52.212-2 - Evaluation-Commercial Products and Commercial Services (DEVIATION JAN 2026)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors will be used to evaluate offers:

Technical and Management Approach, Past Performance, and Price

[Insert evaluation factors in the relative order of importance. For requests for proposals, state: Evaluation factors other than price when combined are [significantly more important than price/approximately equal to price/significantly less important] than price. For invitations for bids, list only price and price-related factors.]

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

SECTION M – EVALUATION FACTORS FOR AWARD CONTINUED

M.1 Basis for Award

The Government intends to award a single contract resulting from this solicitation to the responsible Offeror whose proposal represents the best value to the Government.

Offerors will be evaluated on non-cost factors (Factors 1 and 2) and price factor (Factor 3). All evaluation factors other than cost/price when combined are significantly more important than the price factor. Following a review of all eligible proposals, the Government will determine which proposal represents the best value to the Government, using the tradeoff process described below:

Tradeoff Process:

1. A tradeoff process is appropriate when it may be in the best interest of the Government to consider award to other than the lowest priced offeror or other than the highest technically rated offeror.

2. When using a tradeoff process, the following apply:

a. All evaluation factors and significant subfactors that will affect contract award and their relative importance shall be clearly stated in the RFP; and

b. The RFP shall state whether all evaluation factors other than cost or price, when combined, are significantly more important than, approximately equal to, or significantly less important than cost or price.

3. This process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced quote. The perceived benefits of the higher priced quote shall merit the additional cost, and the rationale for tradeoffs must be documented in the file.

In making the award determination, the Government will consider the following evaluation factors:

1. Technical and Management Approach

2. Past Performance

3. Price

M.2 Evaluation Factors

Document Number: 19AQMM26R0376 PROCESSED Page 6 of 7

Factor 1 – Technical and Management Approach

The Government will evaluate the Offeror’s demonstrated understanding of the Performance Work Statement (PWS) requirements and the feasibility and effectiveness of its proposed technical and managment approach. The Government will evaluate the Offeror’s management structure and ability to effectively administer and oversee the contract performance.

The Government will evaluate whether the proposed management approach is realistic, comprehensive, and capable of supporting uninterrupted mission execution.

Management Approach.

Areas of evaluation include:

• Worldwide diplomatic courier support capabilities;

• Ability to recruit, retain and manage qualified personnel;

• Continuity of operations and mission readiness;

• Quality Control Plan;

• Transition-in and transition-out approach;

• Risk identification and mitigation strategies;

• Security and classified information handling procedures.

• Program management organization;

• Staffing methodology;

• Key Personnel qualifications;

• Communication processes;

• Ability to maintain surge support capabilities;

• Management of cleared personnel and security requirements.

The Government will assess its level of confidence that the contractor will successfully perform the requirements based on their proposed key personnel and technical/ management approach. See the Confidence Ratings table listed below used to evaluate the technical factor.

Confidence Rating Table

Rating Definition High Confidence The Government has high confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful performing the full range of the requirement with little or no Government intervention.

Some Confidence The Government is confident that the Quoter understands the requirement, proposes a sound approach, and will be successful performing the full range of the requirement with some Government intervention.

Low Confidence The Government has low confidence that the Quoter understands the requirement, proposes a sound approach, or will be successful performing the full range of the requirement even with Government intervention.

Factor 2 – Past Performance

The Government will evaluate the quality of the offeror's past performance deemed relevant to the requirements in the PWS. In conducting the Past Performance evaluation, the Government reserves the right to use information provided in the Offeror’s Past Performance submission and information obtained from other sources available to the Government, to include, but not limited to, the Contractor Performance Assessment Reporting System (CPARS).

The below confidence levels will be used to evaluate the offeror’s past performance.

Document Number: 19AQMM26R0376 PROCESSED Page 7 of 7

Rating Definition Substantial Confidence Based on the offeror’s recent/relevant performance record, the

Government has a high expectation that the offeror will successfully perform the required effort. It is unlikely that Government intervention will be needed in order to obtain the required product/service.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort. Little Government intervention will be needed in order to obtain the required product/service.

Unknown Confidence (Neutral) No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can reasonably be assigned.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort. Some Government intervention will be needed in order to obtain the required product/service.

No Confidence Based on the offeror’s recent/relevant performance record doubt exists that the offeror will be able to perform the required effort.

Factor 3- Price Price is not scored; rather, the principal basis for evaluating price as a factor for award under this solicitation will be an evaluation of the reasonableness of the offeror’s respective “total evaluated price”. The Government will determine the total evaluated price by adding together the total prices of the base year and all option years calculated in Attachment A (Pricing Worksheet). The ODCs and government provided amounts shall not be changed and will be included in the total evaluated price. The not to exceed ceiling price for this time and materials task order will be established in the order schedule based on the total evaluated price.

The principle manner for evaluating price reasonableness will be price competition. The Government will evaluate price to ensure that the awarded price is fair and reasonable.

Note: Award of a contract for any LCAT not listed in the WD does not relieve the awardee of its obligation to request a wage conformance in accordance with FAR 52.222-41(c)(2) (Service Contract Labor Standards) and 29 CFR 4.6(b). The successful offeror will be required to submit a Standard Form (SF) 1444, Request for Authorization of Additional Classification and Rate, to the Contracting Officer within thirty (30) days of employees commencing work in an unlisted classification, or as otherwise directed at the post-award conference. The Contracting Officer will forward the conformance request to the Department of Labor Wage and Hour Division for review and approval.

M.3 Evaluation of Small Business Eligibility

The Government will verify the apparent successful Offeror’s eligibility as a Woman-Owned Small Business (WOSB) through the Small Business Administration’s certification records. Failure to maintain WOSB eligibility through the time of award may result in elimination from consideration.
