This document is the Instructions to Bidders for the City of Midland, Texas, regarding municipal public works projects associated with the Midland International Air and Space Port Beautification Project (Project #900476-505). The work is located in Midland, Texas, and is based on plan sets dated March 16, 2026. Sealed bids must be submitted to the City Secretary at City Hall (300 N. Loraine Street, Midland, Texas) by the date and time specified in the Notice to Bidders. Bidders are required to examine the site, drawings, and specifications prior to submitting bids, and submission of a bid constitutes prima facie evidence of such examination. Work must commence within 15 days of receiving notice to proceed from the City and must be completed without delay. The successful bidder will be required to provide Performance and Payment Bonds equal to 100 percent of the total contract price, executed in five original counterparts by a corporate surety authorized in Texas.

Bid submissions must be made only on the provided Proposal form in ink with both script and figures; any deviations may result in rejection. A Bid Guaranty of five percent of the largest possible lump sum bid, in the form of a certified check, bank money order, or approved Bidder's Bond, must accompany all proposals, and proposals lacking this guaranty will not be considered. All proposals remain valid for 30 days after bid opening. The Owner reserves the right to reject any or all bids and awards contracts to either the lowest responsible bidder or the bidder providing the best value to the City of Midland as determined under Texas Local Government Code Section 252.043. Payment to the contractor will be based on prices stated in the proposal and actual work performed as determined by the Engineer, with final payment due between 30 and 35 days after issuance of the Certificate of Completion. Questions regarding contract documents must be submitted to Maverick Engineering at amellen@maverick-eng.com and must be received no later than three days prior to the bid date.
