About this file
This is a Criminal History Screening Practices Certification form required by Broward County, Florida for vendors seeking contracts valued at $100,000 or more. The certification document, dated September 9, 2024, pertains to the FEMA Pipe and Valve Maintenance & Installation Services contract, which is an open-end agreement to supply and deliver FEMA-compliant pipe and valve maintenance and installation services for Water and Wastewater Services and various other Broward County agencies. Vendors must submit this certification form with their solicitation response through the BPRO electronic system by the closing deadline, or within three business days of the County's request if not provided with the initial submittal. Failure to comply with submission requirements may result in the vendor being deemed nonresponsive.
The certification requires vendors to confirm compliance with Section 26-125(d) of the Broward County Code of Ordinances, which mandates that vendors implement policies, practices, and procedures that prevent inquiry into an applicant's criminal history until after the applicant has been selected as a finalist and interviewed for employment positions located within the United States that will foreseeably perform work under the contract. Vendors may alternatively certify exemption if they are required by applicable federal, state, or local law to conduct criminal history background checks at a different time or manner, or if they are a governmental agency. Non-compliance with these requirements at any point during the contract term constitutes material breach and may result in contract termination, debarment, or suspension proceedings under Broward County Administrative Code Chapter 21. The solicitation also includes requirements for County and State licensing, bonding, FEMA compliance, and County Business Enterprise (CBE) goal participation.
