About this file
This is a Questions and Answers document for a solicitation (19MY3026Q0017) issued by the U.S. Embassy in Kuala Lumpur, Malaysia for MSG Cook Services. The document addresses three inquiries from prospective offerors regarding continuity of scope, insurance treatment, and tax application relative to a predecessor contract (19MY3024D0004) valued at approximately $23,045.21 that was awarded to a foreign vendor. The Government confirmed that the new contract scope is similar to the previous award, which called for three meals daily, 365 days per year, for up to 10 USG Marine Security Guard personnel. Regarding pricing methodology, the Government clarified that Defense Base Act (DBA) insurance and other required insurance must be included in the all-inclusive monthly price consistent with FAR clauses 52.228-4 and 52.228-5, and that Sales and Service Tax (SST) should be priced as a separate line item per the Statement of Work.
The related solicitation requires quotations submitted electronically to KualaLumpurDTO@state.gov by August 3, 2026 at 12:00 noon local time. Prospective offerors above the $40,000 USD threshold must maintain valid and active registration in SAM.gov at the time of proposal submission. A site visit was scheduled for July 15, 2026 at 10:00am at the U.S. Embassy Kuala Lumpur, with inquiries directed to the Procurement Agent at rmuthupillaip@state.gov by July 8, 2026 to arrange building access.

Solicitation No : 19MY3026Q0017 (MSG Cook Services) Questions And Answers (W1) Date : 10 July 2026
Question 1: Continuity of Scope from the Prior Award Our review of historical procurement records indicates a predecessor contract (Award No. 19MY3024D0004) for the same MSG Cook Services requirement, awarded to a vendor registered under "Miscellaneous Foreign Awardees," with a total contract value of approximately $23,045.21. Could the Contracting Officer confirm whether the incumbent provider under that prior award delivered the same scope of services now described in this RFQ (i.e., three meals daily, 365 days a year, for up to 10 USG Marine Security Guard personnel at the MSGR)? If there are any differences in scope, staffing levels, meal frequency, or service standards between the prior contract and the current requirement, we would appreciate clarification so that our quotation accurately reflects the full current scope of work.
| Answer 1: | The scope of the new contract is similar to the previous contract outlined above. |
| Question 2: | Defense Base Act (DBA) Insurance Treatment |
Section 3 (Instructions to Offerors) of the SOW states that the Offeror shall include DBA insurance premium costs in its quotation, while Section 1 (Prices) similarly indicates that insurance under FAR 52.228-4 and 52.228-5 is to be included in the all-inclusive monthly price. Could the Contracting Officer confirm whether this approach is consistent with how the incumbent/prior contract was priced and invoiced — that is, was DBA insurance built into the previous contractor's monthly rate, or was it billed to the Government as a separate line item? We want to ensure our pricing methodology aligns with the Government's expectations and prior practice
| Answer 2: | The requirements for DBA and other insurance are consistent with the FAR clauses mentioned. ‘ |
| Question 3: | Sales and Service Tax (SST) Treatment |
We note that SST is explicitly excluded from the CLIN rate and is to be priced as a separate line item per Section 1.1. We would appreciate confirmation that this treatment is consistent with how SST was applied under the prior award, to ensure consistency in our cost proposal.
Answer 3: SST should be a separate line item as reflected in Section 1.1 of the SOW.
