About this file
This is a Claim of Business Confidentiality Form for the Utah Department of Transportation's solicitation regarding telecommunications expertise for the Utah Broadband Center's administration of the federal Broadband Equity, Access, and Deployment (BEAD) Program. The form allows respondents to designate certain submitted information as confidential under Utah Code Annotated Sections 63G-2-305 and 63G-2-309. Respondents may claim business confidentiality protections for non-public financial statements, specific employee contact information, customer or client lists, and other trade secrets or commercial information that could reasonably result in unfair competitive injury if disclosed. However, pricing and cost proposals are explicitly excluded from confidentiality protections and must be considered public information, and entire proposals cannot be blanket-designated as protected or confidential.
Respondents asserting a claim of business confidentiality must complete the form by specifying the page, paragraph, and reason for each confidential designation, with space provided for additional documentation as needed. The form requires the submitting company's signature and date and advises that the governmental entity will notify claimants if any protected records are classified as public or determined to require release after weighing interests under applicable Utah statutory provisions. This form represents the standard mechanism by which the State of Utah processes and evaluates confidentiality claims in competitive procurements.
