RFP 1.6.12, Key Personnel and Attachment J.5 – Historical Staffing Information

Attachment J.5 – Historical Staffing Information identifies only three labor categories: Manager (MGR), Caseworker (CW), and Administrative Assistant (AA).

However, RFP 1.6.12, Key Personnel, identifies the labor categories of Program Director (Key Personnel), Deputy Program Director (Key Personnel), Program Manager, Case Worker, Administrative Assistant, and Office Manager.

Request the Government clarify all labor categories on Attachment J.5 with their work locations and number of FTE.

The Government identifies that the contractor shall furnish all monitors, computers, laptops, printers, and all other computer equipment necessary for staff to perform the specific tasks outlined in the PWS (unless Government or DOL OCIO requirements change and require the use of Government Furnished Equipment).

Because it impacts pricing veractiy, what is the DOL's minimum hardware procesesing requirements (processor speed, number of core processors, random access memory, graphics card, etc.) for the computers, are there additional NIST 800-66 requirements for HIPAA compliance, and do they need to be NIST 800- 171 and FIPS compliant (i.e., modem, router, switch multi-factor authentication, etc.)?

The DEEOIC primarily uses Dell Latitude 5430 computers. It's recommended the Contractor have computers with similar or better capabilities/specifications.

Contractors under this contract are not subject to HIPAA. Any other requirements for hardware are specified in the PWS.

Scanners are required for each office location.

Historical Workload 5.1.3 Staffing

This section identifies the contractor must provide sufficient staff, in number, experience, and qualifications to perform the assigned tasks associated with this PWS; however, no supporting information is provided to determine what is a "sufficient" number of staff.

Request the Government provide statistics per month and year for data collected for each Resource Center.

Standard Operating Procedures

5.6.1 Claim

Intake and Assistance

The PWS states "All Government Regulations and Standard Operating Procedures must be implemented and followed when assisting in the completion of the claim form."

In the 2021 Annual Report to Congress by the Office of the Ombudsman for the Energy Employees Occupational Illness Compensation Program, the Director of OWCP stated, “DEEOIC agrees with the Board that providing claimants with better information about the OHQ process may also improve exposure data. Accordingly, DEEOIC will work to produce a notice or summary document to help claimants prepare for an OHQ. This process will be included in standard operating procedures for the Resource Centers this summer.”

Respectfully request a copy of the Standard Operating Procedures used by the Resource Centers.

Resource Center operating procedures are outlined in the Federal (EEOICPA) Procedure Manual, Version 7.1 and the PWS.

Statement of Equivalent Rates for Federal Hires

I - Contract Clauses

There is an "X" in front of (2) 52.222-42, Statement of Equivalent Rates for Federal Hires (MAY 2014) (29 U.S.C. 206 and 41 U.S.C. chapter 67) but required information is missing. In compliance with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor ( 29 CFR Part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C.5341 or 5332.

To create a level playing field for all proposers and to accurately project costs, prevent an unfair competitive advantage to the incumbent, and provide accurate pricing to the Government, request the Government provide the information required by the Department of Labor per FAR 52.222-42, Statement of Equivalent Rates for Federal Hires, as prescribed in 22.1006(b).

The required information includes Employee Class and Monetary Wage-Fringe Benefits.

Please refer to the applicable wage determinations associated with the RFP.

Statement of Equivalent Rates for Federal Hires

I - Contract Clauses

There is an "X" in front of (2) 52.222-42, Statement of Equivalent Rates for Federal Hires (MAY 2014) (29 U.S.C. 206 and 41 U.S.C. chapter 67) but required information is missing. In compliance with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor ( 29 CFR Part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C.5341 or 5332.

To create a level playing field for all proposers and to accurately project costs, prevent an unfair competitive advantage to the incumbent, and provide accurate pricing to the Government, respectfully request identification of employment start dates on the current contract or preceding contracts (just dates, not names) for non-Exempt personnel employed under a Service Contract Act Wage Determination. FAR 52.222-42, Statement of Equivalent Rates for Federal Hires, in compliance with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor (29 CFR Part 4), identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C.5341 or 5332. This is also necessary because Paid Time Off benefits change depending upon the start date for employees (whether on the current contract or preceding contracts).

Please refer to the applicable wage determinations associated with the RFP.

Terms & Conditions - Statement of Equivalent Rates

I - Contract Clauses

There is an "X" in front of (2) 52.222-42, Statement of Equivalent Rates for Federal Hires (MAY 2014) (29 U.S.C. 206 and 41 U.S.C. chapter 67) but required information is missing. In compliance with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor ( 29 CFR Part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C.5341 or 5332.

To create a level playing field for all proposers and to accurately project costs, prevent an unfair competitive advantage to the incumbent, and provide accurate pricing to the Government, respectfully request Civil Service Equivalent Grades for Exempt personnel to ensure proper compensation is provided in accordance with FAR 22.1016, Statement of Equivalent Rates for Federal Hires. FAR 52.222-42, Statement of Equivalent Rates for Federal Hires, identifies the Government shall set forth those wage rates and fringe benefits that would be paid by the contracting activity to the various classes of service employees expected to be utilized under the contract if 5 U.S.C.5332 (General Schedule-white collar) and/or 5 U.S.C.5341 (Wage Board-blue collar) were applicable. This allows us to accurately price the corresponding pay band for each position.

Please refer to the applicable wage determinations associated with the RFP.

Pricing Section B - Supplies or Services/Prices

Should Offerors enter the NTE ceiling amount as the Unit Price and Amount when completing B.2 Pricing Schedule for CLINS 0003, 0004, 1003, 2003, 3003, and 4003?

Pricing Section B - Supplies or Services/Prices

Would the Government please provide the locations and estimated number of trips for travel so that Other Direct Costs & Travel may be priced fairly? If that information is not available, would the Government please provide a "plug" travel / Not To Exceed amount for CLINS 0002, 1002, 2002, 3002, and 4002 so it may be priced fairly?

Travel locations and number of in-person outreach events varies from year to year based on a variety of factors such as legislative and policy changes, community interest/needs, and most recently, Executive Order 13985.

4.1.3.1 - Maintain Database

Does the database Contractors are responsible for managing, which includes all 11 Resource Center claim-related activities, already exist and will it be transferred to the new Contractor?

5.4.3 - Driving to Terminal Claimant Residence or Medical Care Facility

Please confirm all mileage incurred in support of driving to a Terminal Claimant Residence or Medical Care Facility is reimbursable by the Government under Federal Travel Regulation criteria.

The mileage is reimbursable under FTR criteria through Other Direct Costs & Travel

Bronze Information

5.10.2 - Energy Imaging System

Section 5.10.2 alludes to "bronze" information being uploaded into OIS.

Could the Government please define or provide additional examples of what "bronze" information means?

As stated just before the term is used, it refers to uploading information directly to OIS. Resource Centers are to use the Energy Document Portal to scan documents rather than uploading or "bronzing" them directly to OIS.

Key Personnel Resumes

Section L, Sub- Factor 2: Staffing

The Government has requested resumes to be submitted for Key Personnel (Program Director and alternate).

Because resumes can be very lengthy, respectfully request the Government exclude resumes from being included in the page count identified in Section L-C (Page Count) ("Volume I cannot exceed 35 pages, excluding the Quality Control Plan (QCP), transition plan, cover pages, title pages, executive summaries, table of contents, or any applicable attachments in Section J of the RFP.").

No, resumes will not be excluded from the page count.

Past Performance

CPARS

M.3 Past Performance Evaluation

Given the short timeframe of the solicitation (10 days) and the additional urgency and burden placed on our current technical customers in this short timeframe, may the Offeror use CPARS in lieu of Past Performance Questionnaires?

The offeror may not use CPARs in lieu of Past Performance Questionnaires.

Past Performance Subcontractors

M.3 Past Performance Evaluation

The solicitation states, "Past Performance information performed entirely by an Offeror's proposed Subcontractor, or the proposed Subcontractor and an entity other than the Offeror will not be evaluated."

This is unclear. Does this mean that at least 1 of the 3 contract references must be from the Offeror and that all 3 may not be from a firm other than the Offeror?

No. This means we will only evaluate the offeror's past performance, not their subcontractor's performance.

Attachment J.4 – Historical Staffing Information This table provides the number of staff of in each position at all Resource Center locations. Positions include Office Manager (MGR), Caseworker (CW), and Administrative Assistant (AA). The table also includes two (2) CW positions that are not physically located within a Resource Center location. These Caseworkers work remotely from the Navajo Nation and are supervised by the Espanola Resource Center MGR. Part time employees are counted as 0.5.
