1. PROJECT REQUEST

The City of Detroit Office of Contracting and Procurement (OCP) on behalf of the City of Detroit, Housing and Revitalization Department (HRD) in partnership with the Detroit Water and Sewerage Department (CITY) requests quotes from additional qualified Plumbers to render complex system of underground pipes, sewers and catch basins services ("Services") as set forth in this RFQ.

2. BACKGROUND/DESCRIPTION OF ENVIRONMENT

It is the responsibility of the Bidder to review General Conditions. In your quotation a distinction between dollars and cents must be made. Also, illegible bids may be grounds for rejection of your bid. All changes made to the bid form altering, price, terms, quote and/or conditions. MUST be crossed out and initialed. Failure to initial any changes will be grounds for rejection of your bid.

The U.S. Department of Housing and Urban Development (HUD) has allocated the City of Detroit, through its Housing and Revitalization Department (HRD) $442 Million in Community Development Block Grant – Disaster Recovery (CDBG-DR) funding to support long-term recovery efforts following storm events from the 2021 & 2023 Presidential Major Disaster Declaration (federal disaster declaration FEMA#4607 #4757 - Michigan Severe Storms, Flooding and Tornadoes) no matching requirements. These funds were allocated through the publication of the Federal Register, Vol. 90, No. 5, January 8, 2025, and updated March 19, 2025. The allocation was made available through the Disaster Relief Supplemental Appropriations Act, Public Law 118-158.

These funds were allocated through the publication of the Federal Register, Vol. 87, No. 100, May 24, 2022, and 6368-N-01 January 18, 2023. The allocation was made available through the Disaster Relief Supplemental Appropriations Act Public Law 117-43 and 117-180.The CDBG-DR program funds necessary expenses related to disaster relief, long-term recovery, and restoration of infrastructure, housing, economic revitalization, and mitigation.

This project does meet the definition of mitigation, repairing or replacing sewer laterals may prevent future damage to residential homes, lessening the hardship cause to low-to-moderate income households who may not be able to afford insurance or afford to make those types of repairs without assistance. The City has developed an Action Plan that provides a framework for the expenditure of funds. The CDBG-DR Action Plan is available at the City of Detroit, Housing and Revitalization, Disaster Recovery website, accessible at https://detroitmi.gov/sites/detroitmi.localhost/files/2023-04/CDBG- DR%20Action%20Plan%20APPROVED%204.6.23.pdf

The City of Detroit, Department of Housing and Revitalization, is responsible for the administration of the CDBG-DR funding. The City of Detroit must comply with the terms provided in the applicable Federal Register Notice. The City of Detroit must conform to all Housing and Urban Development, CDBG-DR, and Federal Register notices, and cross-cutting federal requirements in the implementation of projects funded with CDBG-DR.

Because this project is funded with CDBG-DR funds, any contract awarded under this RFQ will condition payment on the City’s receipt and continued availability of those federal funds, and on compliance with applicable federal eligibility and documentation requirements. The City reserves the right to delay payment, reduce scope, suspend work, or terminate the contract if such funds are withdrawn, suspended, reduced, or determined to be ineligible.

3. AWARD CLAUSE INCLUDING RENEWAL OPTIONS

https://detroitmi.gov/sites/detroitmi.localhost/files/2023-04/CDBG-DR%20Action%20Plan%20APPROVED%204.6.23.pdf https://detroitmi.gov/sites/detroitmi.localhost/files/2023-04/CDBG-DR%20Action%20Plan%20APPROVED%204.6.23.pdf

If a contract is awarded as a result of this RFQ, it will be a City of Detroit Contract (Attachment E). The term of the contract will be for four (4) years. Any renewal option exercised under this contract is effective only after the approval of the Detroit City Council and signed by the Chief Procurement Officer. The City anticipates one or multiple awards as a result of the RFQ.

4. SCOPE OF WORK

The City of Detroit is issuing a Request for Quote for the Alley Sewer Repair Program, funded by the Community Development Block Grant – Disaster Recovery . A more detailed description of the CDBG-DR Program is included in the Action Plan approved by HUD, available on the CDBG- DR Program Website.

The City of Detroit is seeking contractors, licensed plumbers, or master plumbers to provide installed/constructed cost for implementation of one or more of the work items described below to inspect, complete repair, or replacement of failed and/or collapsed. The scope also includes the inspection of the receiving public sewers to determine if a private sewer connection is damaged and needs to be repaired or replaced.

SERVICES TO BE PERFORMED *Locations are provisional and subject to change*

The Work is at the direction of the CITY on an as-needed basis and will be throughout the city of Detroit. All labor, equipment, and material for the entire work shall be furnished by the Contractor unless otherwise listed in the measurement and payments. The bidder hereby agrees to perform all work assigned by the Engineer no matter where located, at the Unit Prices established in the Bid Schedule. The Bidder agrees that the unit prices shall remain unchanged for the duration of the Contract and will not be increased for escalation and regardless of the quantities used, whether the quantity of a particular item increases or decreases or if the item is not used at all.

Due to the depth of excavation, the City has determined that the project has an elevated risk of encountering previously unknown archaeological and historic sites. To mitigate this risk, all of the project's ground disturbing activities will be required to follow an Unanticipated Discoveries Plan and Archaeology Inspection Plan. These plans include detailed directions for contractors and the City to follow in the event of an unanticipated discovery of hazardous materials, archaeological artifacts, or human remains, including Stop Work procedures, communications protocols, and steps required prior to resumption of ground disturbing activities. Prior to the commencement of the project's ground disturbing activities, contractors will be required to attend a pre-construction meeting/training to ensure that all parties understand the Unanticipated Discoveries Plan and Archaeology Inspection Plan, and must submit a Health & Safety Plan to HRD for approval.

The Bidder is expected to provide sufficient staff and crews to complete all as-needed tasks on a timely basis as assigned by CITY at the unit prices established in the bidding documents.

The Project may include the following Work as issued by CITY on an as-needed basis:

• Site documentation by means of pre/post construction photography.

• Inspection of the public sewer by means of closed-circuit television (CCTV) and reporting the condition of private sewer service lines (laterals).

• Replacement of sewer services and installation of new cleanout at the property line.

• Point repairs of circular and non-circular public sewers associated with sewer service replacement by open-cut method of excavating the portion of the pipeline and replacing it with new connections.

• Performing site cleanup and restoration including surface restoration of pavement, curbs, sidewalks, driveways, and lawns.

• CCTV of the lateral after installation from newly installed cleanout to the point of connection to the public sewer.

• All labor, equipment, and material for the entirety of the Contract shall be provided by the Contractor unless otherwise stated in the measurement and payment description.

It is anticipated that approximately 9,000 private sewer service line replacements (by means of the open-cut method) of up to approximately 25-feet in depth are to be performed through this contract.

Though some sewer service connections may be 25 feet deep, the average depth of the lateral connection to the public sewer is around 12 to 15 feet deep. The public sewers that private sewer service lines are connected to may range in size from 6-inch through 24-inch. There is no guarantee as to the number of replacement locations that will be assigned, any individual task or through a combination of multiple tasks assigned through this Contract.

All contractors shall be registered with the City of Detroit Buildings Safety Engineering and Environmental Department. With the proper documentation this is done in the office, at the Coleman A. Young Municipal Center, 2 Woodward Ave. Room 408. An appointment is required and can be made at https://detroitmi.gov/departments/buildings-safety-engineering-and-environmental-department

5. OPERATIONAL INFORMATION

a. Site Visit and Testing by Bidders

i. Bidder is encouraged to visit the Site and conduct a thorough visual examination of the Site and adjacent areas. During the visit the Bidder must not disturb any ongoing operations at the Site.

ii. Bidders visiting the Site are required to arrange their own transportation to the Site.

iii. Bidder must conduct the required Site visit during normal working hours.

iv. Bidder is not required to conduct any subsurface testing, or exhaustive investigations of Site conditions.

v. On request, and to the extent Owner has control over the Site, and schedule permitting, the Owner will provide Bidder general access to the Site to conduct such additional examinations, investigations, explorations, tests, and studies as Bidder deems necessary for preparing and submitting a successful Bid. Owner will not have any obligation to grant such access if doing so is not practical because of existing operations, security or safety concerns, or restraints on Owner’s authority regarding the Site. Bidder is responsible for establishing access needed to reach specific selected test sites.

vi. Bidder must comply with all applicable Laws and Regulations regarding excavation and location of utilities, obtain all permits, and comply with all terms and conditions established by Owner or by property owners or other entities controlling the Site with respect to schedule, access, existing operations, security, liability insurance, and applicable safety programs.

vii. Bidder must fill all holes and clean up and restore the Site to its former condition upon completion of such explorations, investigations, tests, and studies.

b. Owner’s Safety Program

i. Site visits and work at the Site may be governed by an Owner safety program. If an Owner safety program exists, it will be noted in the Supplementary Conditions.

c. Other Work at the Site

i. Supplementary Conditions for the identification of the general nature of other work of which Owner is aware (if any) that is to be performed at the Site by Owner or others (such as utilities and other prime contractors) and relates to the Work contemplated by these Bidding Documents. If Owner is party to a written contract for such other work, then on request, Owner will provide to each Bidder access to examine such contracts (other than portions thereof related to price and other confidential matters), if any.

d. Owner on its own initiative may issue Addenda to clarify, correct, supplement, or change the Bidding Documents.

e. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda delivered to all registered plan holders. Questions received less than seven days prior to the date for opening of Bids may not be answered.

f. Only responses set forth in an Addendum will be binding. Oral and other interpretations or clarifications will be without legal effect. Responses to questions are not part of the Contract Documents unless set forth in an Addendum that expressly modifies or supplements the Contract Documents.

Awarded Contractor(s) will work closely with City agency staff.

The Respondent is expected to provide service in accordance with the terms of the executed contract and under the rules, regulations, and supervision of the City.

Each Contractor will be awarded an initial work budget from which tasks will be assigned by CITY until the allotted budget is spent. Additional budget will be awarded to Contractor(s) as work assignments are satisfactorily completed and the allocated budget is spent. Work shall be assigned to Contractor(s) on an as-needed task order basis until the Project Budget is completed. Each task may include multiple sub-tasks, where each sub-task represents one individual service replacement location. Sub-tasks may be grouped into a task when the locations are within the same general area to improve production efficiency and reduce unnecessary mobilization.

After each task is assigned, the contractor will be required to inspect the receiving public sewer to verify that the private sewer service line associated with each sub-task has failed and requires open-cut replacement. The Contractor will be required to submit video documentation to CITY showing the failure on the private service line for CITY’s approval to proceed with the open-cut repair. The video footage must include panned views of services and a distance counter measured in feet.

CITY will provide along with each task assignment:

⦁ A list of sub-task locations ⦁ The task level milestone (substantial and final completion) ⦁ The total budget of the task.

Deliverables for Task /sub-task Assignment are as follows:

a. Sewer inspection video

b. Post private sewer service line replacement video

c. Post site restoration photos

d. Monthly payment application

SCHEDULES: Contract Times: Days All time limits for Milestones, if any, Substantial Completion, and completion and readiness for final payment as stated in the Contract Documents are of the essence of the Contract.

The Work will be substantially complete within 1415 calendar days after the date when the Contract Times commence to run as provided in the General Conditions, and completed and ready for final payment in accordance with the General Conditions within 1461 calendar days after the date when the Contract Times commence to run.

Milestones Parts of the Work must be substantially completed on or before the following Milestone(s):

Milestone duration may be adjusted by the Engineer for each task to reflect the number of sub-tasks, field conditions, restoration needs, and seasonal limitations.

Sub-Task Milestones (per location) Inspection of the public sewer to identify private sewer service line failures: Within 2-3 Calendar days from the date of issuance of each sub-task assignment.

Installation (excavation, replacement, backfill) Each sub-task will be substantially completed within 3 Calendar days from the start of excavation after CITY approval of the open-cut repair.

Restoration (hard and soft restoration)

Restoration for each sub-task shall be completed within 30 Calendar days after installation.

Task Level Milestone (entire task) Task Substantial Completion

Task Substantial Completion will occur within a duration determined by multiplying the total number of sub-tasks in the Task by a Task Substantial Completion Coefficient (TSCC) expressed in calendar days.

Task Substantial Completion = Number of Sub-tasks X (TSCC) The TSCC shall be established by the Engineer for each task. TSCC will generally fall within 3.0 calendar days per sub-task, depending on task complexity.

Total Task Completion Task Final Completion will occur within a duration determined by multiplying the total number of sub-tasks in the Task by a Task Final Completion Coefficient (TSCC) expressed in calendar days.

Task Substantial Completion = Number of sub-tasks X (TSCC) The TFCC will account for restoration sequencing, punch list work, winter shutdown, and any follow up activities necessary to close the Task.

For planning purposes, TFCC will generally fall within 3.0 calendar days per sub-task, as determined by the Engineer based on the task’s overall scope and restoration conditions.

An example for a milestone of a task consisting of 40 sub-tasks/sites:

• Inspection of the public sewer to identify private sewer service line failures: Within 14 Calendar days from the date of issuance of each task

• Task Substantial Completion Date: 85 Calendar Days after task assignment

• Open Hard Surfaces Restored: Within 30 Calendar Days after substantial completion

• Task Final Completion Date: 120 Calendar Days after task assignment

Open hard surfaces restored within 30 Calendar days of installation work. Berm and other soft-scape restoration have a deadline of 30 days after completing the installation of the replacement service.

The Proposer agrees that any work including unmarked underground utilities that may be required to complete any specific item shall be considered incidental and no claim for additional compensation will be made. The work adjacent to any Detroit Department of Public Works (DPW) Road jurisdictions shall be in accordance with the requirements of the Detroit DPW.

CITY will increase the frequency of safety inspections to ensure compliance with safe practices and accepted standards.

Liquidated Damages

Contractor and Owner recognize that time is of the essence as stated in Paragraph

4.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the Contract Times, as duly modified. The parties also recognize the delays, expense, and difficulties involved in proving, in a legal or arbitration proceeding, the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty):

Substantial Completion: Contractor shall pay Owner $500.00 for each day that expires after the time (as duly adjusted pursuant to the Contract) specified above for Substantial Completion, until the Work is substantially complete.

Final Completion: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Times (as duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $1,000.00 for each day that expires after such time until the Work is completed and ready for final payment.

Liquidated damages for failing to timely attain Milestones, Substantial Completion, and Final Completion are not additive, and will not be imposed concurrently.

If Owner recovers liquidated damages for a delay in completion by Contractor, then such liquidated damages are Owner’s sole and exclusive remedy for such delay, and Owner is precluded from recovering any other damages, whether actual, direct, excess, or consequential, for such delay, except for special damages (if any) specified in this Agreement.

Owner shall pay Contractor for completion of the Work in accordance with the Contract Documents, the amounts found in the attached cost summary containing estimated quantities, subject to adjustment under the Contract:

For all Work, at the prices stated in Contractor’s Bid, attached hereto as an exhibit.

Progress Payments; Retainage

Owner shall make progress payments on the basis of Contractor’s Applications for Payment each month during performance of the Work provided that such Applications for Payment have been submitted in a timely manner and otherwise meet the requirements of the Contract. All such payments will be measured by the Schedule of Values established as provided in the General Conditions (and in the case of Unit Price Work based on the number of units completed) or, in the event there is no Schedule of Values, as provided elsewhere in the Contract.

Prior to Substantial Completion, progress payments will be made in an amount equal to the percentage indicated below but, in each case, less the aggregate of payments previously made and less such amounts as Owner may withhold, including but not limited to liquidated damages, in accordance with the Contract.

• Ninety (90) percent of the value of the Work completed (with the balance being retainage).

• If 50 percent or more of the Work has been completed, as determined by Engineer, and if the character and progress of the Work have been satisfactory to Owner and Engineer, then as long as the character and progress of the Work remain satisfactory to Owner and Engineer, there will be no additional retainage.

• Pursuant to MCL 125.1563(3), unless the retained funds are to be provided under a state or federal grant, and the retained funds have not been paid to the City, all retainage shall be held in an interest-bearing account with a regulated financial institution in the State of Michigan. The interest shall belong to the Contractor. The retainage plus interest shall be paid to the Contractor with the Final Payment.

Upon Substantial Completion, Owner shall pay an amount sufficient to increase total payments to Contractor to 100 percent of the Work completed, less such amounts set off by Owner, and less 200 percent of Engineer’s estimate of the value of Work to be completed or corrected as shown on the punch list of items to be completed or corrected prior to final payment.

Final Payment Upon final completion and acceptance of the Work, Owner shall pay the remainder of the Contract Price in accordance with Paragraph 15.06 of the General Conditions.

Consent of Surety Owner will not make final payment, or return or release retainage at Substantial Completion or any other time, unless Contractor submits written consent of the surety to such payment, return, or release.
