ANSWERS TO QUESTIONS ASKED BY INTERESTED PARTIES

Question #1: Is it possible to limit the number of voice minutes and SMS minutes in the Smart
Phone Plans in section 1.3 of the solicitation?
Answer #1: No, Section 1 - The Schedule, 3 Pricing of the solicitation states unlimited voice minutes and unlimited SMS for all relevant line items and shall remain as stated in the solicitation and will not be revised.
Question #2: Is it possible to allow an international roaming limit or a price change for adding countries who sign a roaming agreement with the contractor after the contract award?
Answer #3: No. Section 1 – The Schedule, subsection 6.1.6 International Roaming of the solicitation states, “Any country that signs a roaming agreement with Israel within the Contract period of performances will be added automatically to the Contract packages at no extra cost (no change on the agreed prices of the contract packages).”.
Question #3: May the requirement for international roaming be excluded for the West Bank, Gaza, and Egypt?
Answer #3: No, Section 1 – The Schedule, subsection 6.1.6 International Roaming of the solicitation states, “The Contractor shall provide as extensive international roaming connectivity as possible, with the special interest of the Government for roaming within the West Bank, Gaza, Jordan, Egypt, Europe and the USA.” In addition, all the line items in section 1 of the solicitation state as a definition for throughout the world, “**Throughout the world: including The West
Bank, Gaza, Jordan and Egypt.”
Question #4: Is there a requirement of having two mobile numbers on one line (ESIM and regular SIM), and if yes are both lines required to supply all of the same services?
Answer #4: There is no requirement to operate two separate lines on one line in this solicitation.
Section 1 – The Schedule, subsection 6.1.10(b) Equipment states that, “The Contractor shall be able to offer the e-sim service. The Contractor shall provide a web-based portal to allow
Embassy telecom team to activate the e-sims as needed.” The E-Sim service if activated will be activated in place of the regular SIM Card and will adhere to all the service requirements in the solicitation.
Question #5: What is the contractor’s responsibility of ensuring 24-hour service as stated in section 6.1 of the solicitation if there are service issues with the operators in the West Bank and
Gaza?
Answer #5: While section 6.1 of the contract states that the contractor should ensure the services on a 24-hour basis, it is understood that in the West Bank and Gaza this will be dependent on the service of those telecom companies in those areas. Please refer to FAR Clause 52.212-4(f) –
Contract Terms and Conditions—Commercial Products and Commercial Services (Excusable
Delays).
Question #6: Do all new countries that are included in the contractor’s international roaming agreements need to be added to the phone plans?
Answer #6: Yes, Section 1 – The Schedule, Subsection 6.1.6 International Roaming of the solicitation states, “Any country that signs a roaming agreement with Israel within the Contract period of performances will be added automatically to the Contract packages at no extra cost (no change on the agreed prices of the contract packages).”.
Question #7: Is the Contractor required to distribute the voicemail and voice message distribution service?
Answer #7: Yes, Section 1 – The Schedule, subsection 6.1.8 Voice Mail of the solicitation states, “Distribution of Messages
The Contractor shall have the ability to distribute voice messages:
1. To a predetermined distribution list.
2. To ad-hoc distribution list.
3. To individuals from the phone directory.
Upon request, the Contractor shall allow the voicemail service to continue for an additional 60 days, if the user number has been changed; the message will allow the calling parties to be informed on the new number.
At the end of the contract period, if the contract is not renewed, the Contractor shall allow the voicemail service to continue for an additional 60 days. The message will allow the calling parties to be informed on the new number.”
Question #8: What is the security code requirement mentioned in section 1 – The Schedule, subsections 1.10.1 Government Furnished Properties and subsection 11.1 Addition of New Lines of the solicitation?
Answer #8: The security codes mentioned in section 1 – The Schedule, subsections 1.10.1
Government Furnished Properties and subsection 11.1 Addition of New Lines of the solicitation are the codes that are needed to unlock the SIM cards.
Question #9: Is it possible to delete solicitation term 13 from the solicitation?
Answer #9: No, it is not possible to delete the solicitation term 13 – Technological
Refreshments, from the solicitation. Please note that solicitation term 13 also states, “Contractor has the right to withdraw, in whole or in part, any technological refreshment proposal prior to acceptance by the Government. Contractors will use commercially reasonable efforts to ensure that prices for substitutions or additions are comparable to replaced or discontinued products. If a technological refreshment proposal is accepted and made as part of this contract, an equitable adjustment, increasing or decreasing the contract price, may be required and any other affected provisions of this contract shall be made in accordance with FAR clause 52.212-4, paragraph (c), Changes, and other applicable clauses of the contract.”
Question #10: Does the non-American contractors have to complete the certification 52.212-3 as part of the certifications when submitting the proposal?
Answer #10: Yes
Question #11: Is the requirement for 5G Coverage subject to Israel regulations and dependent on supported cell phone devices?
Answer #11: Yes, the 4th paragraph of section1.1 of the solicitation states, “The 5G Coverage should be always provided to all the US Embassy devices/ lines (within the 5G capable
Network).”
Question #12: Does the offeror need to comply with section 2 contract clauses in the solicitation, or is compliance to all Israeli regulatory law sufficient?
Answer #12: The Solicitation is governed by US federal law and all contract clauses must be complied with. The Solicitation specifies the extent to which local law applies to a specific requirement.
Question #13: What are the payment conditions for this solicitation and are there any compensation paid for delayed payments?
Answer #13: Refer to FAR Clause 52.212-4(g)(2), and section 7 Invoicing in the solicitation
Question #14: What type of evidence is required to show that the offeror can provide the necessary personnel, equipment and financial resources needed to perform the work?
Answer #14: Refer to Section 3 Solicitation Provisions.
Question #15: Can the Government clarify that all services under this requirement are subject to local Israeli regulations and laws?
Answer #15: See the Government’s response to Question 12.
Question #16: Will the contractor be liable for any 3rd party claim or indemnification claim under any contract awarded off of this solicitation?
