About this file

This is a Trench Safety Act Requirement form for Broward County, Florida's FEMA Pipe and Valve Maintenance & Installation Services contract. The document establishes compliance requirements for vendors performing work involving trenches exceeding 5 feet in depth. Vendors must acknowledge awareness of Florida Statutes Sections 553.60 through 553.64, which incorporate Occupational Safety & Health Administration excavation safety standards (29 C.F.R. Section 1926.650) as state standards. The form must be submitted with the vendor's initial solicitation response or within three business days of the County's request, with failure to comply potentially rendering the vendor nonresponsive. Vendors are required to identify anticipated methods and costs for compliance with applicable trench safety standards, including special shoring requirements where applicable.

The completed form requires vendors to specify their trench safety compliance approach and associated costs using either an open-end or fixed contract format. For open-end contracts, vendors must identify unit prices and methods for linear feet of trench work and special shoring by square feet. For fixed contracts, vendors must provide quantities, unit prices, and methods for the same line items. This requirement applies to any project under the FEMA Pipe and Valve Maintenance & Installation Services contract that involves trench work, and vendors' assurance of compliance is legally binding on all employees and subcontractors. The form was dated September 9, 2024, and serves as a mandatory documentation of vendor capability and commitment to excavation safety standards.
