About this file

This is a Special Provisions document for the Midland International Air & Space Port Beautification Project (Project #900476-505) managed by Maverick Engineering in Midland, Texas. The scope of work encompasses mobilization, erosion controls, demolition, site preparation, foundation preparation, potential gas relocation coordination with Atmos Energy, electrical trenching and coordination with Oncor, steel sign fabrications, concrete and rebar foundation work, sign installations, electrical conduits and wiring, masonry work, landscape backfill, landscape conduits, and site cleanup. All work shall be performed in accordance with the Plans and Specifications and the City of Midland Standard Specifications, unless modified by these Special Provisions. The Owner reserves the right to abandon any portion or the entire project at any time before the Contractor begins construction work. Contractors must provide the Engineer with a construction schedule at least 48 hours prior to beginning work, outlining anticipated start and completion times for each phase, and maintain updated schedules throughout construction. A supervising representative of the Contractor must be present on-site during all construction activities and be on the Contractor's direct payroll; subcontractors or paid consultants do not satisfy this requirement.

The Contractor bears full responsibility for safety compliance, including adherence to OSHA regulations and special restrictions for work near high voltage lines, which requires coordination with the power company at the Contractor's sole cost and expense. All materials provided for permanent installation must be new and compliant with technical specifications and general conditions. The Contractor is responsible for implementing erosion control measures consistent with the supplied Erosion Control or Storm Water Pollution Prevention Plan and addressing any plan discrepancies immediately. The Contractor assumes all liability for damage to utilities, obstructions, or adjacent property encountered during construction and must cover repair costs. Excess excavation materials become the Contractor's property unless the Owner claims base material, asphalt millings, or other valuable construction materials, in which case no additional compensation is provided. The Engineer makes no guarantees regarding earthwork quantities or balance due to varying field conditions and construction tolerances.

which is to be performed as outlined in the Plans and Specifications, including all labor, material, incidentals and appurtenances necessary to complete the work to the satisfaction of the Owner/Engineer.

The Owner reserves the right to abandon, without obligation to the Contractor, any part of the project, or the entire project, at any time before the Contractor begins any construction work authorized by the Owner.

City of Midland Standard Specifications will govern all construction, except as modified by these Special Provisions.

PLAN DISCREPANCY:

Prospective bidders shall make a careful examination of the entire site of the project and shall make such explorations as may be necessary to determine the subsoil and/or water conditions to be encountered; improvements and obstructions which may be encountered; methods of providing ingress-egress to private as well as public property; and a general overall site inspection as described in section 3.0 INSTRUCTIONS TO BIDDERS, subsection EXAMINATION OF SITE, DRAWINGS, PROJECT. At any time that a plan discrepancy is discovered during any portion of bidding or construction, it shall be brought to the immediate attention of the Engineer. If necessary in the Engineer’s opinion, work shall cease until such discrepancy is resolved to the Engineer’s satisfaction.

SAFETY REQUIREMENTS:

It shall be the responsibility of the Contractor to follow and comply at all times with Occupational Safety and Health Administration (OSHA) and all other applicable safety regulations and requirements throughout the course of the project’s work.

SAFETY RESTRICTIONS – WORK NEAR HIGH VOLTAGE LINES:

The following procedure will be followed regarding the subject item on this contract:

A warning sign painted yellow with black letters that are legible at twelve feet shall be placed inside and outside vehicles such as cranes, derricks, power shovels, drilling rigs, pile drivers, hoisting equipment or similar apparatus. The warning sign shall read as follows:

“WARNING – UNLAWFUL TO OPERATE THIS EQUIPMENT WITHIN SIX FEET OF HIGH VOLTAGE LINES” Equipment that may be operated within ten feet of high voltage lines shall have an insulation cage-type of guard about the boom or arm, except back hoes or dippers, and insulator links on the lift hook connections.

The Contractor is required to make arrangements with the Power Company for the temporary relocation or raising of high voltage lines at the Contractor’s sole cost and expense. No person shall work within six feet of a high voltage line without protection having been taken as outlined above.

PROPERTY AND RIGHT-OF-WAY ACCESS:

Access to adjacent property shall be maintained at all times unless otherwise directed by the Engineer. If the contractor will not be working in an area for a period of one week or more, special care should be taken to address any unsafe conditions such as excavated areas or obstructions outside the worked area that could be tripping hazards, etc.

CONSTRUCTION SCHEDULE:

It shall be the responsibility of the Contractor to furnish the Engineer, a minimum of 48 hours prior to construction, a schedule outlining the anticipated time each phase of construction will begin and be completed, including sufficient time being allowed for clean-up. The Contractor shall remain responsible for keeping the schedule up to date throughout the course of construction.

CONSTRUCTION MATERIALS:

The Contractor shall only provide new materials for permanent installation in any and all parts of this project, and all such materials shall comply with section 4.0 TECHNICAL SPECIFICATIONS & 5.0 GENERAL CONDITIONS.

EROSION CONTROL:

Erosion control will be the responsibility of the Contractor and shall be implemented so as to prevent sediment erosion from wind, rain, and other elements from the project site. Erosion control shall be consistent with the supplied Erosion Control or Storm Water Pollution Prevention Plan. Should the Owner/Engineer feel that supplementary erosion control measures are required in addition to those implemented by the Contractor then the Contractor shall include additional erosion control measures within reason to the Owner’s satisfaction and/or TCEQ requirements.

Reasonable erosion control measures include but are not necessarily limited to: construction entrance(s), concrete washout(s), perimeter silt fence or fiber wattle, rock rip-rap dams for concentrated runoff control, gutter and inlet protection measures such as sand bags, and stabilization of the construction area surfaces when construction work is not actively occurring by means of vegetative cover, hydro-mulching, or erosion control blankets.

These measures shall be ancillary to the project and not paid as a separate item, unless otherwise noted in the proposal and/or pay notes.

WASTE MATERIALS:

Excess material from excavation and other construction will become the property of the Contractor. The Owner reserves the right to claim base material, asphalt millings, or other valuable construction materials which are shown for removal. In the event that the Owner exercises this right, no extra compensation shall be made to the Contractor, nor will it constitute grounds for an additional claim to be made by the Contractor. If prices bid are contingent on the Contractor salvaging certain materials, it should be specifically identified during the bid process as noted in section 3.0 INSTRUCTIONS TO BIDDERS.

Materials claimed by the Owner shall be stockpiled on the jobsite as directed by the Owner/Engineer. Excess excavation will be disposed of at locations approved by the Owner/Engineer and in compliance with all state and federal laws. No material

E R shall be placed on private property or City property without the approval of the Owner/Engineer. Construction and final project site cleanup shall be performed as per section 5.0 GENERAL CONDITIONS.

Where a depth of removal is shown on the plans, it shall be considered an average depth. Where concrete, pavement, or other materials are shown to be removed, all of that material shall be removed unless specifically shown otherwise. If the material should have a greater depth than that shown on the plans, the Contractor shall remove the remaining material at no additional cost to the Owner/Engineer. No additional compensation shall be made for removing the remaining material, regardless of depth. This shall in no way constitute grounds for the Contractor to make a claim against the Owner/Engineer.

COMPLIANCE:

The said Contractor further agrees to comply with all applicable provisions of the laws and building and construction codes of the City of Midland and the State of Texas, and with any regulations for the protection of workers which may be promulgated by the Government, and shall protect such work with all necessary lights, barriers, safeguards, and warnings as provided for in said specifications and the Ordinance regulations.

PERSONNEL:

It shall be the Contractor’s responsibility to have a supervising representative of the Contractor on the construction site any time that construction work is taking place. The Contractor’s representative must be on the Contractor’s direct payroll. Sub-contractors or paid consultants will not satisfy this requirement.

EARTHWORK QUANTITIES:

The Engineer/Owner makes no representation or guarantee regarding earthwork quantities or that the earthwork for this project will balance. This is due to varying field conditions, changing soil types, allowable construction tolerances, and construction methods that are beyond the control of the Owner/Engineer.

UTILITIES:

A thorough attempt has been made to show the locations of all underground obstructions and utility lines in the project area.

However, the contractor shall be responsible for any damage to obstructions and utility lines encountered during construction and shall determine the exact location of utilities on the project site and within the immediate vicinity. Any damage to utilities, obstructions, or adjacent property by the Contractor shall be repaired at the sole expense of the Contractor.
