About this file

This is a Bid Bond form required by the City of Temple, Texas, a home rule municipal corporation located in Bell County, for the Poison Oak Road Realignment Phase II project. The bid bond must be completed and either uploaded to Bonfire or submitted as a hard copy by prospective contractors. The principal contractor and surety are jointly and severally bound to the City of Temple in an amount to be specified on the form as security for faithful performance of the bidding obligations.

The bid bond serves as a guarantee that the successful bidder will enter into the written contract and furnish satisfactory Performance and Payment Bonds upon award. If the principal withdraws its bid after opening and before official rejection, or if awarded but fails to execute the contract and provide required bonds, the City of Temple is entitled to collect the full amount of the bid bond as liquidated damages. The bond must include a Power of Attorney attached as a note, and any legal action arising from the bond shall be filed in Bell County, Texas. The referenced project involves approximately 4,200 linear feet of new four-lane roadway with associated bridge, drainage, water, pedestrian facilities, and lighting improvements, with an engineer's estimate of probable cost of $8,900,000 and a completion requirement of 550 consecutive calendar days from Notice to Proceed.
