FAR (48 CFR) 53.110

Section of the Request for Proposals (RFP) / Solicitation Questions Responses

B.1 (Background) Will the successful operator be required to submit an On-board Strength (OBS) Build-up Plan? Will the current operator be required to update applicant files that have been pending since the center has been on pause prior to transition?

The contractor will be required to submit a build-up plan. The current operator will be required to update applicant files that have been pending.

B.2 (Pricing Schedule); G.10 (Not to Exceed Contracting Line Items)

Please clarify what kind of special projects/initiatives would be paid for under the CLINs 0008, 1008, 2008, and 3008? Special projects may be of a one-time nature such as meetings in the national office attended by center staff. They are changes to the contractor's scope of work that will result in additional expenses currently not contemplated in the contract, which would best be fulfilled as one-time adjustment and billed amounts.

C.2.A (Site Specific Information) Please confirm that the Outreach/Admissions territory is the San Diego Workforce Development Board and Imperial County Workforce Development Board.

That is correct. The Outreach/Admissions territory is the San Diego Workforce Development Board and Imperial County Workforce Development Board. An amendment to the solicitation will be published.

C.2.A (Workforce Development Area) There is only one NEAP zone for the entire state of Utah and two Job Corps centers. Please identify the specific counties within the Utah Workforce Development Board (UTRZ00) for which the San Diego contract is responsible for recruiting.

Concerning new enrollees recruited for the resulting contract, there is a requirement to send 200 students to Utah in addition to the 600 recruited for the San Diego center. Thus, the operator of the San Diego Job Corps Center will send students to Utah but not recruit from Utah. Instead, the operator will recruit from the San Diego Workforce Development Board and Imperial County Workforce Development Board territories. An amendment to the solicitation will be published. Section F.5 states that offerors are expected to recruit 200 arrivals for Clearfield, Utah and 600 arrivals for San Diego, California. Section F.5 also provides a breakdown of the arrivals for each center along with the male students, female students, monthly total, and yearly total for each.

C.2.C (Site Specific Information / On-board Strength) Will the successful operator be required to submit a plan per Job Corps Program Instruction Notice No. 21-12 (Consolidation of Job Corps’ COVID-19 Policies) and 21-04 (Resumption of Traditional Enrollment)?

The successful offeror will not be required to submit a plan. The salient parts of the Job Corps Program Instruction Notice No. 21-12 will be incoprated into the Emergency Action Plan.

C.2.D (Site Specific Information / Career Technical Training Program)

Please confirm if the off-center trade is 1:1 and all on-center trades are 2:1. Section C.2.D stipulates the trades and slot counts that pertain to this solicitation

C.2.D (Site Specific Information / Career Technical Training Program)

Please confirm that all trades listed in the Career Technical Training chart are not to be provided by National Training Contractors (NTC) except for the ones marked by the asterisks (**).

The asterisks (**) indicate programs offered by National Training Contractors (NTCs).

C.2.D (Site Specific Information / Career Technical Training Program)

Please clarify the slots for Advanced Career Training (ACT), Certified Nurse Assistant, and Welding. The slot counts do not appear to match U.S. Department of Labor's master profile.

The slot count for Career Technical Training is correct for this solicitation.

C.2.D (Site Specific Information / Career Technical Training Program)

Can the Government provide clarification on the location of Advanced Career Training (ACT)? Providing the Advanced Career Training (ACT) will be offeror-specific in compliance with all PRH and RFP requirements, the ACT program should be located close to the center to ensure all services and programs are offered according to policy. Local area research indicates there are over 20 colleges within a 50-mile area.

C.2.D (Site Specific Information / Career Technical Training Program)

Is the center's certified nurse assistant program state-approved? Is the San Diego center a state-certified driver’s education provider?

This is offeror-specific by state. Job Corps medical programs that operate as listed in the solicitation may graduate or have students complete without taking the state exam. Therefore, offerors are expected to ensure proposed programs meet Government requirements and should not presume that any state approvals will be transferred to incoming operators.

C.2.D (Site Specific Information / Career Technical Training Program)

The RFP shows a total of 526 Career Technical Training (CTT) slots. However, the most recent CTT-10 report shows 580 total slots (including Advanced Career Training). Can U.S. Department of Labor confirm that 526 CTT slots are accurate for the upcoming contract?

For example, for Certified Nurse Assistant, the CTT-10 report shows 90 slots, but the RFP specifies 60. Likewise, the CTT- 10 report shows 48 slots for Welding, but the RFP specifies 24.

The old contract was incorrect and not compliant with current policy and CTT slot ratios. The program office was consulted regarding trades and slots to ensure that new policy is implemented in this solicitation. The slot count for CTT is correct for this solicitation.

C.2.F (Site Specific Information / Staff Housing) The RFP notes staff housing is available, but there is no reference to it in the Facility Survey, and there was no mention of it during the site walk-through. Can the Government please confirm that staff housing is available. If so, how many units/square footage is available per unit? Does rent from staff housing go to the Government or is it part of the firm fixed price?

Staff housing is not available at the San Diego Job Corps Center. The solicitation has been amended through Amendment 0001.

C.2.F (Site Specific Information / Staff Housing) The RFP indicates that a housing plan for non-residential students is required within 30 days. Please provide further expectations and indicate whether this is related to the staff housing reference.

The phrase "non-students" refers to staff. Staff housing is not available at the San Diego Job Corps Center.

C.2.I (Failure to Maintain Staffing Levels) The solicitation states that damages for failure to maintain staffing levels will begin on the first month of operations. Will the Government consider revising this language to state, “Beginning the fourth month of operations....,” which is similar to other fixed-price contracts awarded?

The language in the solicitation is standard and cannot be amended at this time.

C.2.I (Failure to Maintain Staffing Levels) Can the Government share the current staffing vacancy rate? Does the center currently have significant staffing vacancies? The staff vacancy rates of the current operator will not be shared.

Offerors should propose adequate staffing and wages to ensure that services and programs meet Government requirements.

F. 5 (Deliverables) / C.2 (Site Specific Information)

Section F.5 (Deliverables) indicates the contractor will be responsible for arrivals at the San Diego (California) and Clearfield (Utah) Job Corps Center. Section C.2 (Site Specific Information) states, “Youth screened for the Job Corps program shall come from workforce development areas in the state of California as follows: Imperial County Workforce Development Board, San Diego Workforce Development Board, Utah Workforce Development Board.” Please confirm the Government’s mention of the Utah Workforce Development Board is related to the recruitment of students for the Clearfield (Utah) Job Corps Center. Or will the contractor recruit students from Utah for the San Diego Job Corps Center in California? Also, please clarify who is responsible for Outreach/Admissions in the Riverside County Workforce Development Area.

Concerning new enrollees recruited for the resulting contract, there is a requirement to send 200 students to Utah in addition to the 600 recruited for the San Diego center. Thus, new enrollees in Utah will not be assigned to the San Diego Job Corps Center in California. Please refer to the solicitation for the exact On-board Strength (OBS), capacity, and male / female enrollee breakdown for each center. The operator of the Inland Empire Job Corps Center is responsible for Outreach and Admissions in the Riverside County Workforce Development Area.

F. 5 (Deliverables) The RFP lists 600 arrivals for San Diego and 200 to Clearfield. With a contracted capacity of 555 students, this arrival goal for San Diego seems low when applying the normally-used 3% Weekly Termination Rate (WTR). Please confirm this arrival goal for San Diego to ensure adequate staffing to meet arrival needs and promote 100% On-board Strength (OBS).

The solicitation is correct for the arrival numbers.

F. 5 (Deliverables) The expected arrivals are between 51 and 53 monthly. Will there be an adjusted COVID OBS of 84% per the recent release from Job Corps Acquisition Services?

The Outreach/Admissions arrivals specified in Section F.5 of the solicitation will remain unchanged at this moment.

G.9 (Price Adjustment for Less-than-100% On Board Strength)

The Executive Order and Service Contract Act requirement has significantly increased wages. The On-board Strength (OBS) payback calculation assumes 15% of the contract value is a group of select non-personnel lines. There has been no consideration for increases in personnel expenses and the dilution of non-personnel expenses. Will the Government consider a Contract Line Item Number structure that breaks out personnel, non-personnel, and non-personnel expenses subject to the 15% OBS price adjustment?

The language in the solicitation is standard and cannot be amended at this time.

H.5 (Travel and Per Diem)

Please confirm if the Contract Line Item Number (CLIN) reference in this paragraph should be to CLIN xx08?

Travel may be associated with work identified with special projects/initiatives as directed by the Government. However, it may be exclusive to CLIN XX08. The requirement to obtain pre-approval from the Contracting Officer for travel outside of a special project initiative is no longer required. All travel costs that the contractor anticipates for normal operations, Outreach & Admissions, and Career Transition Services (non-special projects) are to be built into the contractor's fixed price.

H.6 (Service Contract Labor Standards)

Should the hire/vacation accrual date be when the employee originally was hired on the contract (regardless of which contractor operated the center)? Or should the hire/vacation accrual date be when the employee was hired with the current contractor?

A service employee’s eligibility for vacation benefits is based on the total length of time the employee has been in the contractor’s service (commercial work and federal contract) and, where applicable, the total length of time the employee has been employed in any capacity in the continuous service of any predecessor contractor and has been carrying out similar contract functions at the same facility.

For the purpose of proposal development and submission only, offerors shall assume that all incumbent employees are entitled to two weeks of vacation

H.25 (Adherence to Lease Agreements) Please advise if there are any existing lease agreements to support Outreach/Admissions and Career Transition Services that the successful offeror must assume. If so, please provide.

There should not be any rental or lease agreements that will be transferred to the successful offeror. All such agreements should be terminated during the transition period.

I (Contract Clauses and Provisions) In accordance with FAR 16.203-1, will the Government consider adding an Economic Price Adjustment (EPA) or Price Adjustment Clause to the contract?

On a case-by-case basis, the Government may honor requests for equitable adjustment. However, Section I (Contract Clauses and Provisions) of the solicitation will remain in its present format. No additional clauses will be incorporated at this time.

J-1 (Price Detail Template) Should offerors update the Not-to-exceed (NTE) fields on the Contract Award tab to better align with Section B.2 (Pricing Schedule)?

Attachment J-1 (Price Detail Template) has been revised/updated with not-to-exceed (NTE) amounts aligning with Section B.2 (Pricing Schedule) of the solicitation.

J-5 (Career Technical Skills Training) Please confirm the Career Technical Skills Training (CTST) slot count for the Welding program. The slot count for CTT is correct for this solicitation.

J-5 (Career Technical Skills Training) Has the CTST Plan for Job Corps Program Year 2023 been submitted? Are there any incomplete/pending CTST projects pending from the pre-pandemic period?

Offerors should propose a CTST program, plan, and projects that meet the Government's requirements with a planned new contract start date of October 1, 2023.

J-8 (Standard Form 1413) Please confirm that Attachment J-8 (Standard Form 1413) is to be provided upon contract award and not as part of the proposal submission.

Standard Form 1413 (Statement and Acknowledgment) will be completed upon award of a subcontract following the execution of the prime contract. It is not submitted with the proposal for the prime contract.

J-9 (Facility Survey) The Facility Survey volumes only provide the Executive Summaries. Can the Government please provide the complete volumes of the Facility Survey?

Please review the complete Facility Surveys provided.

J-9 (Facility Survey) The Facility Survey from 2017 indicates that Building 190 was closed and the first floor of Building 177 was vacant. Can the Government please confirm this is still the case?

Bldg. 190 is closed. Bldg. 177 is used as a dormitory and is designated as such. Please refer to the dormitory bed capacity roster provided. (This information was further confirmed by the Contracting Officer's Representative.)

J-9 (Facility Survey) How many dormitories are necessary to operate at full On-board Strength (OBS)? How many floors in each dormitory can be utilized for housing? Please provide bed capacity for each dormitory and floor.

The dormitory capacity and configurations are provided in a separate attachment.

J-9 (Facility Survey) Can U.S. Department of Labor confirm if there are elevators in any building on the center? Please revew the full Facility Surveys provided.

J-9 (Facility Survey) Have any of the issues recommended for Regional or National Projects in the facility survey been resolved since the 2018 visit?

Depending on which issues, some have been resolved and others have been postponed for resolution. Any projects which the contractor is responsible for will be funded through the Construction, Rehabilitation, and Acquisition (CRA) line item.

J-9 (Facility Survey) Does any of the facility equipment (boilers, heating, or ventilation) require the maintenance workers to have a certain certification or license to work on them? If yes, would the Government please provide a list of certifications/licenses so the maintenance workers can be classified correctly?

Offerors should propose qualified maintenance staff to ensure that Government facilities are maintained with all applicable codes and regulations.

J-10 (Electronic Property Management Listing) Are the washers and dryers on the center leased or owned? Twenty washers and dryers are owned. The remaining washers and dryers were leased. At this time, the lease is being terminated.

J-10 (Electronic Property Management Listing) Does the center own or lease dishwashers? Dishwashers are owned.

J-10 (Electronic Property Management Listing) The Electronic Property Management Listing (EPMS) shows more the 10 rented copy machines. Since the EPMS also indicates the center owns copiers of the same brand (Kyocera), please advise if these existing copier agreements are lease-to-own. If so, will these lease-to-own copiers remain at the center upon change of operator?

If any lease-to-own copiers are on center, the current agreements will be terminated at transition. The copiers would be turned over to the new operator under new agreements.

J-11 (Inventory) Please clarify if the clothing inventory on hand will be transferred from the incumbent contractor to the new contractor if the incumbent contractor is a cost-reimbursement or hybrid type contract. Or will the successful offeror be required to negotiate the purchase and transfer of expendable inventory and supplies on hand?

Inventory will be turned over to the successful offeror.

J-12 (Utilities and Fuel Usage) Are there any costs for utilities outside of electricity, gas, sewer, and water (i.e., wastewater, propane, fuel oil)? There are no costs for any other utilities.

J-12 (Utilities and Fuel Usage) The data in Attachment J-12 only provides 18 months of information. Can U.S. Department of Labor provide prior years' data for comparison?

The data in Attachment J-12 of the solicitation is the latest and most complete information available as provided.

J-12 (Utilities and Fuel Usage) / J-23 (Utility Cost Trend)

Attachment J-12 indicates utility utilization for the period ending 9-30-2022 is $1,071,487. Annualized through 9-30-2023, the utilization equates to $1,331,172. For the 5 program years in Attachment J-23, the center's utilization averaged 50% less than what's indicated in Attachment J-12 . Can you confirm the data provided in Attachment J-12 is accurate and more relevant than the historical data provided in Attachment J-23? Can you also confirm there is no infrastructure concern that would create excessive utilization of water/sewage or electricity?

Some of the data was generated during the pandemic. The data is accurate as provided. U.S. Department of Labor/Office of Job Corps leases the site/buildings from the Navy. The Navy's billing is inconsistent, which can be attributed to the large variances.

J-12 (Utilities and Fuel Usage) / J-23 (Utility Cost Trend)

According to Attachment J-12, total utility costs were approximately $1.07 million for the period of 10/2021 – 9/2022.

However, according to Attachment J-23, total utility costs were approximately $390,000 one year prior in 2020. Can U.S.

Department of Labor confirm this data is correct? If so, please explain why there are such large variances between years?

U.S. Department of Labor/Office of Job Corps leases the site/buildings from the Navy. The Navy's billing is inconsistent, which can be attributed to the large variances.

J-15 (Construction Wage Rate Requirements Determination); J-16 (Service Contract Labor Standards)

Will U.S. Department of Labor provide the Wage Determinations for all counties in the National Enrollment Assignment Plan

(NEAP)?

U.S. Department of Labor will not provide the Wage Determinations for all counties in the National Enrollment Assignment Plan. Contractors must notify the Government of the location of any staff not covered in the Wage Determinations published in the solicitation.

J-16 (Service Contract Labor Standards) Suppose a position fits within the wage determination but also supervises student workers. Would the Government please clarify if this position is required to be paid more?

Compensation and payment to employees will be the decision of the contractor and should be in compliance with the current applicable Federal and State prevailing wages.

J-17 (Collective Bargaining Agreement) Are any of the employees represented by a union? If so, can we get a copy of the agreement? A Collective Bargaining Agreement is not applicable to this solicitation.

J-19 (Lease Agreement) Since the Job Corps center is on Navy property, is there a lease that the operator is responsible for maintaining? What is the expiration date of the current lease with the Navy?

The Navy leases the buildings to the U.S. Department of Labor. Offerors will be expected to fulfill all Government requirements as specified by the Job Corps Policy and Requirements Handbook (PRH), the periods of performance as defined in the solicitation, and the new contract resulting from the solicitation.

J-22 (GSA Vehicle List) The GSA Vehicle List shows 23 vehicles with duplicates for Tag Nos. G43-2420U and G43-2470U, thus resulting in 17 GSA vehicles. Please confirm the duplication and identify the vehicle(s) used for Driver’s Education and whether they are equipped with dual brakes. Are there any plans for return of under-utilized vehicles?

There are 17 General Services Administration (GSA) vehicles. Tag Nos.

2420U and 2470U with Vehicle Identification Numbers 760 and 965 are duplicates. GSA vehicle staff indicates duplicates are due to various recalls. Duplicates were identified and provided to the offerors.

J-26 (Additional Center-Specific Information) Please confirm there is no additional center-specific information. There is no Attachment J-26 (Additional Center-specific Information).

J-28 (Staff Compensation Plan) / J-4 (Staffing Chart) Should offerors delete positions not used on the Staff Compensation Plan the same way as prompted on the Staffing Chart since they are aligned?

Positions not used could be deleted from the Staff Compensation Plan.

L.6 (Instructions for Proposal Submission) / L.7 (Proposal Content)

To assure receipt of email submissions, please confirm any file size limitations. Assuming adherence to Sections L.6 and L.7 of the solicitation, proposals may be submitted through multiple e-mails, in Portable Document Format (PDF), or as a compressed (ZIP) file.

L.6 (Instructions for Proposal Submission) What is the page limit for Technical Approach? In accordance with the solicitation, Technical Approach is limited to 43 total pages.

L.6.H (Proposal Format) Restricting the type of font to Times New Roman or Arial significantly reduces the proposal response space (up to 3 pages depending on font type). Would U.S. Department of Labor consider accepting "Garamond" type font for this proposal?

The requirements in Section L.6.H (Proposal Format) of the solicitation will remain in its present form. No changes will be implemented at this time.

L.7 / Factor 4 (Business Management Proposal) The 2023 California state minimum exempt salary threshold is $64,480. Please confirm offerors are required to bid the California 2023 exempt status salary threshold minimum for all exempt employees.

Please submit your proposal in accordance with applicable state law.

L.7 / Factor 4 (Business Management Proposal) Please confirm that the "not less than 3%" escalation factor applies only to Attachment J-28 (Staff Compensation) and is not mandatory for Attachment J.1 (Pricing).

All offerors shall propose staff salaries and health and welfare benefits with a yearly escalation factor of not less than 3%.

L.7 / Factor 4 (Business Management Proposal) Should offerors include sales taxes in their pricing? Or will U.S. Department of Labor allow an equitable adjustment in the event the State of California requires the winning bidder to pay sales tax on purchases made during contract performance?

Please refer to Section 158(d) of the Workforce Innovation and Opportunity Act. The U.S. Department of Labor will not allow equitable adjustments due to state taxes.

M.1 (Evaluation Factors) Technical Approach, Demonstrated Record of Effectiveness (Past Performance), and Staff Resources are adjectively rated.

Can the adjectival ratings and matrix for the ratings be provided?

Concerning factors for evaluating proposals, the information in Section M.1 of the solicitation is all that will be provided at this time.

Will Service Contract Act wages and the Health & Wellness rate increase by a minimum of 3% every year of the new contract?

All offerors shall propose staff salaries and health and welfare benefits with a yearly escalation factor of not less than 3%.

Is the center on a bus route? A search on the San Diego Metropolitan Transit System's website revealed that the San Diego Job Corps Center may be accessible by public transporation. Please visit the website for more information:
