About this file

This document is a Procurement Offering standard terms, conditions, and disclaimers document from the Buffalo Public Schools (BPS)/Buffalo City Schools/Buffalo Board of Education for potential vendors and bidders. The document outlines comprehensive procurement guidelines, submission requirements, and expectations for vendors seeking to provide goods or services to the school district. It covers multiple procurement processes including Request for Bid (RFB), Request for Proposal (RFP), and Request for Pre-Qualification (RFPQ), with detailed instructions on response submission methods, both electronic and physical. The document provides extensive guidance on response preparation, including requirements for response surety, insurance certifications, prevailing wage rates, delivery expectations, and invoice submission protocols.

The procurement offering establishes clear financial and legal parameters for potential contractors, including mandatory insurance requirements with specific policy limits (e.g., $500,000 per person bodily injury, $1,000,000 per accident, $300,000 property damage), workers' compensation certification, and public liability coverage. The district reserves significant rights in the procurement process, including the ability to reject any or all proposals, seek clarifications, negotiate pricing, and cancel or amend the offering at any time. Vendors must comply with New York State Labor Laws, particularly regarding prevailing wage rates for public work contracts, and are subject to strict communication restrictions during the bidding process to ensure fair competition. The document also emphasizes vendor conduct expectations, including professional behavior on school premises and adherence to specific delivery and interaction guidelines.
