C-001 - Performance Work Statement

Performance Work Statement

Public Member Service on Foreign Service Selection, Reconvened, and Reconstituted Boards, GTM/PE

February 24, 2023

1. BACKGROUND:

This is a non-personal services requirement for recruitment and administration services in support of the Department of State, Office of Performance Evaluation. The United States Government shall not exercise any supervision or control over contractor personnel, who are the service providers performing the services described herein. Service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

The Department of State maintains a rigorous system to identify and promote employees, as required under the Foreign Service Act of 1980. One key requirement is to include Public Members on the Foreign Service Selection Boards to review the performance records of Foreign Service personnel; recommend employees for promotion; and recommend other personnel actions when warranted alongside the department's board members.

Public members bring diverse experience and perspectives to Board deliberations that enhance the integrity of the performance review process for employees who represent the United States.

2. DESCRIPTION OF SERVICES/INTRODUCTION:

The Contractor will be responsible for wide-spread recruitment of qualified candidates, providing multiple qualified candidates for the government's ultimate selection, replacement of members when necessary, and payment to public members for their service. The Department of State Office of Performance Evaluation estimates a need for approximately 30 Public Members per year. Depending on their caseload, the Boards can meet from four to nine weeks for a minimum of 40 hours per week during the Boards’ session period. Public members will be expected to be available and online during core business hours of 9:00 AM to 5:00 PM or longer, if necessary. There may be other boards throughout the year for which GTM/PE would recall public members for additional board activities. Such boards could include, but are not limited to, the Department Senior Review Board, the Interagency Review Board, selection boards that are reconstituted to review a limited number of personnel files as a result of Department administrative error.

3. CONTRACTOR PERSONNEL DISCIPLINES AND SPECIALTIES:

The contractor shall accomplish the assigned work by employing and utilizing qualified personnel with appropriate combinations of education, training, and experience. The contractor shall match personnel skills to the tasks outlined herein. The contractor shall ensure the labor categories, labor rates, and man-hours utilized in the performance of this requirement will be adequate to satisfactorily accomplish the tasks outlined in the PWS.

The Contractor shall provide the necessary resources and infrastructure to manage, perform, and administer this requirement.

4. SCOPE OF WORK/REQUIRED TASKS:

Task 1: Program Management

The Contractor shall be a liaison between the Bureau of Global Talent Management, Office of Performance Evaluation (GTM/PE) and the Public Members providing the support as outlined in the tasks outlined in the work statement. The program management team will be responsible for the following:

• Adhering to the details provided in Task 2, the contractor shall source individuals to fill the role of Public Member for Performance boards using diverse methods of recruiting to yield 30 or more viable candidates (annual minimum of 25 active board members with a bench of 5 to 10 candidates to cover any unexpected changes in the ability of the first 25 to perform on the contract)

• provide the program office resumes to review NLT 31 March

• invoicing the government for the work performed

• payment to public members for work completed

• replacement of candidates if necessary

Task 2: Sourcing Candidates

The contractor will utilize recruiting tools available for industry to source viable candidates to serve in the role of public member for the Foreign Service Promotion Boards. The contractor may use the documents provided by GTM/PE referenced below as guidelines in finding candidates that meet the criteria.

• Appendix C 3 FAM 2320 provides the requirements for public members, the vendor must provide candidates that meet or exceed the stated requirements.

A contractor employee's participation in an AWS, flextime, or telework is voluntary and subject to COR approval.

The COR may cancel or adjust the telework arrangement by providing written notice to the contractor.

When Holidays fall within the same pay period the holiday will affect the schedule. Full-time employees on flexible work schedules are entitled to 8 hours of pay when they do not work on a holiday. For a full-time employee on a variable day or variable week schedule, the employee must make arrangements to work extra hours during other regularly scheduled workdays, or use annual leave, credit hours, or compensatory time off in order to fulfill the 80-hour biweekly work requirement.

This decision is not subject to dispute nor does it give rise to a claim under the contract.

The initial eligibility criteria are the same as that for Federal Employees and are listed at 3 FAM 2362.2. At any time with prior notification a contractor employee’s AWS can be terminated or modified for operational considerations related to workload demands.

All contractor personnel engaging in telework must complete the U.S. Department of State Contractor Telework Agreement, DS-5150 and GO Access for Contractors form.
