OIJ Incinerator- INL/Costa Rica Questions & Responses
No.Reference:Question:Post/ Programs Response:Procurement Response:
1Costa Rican Emissions RegulationsCosta Rica law requires that ALL co-incinerators (any system that involves the thermal destruction of waste), must have an Air Pollution Control System (APC) and a Continuous Emission Monitoring System (CEMS), regardless of the incinerators capability. Can you please confirm that this is the case?Confirmed. Mrovira Program Specialist
2ProcurementIs this project restricted only to USA/American manufacturers/bidders?This requirement is 100% set aside for U.S. Small Business Concerns.

Along with this, the non-manufacturer rule applies (FAR 19.001 - “Nonmanufacturer rule” means that a contractor under a small business set-aside or 8(a) contract shall be a small business under the applicable size standard and shall provide either its own product or that of another domestic small business manufacturing or processing concern (see 13 CFR121.406).

3 Appendix A – General equipment specifications – page 5 “Waste: second Marijuana and newly developed drugs/chemical precursors. Drugs inside plastic bags” Can you provide any additional waste characteristics such as typical % Marijuana, % Cocaine etc. of each component in a batch of waste for processing?

Can you provide any waste densities for each component?

What are the physical characteristics of second Marijuana? Loose leaves? Packed bails? Other? The percentages of waste to be destroyed are 60% of Cocaine, 15 percent of Marijuana and 25% of other types of drugs, including cocaine dissolved in diesel or gasoline. The loose leaves are those of the marijuana plants. Second Marijuana refers to that grown in indoor facilities. Packed bails are the packages used to traffick cocaine and the plastic bags where they are placed to keep in a warehouse until the destroying process in the incinerator. Tags placed in the packages to identify unique information from the sezed drug. Mrovira Program Specialist
4Appendix A – General description – page 4 - Emission regulationsCan you clarify what air emission regulations are to be applied to this project? Page 4 indicates EPA standards (…particulate emissions should not exceed 0.10 grains/ft3 (228 mg/m3). This would suggest USEPA CISWI emission limit for Small Remote Incinerators, is this the correct regulation?
The referenced Costa Rican regulation is for large co-incineration applications and requires significantly different air emission limits. We do not have the densities of the waste for each component.
5Pricing Matrix – Base Period - CLIN004 Warranty & Manufacturer Recommended MaintenanceCan you please confirm - is the requirement for the vendor to provide preventative maintenance at site (vendor service labor and materials) during the first year of operation during the Warranty period?
Would this service always be in Costa Rica? Or could it be elsewhere?Confirmed. Mrovira Program Specialist
6Pricing Matrix – Optional Period - CLIN1004 Option Year One (OY1) Warranty & Manufacturer Recommended MaintenanceCan you please confirm – is the requirement for a 1 Year Extended Warranty and an additional 1 year of the vendor provided preventative maintenance at site (vendor service labor and materials)?
Section 2 Statement of work – Period of Performance page 5, states “Period of Performance … four (4) option years for maintenance and operation. Is this a requirement or the expected project duration?Regarding Statement of Work - Period of Performance page 5 -This "four (4) option years" language was an error and has been corrected in the amendment of the solicitation.
7Section 3 Evaluation Criteria – page6 – The quoter shall be registered to do business in the host country or to partner with a host country registered business…Can you please confirm if this refers to Costa Rica specifically and not Guatemala? This was an error, now corrected on solicitation.

Yes, this refers specifically to Costa Rica

8Section 3, pg. 5, subsection “Instructions to Quoters”If premade product/company literature is included with the proposal, will it count towards the proposal 25 page limit?Per the Contracting Officer, failure to follow the instructions specified in the solicitation may put the offeror at risk of not being considered
9Section 3, pg. 5, subsection “Instructions to Quoters”If the premade literature isn’t 12 font-Times New roman will it disqualify the bid?Per the Contracting Officer, failure to follow the instructions specified in the solicitation may put the offeror at risk of not being considered
10Page 5, under Basis of AwardIt says the award will go to “the contractor whose quote provides the best value to the Government, price, and other factors considered.” That is a direct discrepancy with the very next section on page 5 under Evaluation Factors, which states the award will go to the “Lowest Price Technically Acceptable (LPTA)”.

a. Please clarify the award basis.

b. If it is best value, please clarify what the “other factors” are and what is the value of these factors vs the price.Language corrected. This requirement will be awarded to the lowest priced technically acceptable (LPTA) proposal.
11Under CLIN 001 General description in Appendix A on page 6,It states the specific EPA particulate matter emission of 0.1 gr/dscf standard to conform to.

a. Is this the only EPA standard that will be measured for conformance?

b. Also, at the end of the first paragraph it says “Download document here” but there is no link to download documents. Please provide the download link to the document.

c. The incineration of narcotics can fall under different waste classifications and is vague because of the different emission elements involved, resulting in different EPA standards. This leaves it too general and open for bidders to choose their own standard to follow.

Please include the exact US EPA emission gases standard that must be complied with to ensure all bidders are proposing equipment on the same basis, especially if APC equipment is required for this waste type.http://www.pgrweb.go.cr/scij/Busqueda/Normativa/Normas/nrm_texto_completo.aspx?param1=NRTC&nValor1=1&nValor2=80049&nValor3=101481&strTipM=TC
12CLIN001 on page 6; page 7 under System SpecificationsCLIN001 on page 6 indicates a maximum core temperature of 900 to 1,100 degrees Celsius for the primary chamber. Then on page 7 under System specifications it indicates the primary chamber should be around 900 degrees Celsius.

a. Is 900 degrees Celsius for the primary chamber “technically acceptable”?

b. Because it says “around” 900 degrees on page 7, will less than 900 degrees Celsius for the primary chamber be considered “technically unacceptable”?Under 900 degrees will not be acceptable
13CLIN001 on page 6; page 7 under System SpecificationsCLIN001 on page 6 indicates a maximum core temperature of 1,100 to 1,200 degrees Celsius for the secondary chamber, but then on page 7 under System specifications it indicates 1,000 to 1,200 degrees Celsius for the secondary chamber.
a. Is 1,000 degrees Celsius for the secondary chamber, which is industry standard, “technically acceptable”?1,100 to 1,200 degrees is the technically acceptable
14CLIN001 on page 6; page 7 under System SpecificationsCLIN001 on page 6 indicates a feed rate of 350 kg/hr, however on page 7 under general equipment specification it indicates “Volume of Incineration: 300 to 350 kg/hr”. A specified minimum capacity (not the range) should be given to ensure all bidders are proposing equipment on the same basis.
a. Will 300 kg/hr be considered “technically acceptable”?Feed rate 350KG/hr Volume of incineration 300 to 350Kg/hr is correct
15On page 7 under System specificationsit indicates “The results of the analysis of the effluent gases at the final testing points should be displayed on the touch screen, and data stores in the PLC.” As written, this would require a Continuous Emissions Monitoring System (CEMS) and Data Acquisition System (DAS). Again, this is very important to clarify so that all bidders are proposing equipment on the same basis.

a. Was it the US governments intent to have all this equipment included?

b. If no, please clarify what the government is asking for.

c. If yes, please confirm and add to the specification to include the equipment of a CEMS and DAS system in the CLIN001 price.

i. Please clarify exactly what chemicals you want tested in the effluent gasses. CEMS systems vary greatly based on what is being tested.ii. Also, if the particulate level of 0.10 gr/dscf is to be monitored on a continuous basis, this would require the additional equipment of an Opacity Monitor. And if so, please confirm and add to the specification to include the equipment of an opacity monitor.

Yes, it's necessary to have the analysis of the effluent gases at the final testing points should be displayed on the touch screen, and data stores in the PLC.” As written, this would require a Continuous Emissions Monitoring System (CEMS) and Data Acquisition System (DAS).

16 On page 7 under System specifications it indicates the PLC and Control System should be in a NEMA 12 enclosure. A NEMA 12 enclosure indicates the system will be indoors.

a. Will the system be operating inside a building?

b. If yes, will this building be built after the system is installed on the foundation or before? This affects installation costs.

c. If no, then the PLC and all control systems must be in NEMA 4 enclosures. Please confirm this change to NEMA 4 if the system is indeed being operated outdoors.a. Yes, the equipment will be inside an closed hangar (industial type). B. Before. C. The system will be operated indoors.
17ProcurementPlease confirm which Small Business Set-Aside regulation is to be followed, FAR 19.5, as per SOL Notice Page, or FAR 6.203 per Section 2, pg.5, subsection “Set-Aside”.Both, FAR 6.203 and FAR 19.5 are relevant for this acquisition. FAR 6.203, is referenced since this requirement is Full and Open AFTER the exclusion of sources (this is open only to Small Business Concerns. FAR 19.5 provides the policies and procedures necessary for small business concerns.
18Per CLIN004 on page 8it indicates the “Manual for the equipment shall be in both English/Spanish languages.” Much of the manual includes catalogue cutsheets from other vendors and may not be completely translatable into Spanish. Will it be accepted if these cutsheets and some portions of the manual aren’t able to be translated into Spanish? All material necessary to operate the system/equipment must be in both English and Spanish.

OIJ Incinerator- INL/Costa Rica Questions & Responses
No.Reference:Question:Post/ Programs Response:Procurement Response:
1Technical SpecificationsPlease indicate the average waste calorific value in BTU/lb. or kcal/kg. This is essential to determine the volume of the primary chamber and secondary chamber for 2 second retention time. The calorific value is also very important since the specification requires “The chamber heat release should not exceed 15 k BTU/cubic foot/hr”. In the absence of a fixed calorific value in the specification, every manufacturer could choose a different calorific value and have different gas flows in order to offer smaller chamber and stack sizes resulting in lower prices. A specified average calorific value should be given to ensure all bidders are proposing equipment on the same basis to comply with the same standard.
a. What is the average waste calorific value in BTU/lb. or kcal/kg?The average calorific value should be the one for cocaine, since this will be the product that will be most seized, and hence, incinerated. La doctora María de la Cruz Arroyo nos podría dar un dato más exacto de este valor.
2On page 7 under General equipment specificationsIt says “-Waste: Cocaine, second marijuana, and newly developed chemical drugs / chemical precursors. The drugs are inside plastic bags.”

a. What is second marijuana and its composition?

b. Is this dry illegally processed marijuana, marijuana plants or both?

c. What is the composition of the chemicals in “newly developed chemical drugs/chemical precursors”? This can affect the emissions standards. a. Second marihuana is a transcript error. It should read "2nd, marihuana". It refers to normal marihuana.

b. Both

c. This is a difficult situation to be answered. Generaly, one would expect "newly developed drugs" to have different ingredients than the ones available these days. However, for the purpose of this incinerator, it could be assumed they will contain similar solvents and raw materials, as existing chemical drugs.

3 On page 6 under General description It states “possibly liquid and solid chemical precursors”.

a. How many liters of liquid per hour or per day is anticipated?

b. What is the chemical composition of the liquids?

c. What size and kind (i.e. glass or plastic) of container will the liquid be delivered in? a. Not more than 200 kg/hr

b. Mainly solvents. Acetone, Ethyl Phenyl Acetate, Methyl Amine, diluted Hydrocloric acid, some sulphuric acid

c. Normally in either 55 gal drums, both plastic and or metal, or 15 gal plastic or metal containers 4 CLIN004 on page 8 It indicates “Equipment 1-2 year warranty”.

a. Please confirm the base warranty is only for 1 year.

b. Please confirm the option year warranty is only for 1 additional year.CONFIRMED
5In Section 3, under “Evaluation Criteria”, on page 5There is a portion of items that “may be taken into account”. Number 3 in that portion states “The quoter shall be registered to do business in the host country or to partner with a host country registered business, this is required in order to provide maintenance, training, repairs and spare parts since this type of equipment involve a security and safety.”
There will be local registered companies we work with to perform the different functions and services listed above, including installation. Please confirm this is what you mean by “partner with host country registered business”.CONFIRMED
6Article 28 of the Costa Rica RegulationStates “Continuous monitoring of the temperature of the primary and secondary chamber of the incinerator and of the chimney (s) emissions of carbon monoxide (CO), carbon dioxide (CO2), oxygen (O2), total suspended particles ( PTS), total organic carbon (COT), hydrogen chloride (HCl), hydrogen fluoride (HF), sulfur dioxide (SO2) and nitrogen oxides expressed as NO2.”
a.Please confirm these are the list of gases to be monitored by the CEMS system.

b. Also, in order to continually monitor “total suspended particles” an Opacity Monitor is required to monitor the particulate in addition to a CEMS system. Please confirm that an Opacity Monitor is required. Executive Decree No. 3916-S-MINAE, Regulations on Operating Conditions and Emission Control of Installations for Coincineration of Ordinary Solid Waste, Article 10h. . By the way, it is not NO2, like it is stated in question 6, but Nox

a. Confirmed

b. Confirmed
