S. &

CNMI Environment and Historical Preservation (EHP) laws and building codes, as applicable. The USG mandates that the Contractor completes each house project within the agreed upon timeline in each Notice-to-Proceed (NTP).

d) For each new house to be constructed, the USG will provide architectural/engineering drawings for the house size authorized for construction. The Contractor shall conduct a site visit(s) to develop a Civil Design plan and package to include the new house layout and location, all site and utility connection requirement details, a detailed existing site condition and demolition plan to identify all required vegetation removal and tree removal or trimming, site grading and drainage plan, sewer system requirement and location to include a public sewer connection or septic tank and leaching field plan and profile. These documents are to be submitted as part of the package for the FEMA review prior to obtaining permits; part of their work plan submittal and completion timeline schedule for each house project.

e) Construction Standards: The Contractor shall ensure compliance with 2018 IBC standards. The Contractor shall be responsible for presenting to the FEMA Contracting Officer (CO) detailed cost estimates for construction utilizing CIP construction. Also, a separate submittal to include site plans/drawings containing required approvals from appropriate authorities in order to meet the required minimum standards referenced herein. The Contractor shall assess utilities as designated in the attached drawings and based on the specifications. The Contractor shall provide a functional septic system for each home, which may include connecting to the city sewer system if the house is within 200 feet of the city sewer line. All systems shall be approved by BECQ prior to construction work.

f) The PHC new construction program is subject to U.S and CNMI regulations including, but not limited to, CMC Title 155-10.1, Building Safety Code Rules and Regulations.

Title 155-10.1 stipulates procedures and requirements enforced by the Department of Public Works (DPW) related to the safe operation of buildings. DPW reviews and approves residential housing applications for permits prior to construction. Permit applications require plans that are signed and sealed by CNMI professionals. The USG furnished A&E plans developed by U.S. Army Corps of Engineers (USACE) for FEMA are exempt from being sealed because they are USG prepared and are developed for USG use, so long as they are not modified.

g) The Contractor shall follow the attached specifications and drawings and this statement of work. If there are any discrepancies between the specifications, drawings and/or statement of work or the Contractor has a recommended change; the Contractor shall, prior to executing the work, submit a Request for Information (RFI) to the FEMA Contracting Officer and COR for clarification. Some clarifications have already occurred. One such clarification is there are no Antiterrorism requirements for this project. Another clarification is for the Contractor to disregard the requirement in Section 28 31 00, paragraph 1.5 Quality Assurance in the specification requiring submitting “detail drawings prepared and signed by a Registered Professional Fire Protection Engineer…” for the fire alarm systems. A qualified electrical contractor can install the fire alarm system for the project. Another clarification is no laundry cabinet is required for 2-bedroom houses. Another clarification is the type of paint that shall be provided.

Per Section 09 90 00 specification, Latex paint shall be provided. Therefore, disregard the finish schedule on Sheet A-602 which specifies Acrylic paint.

h) For house projects identified as being in a Special Flood Hazard Areas (SFHA), the contractor shall provide all designs, obtain the proper permits, and build the house as required by U.S. and CNMI ordinances, regulations, directives, and guidelines. The contractor shall determine the Base Flood Elevation (BFE) using the correct flood map panel the house is to be constructed in from the Flood Insurance Rate Map (FIRM). The contractor shall, along with the site plan, submit a Flood Elevation Certificate stamped and signed by a certified surveyor with line C1 marked as Construction Drawings demonstrating the finished floor elevation is above BFE utilizing 1 foot of freeboard

(BFE+1).

Immediately after the slab on grade has cured enough to walk on and prior to any other construction work with line C1 marked as Building Under Construction, the contractor shall submit a Certified Signed and Stamped Elevation Certificate.

Finally, once the house is built and in the final PHC milestone stages, the contractor shall submit the final Certified Signed and Stamped Elevation Certificate with line C1 marked as Finished Construction, along with the Certificate of Occupancy document.

All three certificates must include photographs and be validated and approved by FEMA, prior to continuation of each phase of the project. Reference FEMA National Flood Insurance Program (NFIP) Elevation Certificate requirements for instructions on completing the elevation certificates. For houses located in a flood zone, there shall not be any electrical conduits placed under the slab foundation. The contractor shall ensure the new development/property does not cause increased flooding elsewhere or impose flood problems on other properties.

i) For all house project sites, except those identified as located in a SFHA flood zone, the Contractor shall construct a pedestal for the electrical service to the dwelling, in accordance with the guidelines from Commonwealth Utilities Corporation (CUC). The electrical service from the pedestal to the house shall be underground and may vary in distance from the house depending upon site conditions. Non-metallic conduit shall be buried to a depth of no less than 18 inches without being incased in concrete no less than 2 inches thick. If incased in 2 inch or greater thick concrete, the minimum depth shall be no less than 12 inches. Rigid metal conduit may be buried to a depth no less than 6 inches but must be incased in no less than 2 inches of concrete, except for when the buried conduit crosses a driveway or will be traveled across, then the minimum depth shall be no less than 18 inches. The pedestal shall have the electrical meter facing the main road that serves as the entrance to the dwelling in accordance with CUC guidelines. The pedestal detail included as Attachment 10 to this SOW serves as an example only. The contractor shall check with CUC for the pedestal details and location and obtain their written approval, which will accompany the Contractor’s site design submittal for the Government’s approval. The site design plan shall include the site map as to the CUC approved location and direction of the electrical mast weather-head, pedestal, underground electrical service location and details, house connection location and details, and any other planned work.

All house projects sites that are located within a flood zone shall use a service entrance that is attached to the dwelling and without any electrical conduits underground. The electrical service entrance may be placed on any wall so that the meter is facing the main road that serves as the entrance to the dwelling, in accordance with CUC guidelines. The conduit from the electrical service entrance to the main electrical panel shall be routed within the space above the dwelling’s ceiling but below the dwelling’s roof, in accordance with the USACE specifications. Any deviations shall be approved by the Government, prior to any work being performed.

Specifically, CMC Title 155-10.1 addresses the following:

• New construction and modification of existing buildings

• Permit process and fees (initial application)

• Rough in inspections/re-inspections (and associated fees)

4. Contractor Furnished Items & Services and USG Furnished Materials

(GFM):

a) The Contractor shall furnish all management resources, labor, materials, equipment, tools, and any other items necessary to perform all operations. The contract for this requirement will be a Fixed-Price.

b) The Contractor shall meet all logistical and administrative requirements for acquiring, mobilizing, and sustaining necessary laborers, including laborers in skilled trades. The Contractor must obtain all required building materials, vehicles, specialized equipment, and provide a fully qualified Project Manager who shall be responsible for the performance of work. The name of the person designated as the Project Manager, in addition to an alternate Project Manager shall be designated in writing and provided to the CO. The Project Manager shall have full authority to act for the Contractor. The Project Manager shall be on-site in Saipan, MP during normal work hours and available for contingencies requiring work beyond normal work hours (as instructed by the FEMA COR and/or CO). The designated Project Manager shall have written and verbal communications skills in English, and it is encouraged that the Project Manager position have Chamorro as a secondary language; however, this is not a requirement. The CO reserves the right to remove any Contractor staff who the USG deems unacceptable upon written notification.

c) If available, the USG may provide materials for the Contractor to draw upon for the PHC program house projects. USG Furnished Material (GFM) may be available on Saipan and Tinian. All GFM purchased by the Contractor shall be processed as a Request for Change (RFC) Credit to the USG contract.

5. Special Requirements:

• The Contractor shall establish its base of operations and management team on Saipan, MP to ensure close coordination with FEMA.

• The Contractor shall participate in at least one (1) weekly coordination meeting with the

FEMA COR and/or CO and provide meeting minutes for each weekly meeting. Other FEMA and Contractor personnel may be invited on an as needed basis.

• Upon completion of construction of a PHC house, the Contractor shall ensure the following before requesting final certification of occupancy: site is clear of all debris, hazards and machinery; all disturbed earth from construction activities has been remediated (fill and grade) to existing grade, if applicable; the interior is clean from construction materials / activities; and the house is load tested and ready for occupancy before requesting the final certification of occupancy from the CNMI permitting office. Prior to requesting a COR inspection, the Contractor shall ensure their Quality Control personnel have completed a full inspection and all work to be inspected is completed.

• In the event construction items have not conformed to the contract requirements, the Contractor and FEMA COR will develop a punch list to work from in order to meet the contract requirement. It is ultimately the Contractor’s responsibility to ensure all punch list items are completed, prior to requesting a final USG inspection.

• As part of the Contractor’s price proposal identified in the BID Price Breakdown Excel document in the solicitation, the Contractor shall purchase material and include construction of any accessibility features and accessible routes in accordance with the Americans with Disabilities Act Accessibility Guidelines (ADAAG) (http://www.statereview.com/adaag.htm) and the Housing and Urban Development’s (HUD) Design Details for Accessible Disaster Relief Housing. Houses identified as Access & Functional Needs (AFN) will require Contractor furnished items such as metal grab bars for shower and toilet areas, raised commode, shower seat, etc. For ADA homes per ADA Ramp and Handrails specifications, the Contractor shall construct landing areas and one concrete ramp, in accordance with the USG provided design. No walkways are required past the area at the base of the ramp. Once the ground is graded around the house, the ramp shall be placed towards the driveway parking area. Once the final grading is completed, the actual ramp shall be constructed to the required height and length. The Contractor shall construct the ramps in accordance with the USG provided designs and drawings. If the height of the ramp does not exceed six inches, no handrails are required.

• The Contractor shall be responsible for procuring, transporting, storing, securing and disposing of all construction-related materials used in the construction of the PHC houses and on-site debris at no additional costs to this Firm-Fixed-Priced contract.

• As applicable, the Contractor shall only use a licensed Architect or Engineering contractor authorized to work in the CNMI for specific task(s) designated for this labor category.

There may be additional labor regulations in the CNMI legislative code which the contractor is responsible to comply with as required. The Contractor shall state these codes within their project plan.

• The Contractor shall comply with inspection requirements mandated by the USG provided Specifications and CNMI building department which verifies the PHC house is being constructed in compliance with required permits. All Special Inspector reports shall be furnished to the USG, after the inspection is conducted.

• The Contractor shall set up a construction schedule and management plan based on local weather conditions forecasted for each month of the contract.

• The Contractor shall be responsible for Quality Control, Construction/Project Management, production schedule, site security and safety once the NTP(s) are issued.

• The Contractor shall allow FEMA or its Contractors/agents on the work site for the purposes of technical monitoring and quality assurance.

• The Contractor shall work with the local authorities to obtain permits and for utility identification and connection.

• The Contractor shall ensure all construction materials meet U.S. construction standards and are procured in compliance with the Buy American Act and all other applicable laws and regulations. The Contractor shall submit their plan to meet these construction standards by submitting the information with their Project Plan.

• The Contractor shall be responsible for obtaining all required bonds and permits for all phases of construction to include demolition, debris removal, disposal of materials, site preparation and construction. The Contractor must provide copies to the FEMA COR once obtained.

• The Contractor shall comply with any Federal, State or Local laws, regulations or other http://www.statereview.com/adaag.htm requirements to test for asbestos or lead (if needed) and complete any required abatement and associated debris removal.

• The Contractor shall coordinate the installation of essential utility requirements, to include but not limited to water and electrical connections, with CNMI Commonwealth Utility Company (CUC) to prevent impacting the delivery schedule. The Contractor shall contact the COR if there are any CUC homeowner issues, as they are identified. FEMA IA will work with homeowners on their CUC application for service and quickly resolve barriers to reconnection. The Contractor shall be responsible for paying for any disconnection fee, if necessary and shall pay for all utility connection fees.

• Unexploded Ordnance: If any item is discovered that may be an unexploded ordinance, the Contractor must stop work immediately and alert the FEMA Contracting Officer and COR and await further instructions from the FEMA Contracting Officer or COR. The FEMA COR will contact the appropriate agencies for handling of the unexploded ordnance.

• The Contractor shall comply with all applicable Environmental and Historical Preservation requirements mandated by Federal laws, CNMI officials, and the USG Contracting Officer.

This may include, but is not limited to, a requirement allowing a USG Archeologist or USG contracted Archeologist to be present on-site during any ground disturbing activities, such as debris removal, foundation or utility installation work, installation of septic systems, for work in Archeological sensitive designated areas. The Contractor must take appropriate action based on the Contracting Officer’s direction based on specific guidance provided by the Archeologist to protect/preserve Archaeological resources, as necessary. Since a USG/Contracted Archeologist’s presence is required during all ground disturbing events, such as, excavating work, digging, trenching, plowing, grading, post-installation work, each house project in an Archaeological sensitive area may be started independently from other Archaeological house projects awarded on the contract. Therefore, the Notice-to- Proceed (NTP) for each house project and schedule may be independent of the other Archaeological house projects NTP(s) and completion dates. Each Civil Design plan will require a FEMA EHP review prior to any debris removal, demolition activities, and any ground disturbing activities. Therefore, any time beyond a two-business day EHP review period, the NTP end date will be adjusted accordingly by the Contracting Officer for each day past the two-business day review period as an excusable Contractor delay. Prior to any ground disturbing activities, at least a 48-hour notification is required. This advance notice can be added to the Deliverable 5 requirement with the Daily and 48-hour look ahead schedule if it clearly identifies all ground disturbing activities. The Contractor may submit a written Request for Equitable Adjustment (REA) adjustment for any Contracting Officer directed changes or USG delays, which may require additional time and money to complete the house project.

• The Contractor shall obtain all permits within 60 calendar days of the Pre-construction house structure Phase I Notice-to-Proceed (NTP) start date for each property, except for any house project in an Archeological sensitive designated area. For Archeological sensitive area house projects, all permits shall be obtained within 90 calendar days from the Phase I NTP issuance effective date.

• The Contractor shall purchase and install a tankless hot water system, instead of the current hot water system called for in the drawings and specification, i.e., M-102/104, S-

311. The ECO 11 system meets all the USG’s requirements. The tankless water heater shall be placed in the laundry room – inside of the exterior wall. The water heater tank enclosure on D1 at S-311 will not be constructed.

• The Contractor shall procure and install storm window shutters on all windows. The window shutters must be able to be opened, closed, and locked from inside and outside of the house.

• Once construction is completed and the permit closed, FEMA will conduct a quality assurance inspection review and take possession of the keys from the Contractor in order to provide the keys to applicant. If there are items identified requiring remediation, FEMA and the Contractor shall develop an on-site list (punch list) of items requiring remediation at no additional cost to the USG. This list shall be submitted to the FEMA COR for work remediation.

• The contractor shall provide termite pre-treatment for all new construction properties.

• Any resulting contract or contract modification will be inclusive of clauses specific to construction and in accordance with FAR Part 36, to include bid guarantees and performance and payment bonds.

• The FEMA Contracting Officer is the only person who is authorized to make changes to any resulting contract/task order contract or contract modification. Changes to a contract/task order will be in writing via a contract modification.

6. Definitions

New Construction – as authorized by the Robert T. Stafford Disaster Relief and Emergency Assistance Act (Stafford Act), Section 408(c)(4), and implemented in 44 C.F.R. § 206.117.

FEMA may provide permanent and semi-permanent housing construction which must be consistent with minimal local building codes and standards where they exist, or minimal acceptable construction industry standards in the area, including reasonable hazard mitigation measures including storm shutters on all windows, and Federal environmental laws and regulations. Dwellings will be of average quality, size, and capacity, taking into consideration the needs of the occupant. PHC New Construction must comply with 2018 IBC standards.

Non-Standard House – A non-standard house project is defined as a house project that is located in an Archaeological or Biological sensitive designated area.

7. Period of Performance

The overall contract performance period is divided into two Phases, Phase 1 - Pre-Construction and Phase 2 - Construction. A separate NTP will be issued for each phase and will have a number of days associated with it which will determine the overall Period of Performance (PoP). The NTP completion dates for each individual house project may be adjusted due to unforeseeable delays. The final contract Period of Performance will be based on the latest NTP completion date issued and will be adjusted per contract modification.

The contractor shall have 10 days from contract award to provide all required Payment and Performance Bonds. Upon receipt of all required bonds Phase 1 NTP will be issued for all house projects.

Phase 1 – Pre-Construction will be for either 60 or 90 days, depending upon the type of property. Standard properties will have a maximum of 60 calendar days to complete all tasks.

For non-standard properties the NTP will be for 90 days due to the additional permitting, inspections, and monitoring. This phase includes time for site surveys, submission of civil designs, obtaining permits, ordering materials, damaged dwelling demolition, grading, and any required design changes.

Phase 2 – Construction will be a maximum of 150 calendar days for both standard and non-standard properties.

Five calendar days will be allowed between Phase I & II to allow the USG time to examine and approve all submittals prior to issuance of Phase 2 NTP. If the USG takes more than five calendar days to approve the required submittals, the overall contract PoP will be extended accordingly.

The maximum completion date for standards houses will be 225 calendar days and 255 calendar days for non-standard houses.

8. Areas of Operation

The Contractor shall be tasked with performing this requirement as directed by the USG;

nominally in or around multiple areas in Saipan and Tinian based on the USG’s need. The Contractor shall provide FEMA a schedule identifying construction work and where the construction is planned, no less than 72 hours prior to commencement of construction.

9. Experience / Skills

The Contractor shall provide personnel with all necessary expertise in construction and architectural/engineering, as needed. The Contractor shall identify any known shortfalls in skilled labor and provide immediate strategies and planned actions to mitigate the shortfall to the FEMA Contracting Officer and COR.

The Contractor shall conduct preliminary background checks on all staff assigned to the contract and receive favorable results. This process will increase the likelihood of personnel submitted for FEMA’s background investigation receiving approval.

10. Project Execution

a. The Contractor shall execute the permanent housing new construction mission per the purpose and scope, issued work orders, and approved Project Management Plan (identified in Section 11 below). The Contractor shall notify the FEMA COR as soon as practicable if there are unforeseen interruptions due to weather, hazardous conditions, safety issues, or other circumstances resulting in delays to the approved schedules. If there is a potential delay in the schedule, the Contractor shall notify the FEMA COR immediately of identification of a delay of any kind. All services listed in the Statement of Work shall be provided in compliance with applicable Federal, CNMI, and local laws and regulations.

b. Once the Contractor has conducted site visits to validate the scope of work assessment furnished by the USG and has developed the packet including site plans, to include all utilities, and has defined the scope of work using the architectural and engineering drawings for the house authorized for construction at that particular site; including the workplan and timeline for completion for each site; the package will be provided to the Contracting Officer and COR. The specific work site package will be evaluated in accordance with Federal Environmental Protection and Historic Preservation (EHP) laws and Executive Orders (EO), prior to submitting individual applications to the CNMI Department of Public Works (DPW) and Bureau of Environmental and Coastal Quality (BECQ) office for permits prior to construction. The detailed scope of work shall include the proposed location and footprint, demolition plans and vegetation removal, depth, and extent of excavation (including any underground utilities and connections), photographs, detailed site plans, and assessments for the property and new house requirement. No construction work can begin until the USG has concluded the EHP review, including any necessary consultation with CNMI and/or Federal regulatory agencies. Once approved by the Contracting Officer, the Contractor shall proceed with the permit application process.

c. All access and staging of equipment and materials shall be limited to previously existing hard (paved or gravel) surfaces.

d. Unless approved by the Contracting Officer or COR and reviewed for compliance by EHP prior to work, there will be no clearing and/or grubbing of vegetation or removal or trimming of trees.

e. Debris on the sites, including buildings and/or remnants of buildings that will be demolished, and debris generated during construction will be removed to an existing, licensed landfill, currently limited to the Marpi Solid Waste Facility (MSWF) on Saipan.

The Contractor shall be responsible for all costs associated with this requirement. At the individual new house project site, temporary staging of debris will be limited to previously existing hard (paved or gravel) surfaces. Unless previously approved by the Contracting Officer or COR and reviewed for compliance by EHP as described in paragraph b above, no temporary debris staging area will be established without prior Contracting Officer approval by submitting a detailed proposed plan for the area. After coordinating an EHP review, the Contracting Officer or COR will advise the Contractor if the temporary staging plan is approved.

f. There are no licensed solid waste disposal facilities or transfer stations on Tinian. Debris on the sites, including buildings and/or remnants of buildings that will be demolished and debris generated during construction at the sites on Tinian will be disposed of at the Marpi Solid Waste Facility (MSWF) on Saipan.

g. Unless prior approval is received by the Contracting Officer or COR and reviewed for compliance by EHP, existing in-ground elements such as driveways and walkways will be left in place.

h. Unless prior approval is received by the Contracting Officer or COR and reviewed for compliance by EHP, there will be no grading of sites beyond the footprint of the footers and slabs for the replacement dwellings.

i. Any fill (soil or gravel) will be obtained from a previously disturbed commercial borrow source. The Contractor shall be responsible for the cost of all fill necessary to level the ground for the structure and bring it to the proper height to allow for the proper sewer system requirement and water runoff. All sites shall have a minimum of 6 inches of classified imported fill compacted to 95% of maximum dry density based on the modified proctor placed beneath the entire structure.

j. Unless prior approval is received by the Contracting Officer or COR and reviewed for compliance by EHP, all utility repairs/replacements will be limited to the existing alignments and within areas of ground previously disturbed by their original installation and will tie into preexisting utility lines.

k. Unless prior approval is received by the Contracting Officer or COR and reviewed for compliance by EHP, there will be no site improvements such as new drives, walks, drains and drainage systems, etc.

l. Some new house project sites may be in biologically sensitive areas, such as those areas known to be previously inhabited by the critically endangered songbird, the Saipan Reed Warbler. These project sites will be identified by the USG or CNMI officials. For the biologically sensitive project sites, all construction work performed during the months of 1 January through 31 March and 1 July through 30 September shall require on-site biological monitoring. For the months of 1 April through 30 June and 1 October through 31 December, this time period does not require on-site monitoring during construction.

However, regardless of the time of year, one day prior to any construction work, to include any demolition work; a biologist will survey each project site to ensure that no Federally listed threatened or endangered species or their nests are present within a 50-meter (164’) buffer around the project area. For biologically sensitive project sites, the use of equipment greater than 60 decibels and heavy equipment will be limited. All access and staging of equipment and materials will be limited to previously existing hard (paved or gravel) surfaces. There will be no clearing and/or grubbing of vegetation or removal or trimming of trees, unless pre-approved by the Contracting Officer. The USG will provide all biologists for this requirement. If the USG determines some or all construction work must stop, the USG will issue a Suspension of Work order. The Contractor may submit a Request for Equitable Adjustment (REA) for additional time and money due to any delays from the previously approved project specific schedule.
