No written submission is required.
Amendment 1 ‐

The contractor shall be continually prepared to receive a sufficient number of students to maintain the average on‐board strength capacity noted above and a surge capacity of up to 103 percent, where facilities can accommodate the increased capacity.

Please clarify if a trade change was approved to split the program, identify who is teaching the Advanced Culinary Arts Program (center operated or concurrent enrollment provider), and provide clarification on when the Advanced Culinary Arts program was approved, or whether it will be a new program upon contract award.
See response to question 60, above.
62 12‐13
Please clarify the number of Advanced Welding Slots. The RFP indicates 48 slots. The CTT‐10 shows 12 slots, and the Center’s Occupations Report lists 24 slots. Please clarify the slot count and whether the AT slots and the way the slot count is presented (e.g. 48 slots = 24 full time slots).

Please clarify if the 48 slot Advanced Truck Driver program will continue to be listed as 24 slots on the CTT‐10 and whether its listed that way because it’s a full‐time program in which students are taking 2 slots.

The RFP states, “F.2 TYPE OF CONTRACT ‐ This is a Cost Plus Incentive Fee (CPIF) and Firm Fixed Price Combined contract.” Please clarify the Firm Fixed Price portion, if applicable, or whether the procurement is only Cost Plus Incentive Fee (CPIF).
See response to question 34, above.
67 21 The RFP states, “The contractor shall operate the Woodstock Job Corps Center (JCC) located near/in Woodstock, Howard County, State of Maryland.” Please clarify.
See Amendment 0001.
68 23
As noted in the solicitation, “Upon completion of the contract year, the Contracting Officer will determine the amount of cost incentive fee earned by the contractor, using the cost incentive fee calculation identified in the table above.” Additionally, “Upon completion of the contract year, the Contracting Officer will utilize the Job Corps’ Outcome Measurement System (OMS) data to evaluate the contractor’s overall technical performance, based on achievement of Program Years’ goals, and will determine the level of technical performance incentive fee earned by the contractor.”
The solicitation further states, “Please note that the contractor shall not invoice for any technical performance incentive fee until and/if any fee is earned, and a contract modification is issued.” Does this imply that operators cannot bill any cost or technical fee until the contract year end reconciliation is completed? Alternatively, can the operators bill the budgeted average target cost incentive fee (2%)?
Please clarify.
G.3.2 Payment of Cost Incentive Fees language is correct.
69 30
Clarify what is meant by “Damages will be assessed at the rate of 50 percent of the value specified for the vacant position from days 31 through 60. Damages will be assessed at the full value specified for the vacant positions after 60 days. Damages will be assessed and subtracted from a subsequent voucher.”
Vacant positions are not billed to the government, and as such, it appears the language is punitive. Please clarify.
The solicitation is clear on it's face.
65 44
Paragraph H.31 states, “The Government may reimburse direct costs under the subject contract for staff training that is unique to, and directly benefits, the Job Corps Program.” PRH 5.15R5e1 requires “Center Human Resources Manager must implement a professional development program (signed by the Center Director) for the Safety Officer that shall include but is not limited to the courses listed in Exhibit 5‐4.” This is unique to Job Corps. Please clarify if these costs are reimbursable direct costs.
The offeror who receives the resultant contract is responsible for ensuring that their staff are fully trained and certified for the positions they occupy; and that all staff are in complaince with requirements of the contract at all times.
66 60
The J‐9 and J‐12 attachments differ substantially regarding the cost of utilities, with emphasis on the cost of fuel oil. Below is the FY 2016 data in Volume 1 of the survey:
xxx
For the purpose of cost analysis and contract award amount, should operators use the amounts furnished in J‐12? Please clarify.
For the purpose of cost analysis, use the furnished J‐12 Utilities and Fuel cost worksheet as this data is most relevant and up to date.

The pool roof is a National Office project currently in progress.
68 73 ‐ 74 Please clarify if the submission requires an individual USB flash drive for each proposal section or whether all sections are to be included on a single USB flash drive.
The solicitation is clear on it's face regarding proposal preperation.
69 78 & 83
Please clarify whether a phase‐out proposal is needed for non‐ incumbent operators.
Page 78 states, “Phase‐In or Phase‐Out plans shall include the period of time required for each action, staff requirements, and major steps to be accomplished during these periods. Costs associated with the phase‐in in and phase‐out plans shall be submitted as part of the Business Management Proposal.
Page 83 states, “Both incumbent and non‐incumbent offerors shall include in the Phase‐In/Phase‐Out Costs subsection of their Business Management, a description of all costs that the Offeror reasonably anticipates it will incur as part of phase‐out activities at the end of the contract that will result from this solicitation. The Employment and Training Administration understands that this estimate is dependent upon some factors that are unknown at the time of the proposal preparation, such as the amount of unpaid leave. However, offerors are asked to use their best business judgment in preparing this estimate.”
Please clarify how non‐incumbents should provide a phase‐out proposal, plans, and costs.
Proposals shall include Phase‐Out proposals in accordance with the
RFP.
70 92
There is no associated rubric for rating on the technical approach and staffing resources evaluation criteria. Please provide a rubric for rating that shows the description/definition, like what was provided for the relevant experience and past performance evaluations.
The solicitation is clear on it's face regarding proposal evaluation.
71 Amend 0001 ‐ 2 Amendment 0001 added requirements for an oral presentation.
Neither the RFP nor Amendment included evaluation criteria.
The solicitation is clear on it's face regarding proposal evaluation.
72 Amend 0001 ‐ 5
The RFP requests a 20 page narrative limitation on the oral presentation, covering 60 slides for the technical approach, 10 slides for staff resources, and 10 slides for relevant experience. The presentations total 3 hours. Our experience indicates the 20 page limitation on the narrative maybe restrictive and not allow for full discussion of the 80 slides covering the 3 hour period. Please clarify the page limitation or recommend no limitation on the oral script.
The solicitation is clear on it's face.
73 Amend 0001 ‐ 6
The page numbering asks that each presentation slide must identify the corresponding page number in the associated written narrative.
Please clarify if the “written narrative” is defined as the Technical Approach and Staff Resources proposals or just the Narrative of Oral Presentation.
Correct, the hard copy proposals.
Pages 4‐5, Section B.2
Please confirm offerors are not required to provide amounts for the capital CRA, Equipment and Career Technical Skills Training CLINs (0005, 0006, 0007, etc.).
This is correct. These NTE amounts are provided in the RFP, Section B.2, Pricing Schedule.
Page 21, Section
F.4 Please correct the address in Section F.4, Place of Performance See Amendment 0001.
Page 22, Section
G.3
The RFP fee information is incomplete. The RFP language would not be adequate to implement in a contract award. Please revise and clarify.
1. The Technical Performance Incentive Fee section describes the potential for contractors to earn a “technical performance excellence bonus” in addition to the regular technical performance fee. The Center Operations fee chart does not include a section for the calculation of this Performance Excellence Bonus. A rate and calculation must be identified in the proposal/contract. Please confirm the rate is 0.50%, as outlined in other Job Corps RFP’s. Clarify whether the offeror should revise the form.
The solicitation is clear on it's face.
Page 23, Section
G.3.2
The cost incentive fee section excludes FAR‐required information.
FAR 16.405‐1, Cost‐plus‐incentive‐fee contracts, states: “This contract type specifies a target cost, a target fee, minimum and maximum fees, and a fee adjustment formula.”
1. The RFP/contract must clearly identify the terms for fee adjustment. Please confirm the following for compliance with the
FAR:
a. The total of the Cost Reimbursable CLINS 0002 and similarly in option years, are the “Target Cost”;
b. The Fee Adjustment Formula is 50% government and 50% contractor for over runs and under runs, consistent with other Job Corps contracts.
The solicitation is clear on it's face.
Amend. 0001
2. Will another cost incentive form be included in Section G outlining the target costs by year for center operations?
The solicitation is clear on it's face.
Amend. 0001
3. Confirm contractors are allowed to invoice the Average Cost Incentive Fees of 2% throughout the contract years. The paragraph only addresses “additional cost incentive fees” earned. Please revise the language accordingly.
See response to question 18, above.
Page 29, Section
G.12
The language of this section is not clear or adequate for contract implementation. As the RFP later becomes the contract, the language must be clarified/revised in the RFP/proposal phase.
According to FAR 11.501(b), “Liquidated damages are used to compensate the Government for probable damages. Therefore, the liquidated damages rate must be a reasonable forecast of just compensation for the harm that is caused by late delivery or untimely performance of the particular contract.”
The solicitation is clear on it's face.
1. As the center operations contract is cost reimbursable, the government does not incur a financial loss for vacant positions. As this clause is stated, the assessments would be punitive, not a reasonable compensation to the Government for probable damages.
The solicitation is clear on it's face.
2. The RFP states that the contractor agrees to have a maximum vacancy rating not exceeding 4%. Please define the financial or liquidated damages assessment for exceeding the 4%? The RFP is not complete in this regard. This would be double jeopardy to assess for a vacancy rate exceeding 4% as well as a specified fill rate for designated positions.
The solicitation is clear on it's face.
3. Please clarify how the allowable maximum vacancy rating of 4% or less is calculated (based on vacant FTE’s or salary amounts). The calculation must be standardized and defined in the contract.
This is not a solicitation related question.
4. In the 4% maximum vacancy limitation, how will considerations/adjustments be made for the following:
a. Coverage provided by other positions, substitutes, overtime, etc. Contractors propose coverage for vacancies in critical areas, such as security, residential living, etc.
b. Proposed float savings ‐ With the expectation that turnover and vacancies will occur, it has been standard practice to propose float/vacancy savings and reduce the proposed costing accordingly.
This is not a solicitation related question.
5. Please detail what is meant by the “value specified for the vacant position”. Assessments at 50% or 100% of a specified position rate after 30 or 60 days seems punitive.
This is not a solicitation related question.
6. Please confirm the assessments for vacancies only pertain to the position titles identified in the chart, not to other vacant positions.
The solicitation is clear on it's face.
7. Please confirm the liquidated damages will be executed via contract modification by the Government before the contractor is to subtract the amount from a subsequent voucher; otherwise, the contract will not reconcile.
This is not a solicitation related question.
8. How will the government determine the 30‐day vacancy window? How will this be reported to the government? The current vacancy report in FMS is not adequate for this type of reporting.
This is not a solicitation related question.
9. Would the government reconsider the 30‐day requirement to fill vacancies for the Center Director, Senior Residential Counselor, Security Personnel and the Academic Supervisor? It typically takes longer than 30 days to post and advertise a vacancy; obtain and assess resumes and potential applicants; interview for the position;
vet senior candidates with the Region (including interviewing for CD candidates); and then to provide the selected candidate time to give appropriate notice to their current employer.
No.
10. The chart of positions includes Security Personnel. As the other positions in this listing are management or senior staff, please confirm the reference of “Security Personnel” should be revised to “Security Supervisor.”
Please note this chart is only an exanmple, not a Government Model.
Page 30, Section
G.13
Surge CLIN – The government notes: “The surge OBS will be calculated at the per student price identified in G.7 of the contract.”
The increase in OBS is not a simple calculation using SY cost. The costs may differ based on trades that may be revised, the residential or non‐residential designation of the slots, etc. Will the government consider other methods to adjust the contract OBS instead of using per student price? Please advise.
The solicitation is clear on it's face.
Page 30, Section
G.15
This section references reimbursement for GSA rental charges.
Currently Job Corps contractors do not process payments for GSA rental charges, instead they are handled by the national office. It appears this section is irrelevant and should be removed.
G.15 is a standard clause and is clear on it's face.
Page 34, Section
H.6.B Please confirm the reference to Attachment J.14 should be corrected to Attachment J.17 for the Davis‐Bacon wage determinations.
This is correct.
Page 34, Section
H.6.C
Please confirm the Prevailing Wage/Minimum Required chart applies to prime and subcontractors. The narrative language below the chart states these wages apply only to subcontractor employees.
Yes, this applies to the prime as well.
83 Attachment J‐12 This attachment provides utility information –
* Clarify if the water costs include sewer charges. If not, please provide historical costs for sewer.
Yes, the total cost of water in J‐12 includes both, water and sewer.
Attachments J‐
