1.6. INVESTIGATION OF SITE CONDITIONS

1.6.A. The Bidder, as well as their subcontractors, is urged to visit the worksite and project area to become fully aware as to the existing conditions affecting the work to be performed under the Contract Documents. A site visit will be announced during the solicitation. Each Bidder shall attend at their own expense. The

Government will not pay for any site visits. This visit is intended to provide the potential Bidders the opportunity to observe site conditions and incorporate into their proposal any required work based on site conditions. The Bidder will have the opportunity to walk around during the site visit. Unless otherwise noted, no other opportunity will exist for visits to the site.

1.6.B. The Bidder shall be responsible for ensuring that all of its suppliers, manufactures and subcontractors have reviewed all applicable Contract Documents relative to their work. USIBWC RFP 191BWC24R0002 00.21.13.01-Page 3

1.8. STATEMENT OF WORK

1.8.A. The Government does not implicitly warrant performance specifications (SOW requirements) for complete accuracy or adequacy. Typical performance type requirements set forth an objective or standard to be achieved, and the successful Bidder is expected to exercise their ingenuity in achieving that objective or standard of performance, selecting the means and assuming a corresponding responsibility for that selection.

1.8.B. When a particular product or manufacturer is identified by name, but permits substitution of ‘an approved equal,’ such a requirement is ‘performance’ in nature and, as a result, carries no implied warranty.

1.8.A. The Scope of Work is written in imperative and abbreviated form. This imperative language is directed at the Design-Builder, unless specifically noted otherwise. Incomplete sentences shall be completed by inserting "shall", "the Design-Builder shall", and "shall be" or similar mandatory phrases by inference.

The words "shall be" are to be placed by inference where a colon (:) is used within sentences or phrases.

Except as worded to the contrary, the Design-Builder shall fulfill (perform) all indicated requirements whether stated imperatively or otherwise.

1.8.B. All equipment and facilities shall be furnished, installed, and constructed by the Design-Builder to provide the Government with complete, ready to use components, systems, and facilities. All necessary materials and work required to accomplish this are the responsibility of the Design-Builder alone, whether or not specifically stated in the Scope of Work.

1.9. BID SUBMISSION

1.9.A. Submission of a bid shall be conclusive evidence that the Bidder has reviewed, investigated, and acknowledged all items detailed in FAR 52.236-3 and listed below.

1. Conditions bearing upon transportation, disposal, handling, and storage of materials.

2. The availability of labor, water, electric power, and roads.

3. Uncertainties of weather and similar physical conditions at the site.

4. The conformation and conditions of the ground.

5. The character of equipment and facilities needed preliminary to and during work performance.

1.9.B. Submission of a bid shall be conclusive evidence that the Bidder has reviewed all Contract Documents.

1.9.C. Submission of a bid shall be conclusive evidence that the Bidder has investigated and is satisfied as to the conditions to be encountered, the character, quality, and scope of work to be performed, and the quantities of materials to be furnished.

1.9.D. Submission of a bid constitutes agreement that Bidder has provided written notice of all discrepancies, omissions, conflicts, defects, errors, ambiguities, or items that are open to interpretation discovered in the

Contract Documents, that responses to these written notices are acceptable to Bidder, and that Contract

Documents are sufficient to indicate and convey understanding of all terms and conditions for performing and furnishing required work.

1.9.E. Bidder has the sole responsibility to make such independent instigation and examination as they deem necessary in order to satisfy themselves as to the conditions to be encountered in the performance of work and the quantities required to complete the work in a accordance with the Contract Documents. The

Government will not award a modification or additional funds for conditions that were observable but not considered by Bidder.

1.2. MEASUREMENT AND PAYMENT

The work performed by the Design-Builder under this Section shall not be paid for directly but shall be included in the various Bid Items under this Contract.

1.3. BACKGROUND

1.3.A. Amistad Dam is the largest of the international multipurpose storage dams to be constructed on the Rio

Grande by the United States and Mexico, in accordance with the 1944 Water Treaty between the two countries. The dam is operated and maintained jointly by the United States and Mexican Sections of the

IBWC. Amistad Dam provides important flood control, water conservation, recreation, and electrical power production benefits. The Amistad Reservoir and Dam Project is located in Val Verde County, Texas and the State of Coahuila, Mexico, with the dam approximately 12.8 miles northwest of Del Rio, TX. Construction started on December 1964 and was completed in June 1969.

1.3.B. Penstock #5 was originally designed to be a "dual gated" 15 foot irrigation outlet (penstock). Both gates were designed as tractor (cable operated) gates and weigh 48,000 pounds each. The dual gates are generally referred to as the penstock gate (aka head gate or upstream penstock gate) and the irrigation gate (aka operating or downstream penstock gate) and are positioned approximately 10 feet apart. The gates can be hung in the Penstock Service Bay which is 190 feet above their operating positions.

1.3.C. During construction, the irrigation (downstream) gate was replaced with a hydraulic slide gate. The penstock gate (upstream/head gate) was left as originally designed and is currently in the up (or open) position. Upstream of both Penstock #5 gates is a bulkhead gate slot.

1.3.D. The irrigation gate was in the closed position between approximately 2010 and 2018. In 2010 the following observations were made during the last, unsuccessful attempt to operate the gate:

1. Hydraulic Operating System

a. The hydraulic gate pump was completely operational and quickly built adequate pressure to the control valve

b. When the control valve was moved to the open gate position, the hydraulic fluid was heard feeding the hydraulic feed lines; however pressure was quickly lost.

c. Visual observation down the gate slot (maybe 40-50 feet down the slot) indicated a spray of hydraulic fluid being lost from the feed lines.

Existing Condition Information October 31, 2023

00.31.19.01-Page 2 USIBWC RFP 191BWC24R0002

d. There was no indication of gate movement; probably due to the loss of hydraulic pressure.

2. Hydraulic Gate

a. The last time the gate was physically inspected is believed to be in the 1980's.

b. Access to the back side of the gate (downstream side) is 190 foot down the 4 foot by 24 foot penstock gate slot and through an approximate 2.5 foot opening behind the gate.

c. The current physical condition of the gate (wear, corrosion, etc.) is unknown.

d. Similarly the physical condition of the concrete portion of the penstock where the gate frame is embedded in the concrete, as well as that of the concrete/penstock liner interface is unknown.

e. The hydraulic gate was known to have a "chatter" problem at certain gate openings: and during normal operations in 1998 it was reported that the gate would "bleed off" and would not hold a gate opening.

f. The hydraulic gate is framed (and seals) to the upstream side of the penstock concrete.

1.3.E. In 2018 a contract was issued to repair the hydraulic lines. Work included removing and disposing of existing pipe connected to the cylinder on Penstock #5 and installing new ¾ inch 316 stainless steel, socket welded pipe and clamps. Following the replacement of the piping, the irrigation gate was lifted successfully, but the system would not generate sufficient pressure to lower the gate.

1.3.F. In 2019 a new hydraulic motor was installed.

1.4. GENERAL

1.4.A. The final design shall take all existing conditions into account as well as information discovered during investigations under this Contract.

1.4.B. Reports on the Existing Condition Information

1. An inspection of Penstock 5 was performed by the US Army Corps of Engineers. The findings were and available in a report, entitled "Trip Report: Inspections and Technical Oversight on Penstock 5

Hydraulic System Repairs," dated June 10, 2019.

2. A study to repair Penstock #4 was performed by the US Army Corps of Engineers. Since Penstock

#4 and Penstock #5 are the same, their report entitled "Amistad Dam Project, Del Rio Texas, Irrigation Penstock Gate Study," dated October 2006 has been included for reference.

3. Since Penstock #4 and Penstock #5 are the same, instructions for opening the gates for Penstock #4 are provided for reference. The memorandum is entitled "Opening of Gate in Penstock No. 4," dated

May 6, 1986.

1.4.C. The original construction specifications: Volume I and Volume II of the "Specifications for Construction

Allocated to United States, Embankment, Non-Overflow, Power Intake, and Spillway" for solicitation

UDA 65-3 dated August 1964.

1.4.D. Applicable original construction drawings are listed in Table 1.

1.4.E. The original "Amistad Dam, Rio Grande, Operation & Maintenance Manual," dated 1971 includes operations of the penstock and irrigation gates.
