USMS-0012 Contracting Officer's Representative (COR)
CONTRACTING OFFICER'S REPRESENTATIVE (COR) (AUG 2017)
(a) To Be Determined is hereby designated as the Contracting Officer's Representative (COR). The COR may be changed at any time by the Government without prior notice to the contractor by a unilateral modification to the contract. The COR is located at:

(b) The responsibilities and limitations of the COR are as follows:
(1) The COR is responsible for the technical aspects of the contract and serves as technical liaison with the contractor. The COR is also responsible for the final inspection and acceptance of all deliverables and such other responsibilities as may be specified in the contract.
(2) The COR is not authorized to make any commitments or otherwise obligate the Government or authorize any changes which affect the contract price, terms or conditions. Any contractor request for changes shall be referred to the Contracting Officer directly or through the COR. No such changes shall be made without the express written prior authorization of the Contracting Officer. The Contracting Officer may designate assistant or alternate COR(s) to act for the COR by naming such assistant/alternate(s) in writing and transmitting a copy of such designation to the contractor.

USMS-0001 Release of Residual Funds ($100 or Less)
The contractor is advised when submitting the final invoice under this contract to submit an information copy of the invoice to the Contracting Officer. The invoice must be marked “Information Copy – Final Invoice.” If residual funds on the contract total $100 or less, the government will automatically deobligate the residual funds without further communication with the vendor. Upon receipt and payment of the final invoice, it is understood and agreed that all outstanding obligations incurred on the above referenced contract have been satisfied. Therefore, it is further understood and agreed that the government shall not be liable for the payment of any future invoices that may be submitted under the above referenced contract. (Applies to all contracts)

USMS-0002 Release of Residual Funds (Greater Than $100)
If funds greater than $100 remain on this contract after the final invoice, the Government will issue a bilateral modification to authorize release of those funds. The contractor’s signature on the modification will constitute understanding and agreement that all outstanding obligations incurred on this contract have been satisfied. The Government shall not be held liable for the payment of any further invoices submitted under this contract. The contractor will have up to 30 calendar days after issuance of the modification to sign and return it. Further, failure to sign and return the modification within the stated time period shall be considered acceptance of the government’s intent to deobligate the residual funds; and releases the Government from any future liability stemming from or related to this contract. (Applies to all contracts.)

USMS-0003 Acceleration of Payments to Small Businesses
In order for the United States Marshals Service Payment Office to comply with OMB Memorandum M-11-32, all invoices from any small business must include the following statement of self-certification of its small business status:
"I hereby certify that ____________________________________________________________ is a small business concern as defined in Federal Acquisition Regulation (FAR) subpart 2.101."
This requirement for certification is in addition to any other invoicing instructions for this contract. Failure to include this certification on invoices may result in delayed payment.
52.217-8 Option to Extend Services (Nov 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days before the contract expires.

52.217-9 Option to Extend the Term of the Contract (Mar 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 10 days before the contract expires.; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 20 days [60 days unless a different number of days is inserted] before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 10 months (months) (years).

52.203-17 Contractor Employee Whistleblower Rights and Requirement To Inform Employees of Whistleblower Rights (Apr 2014)
(a) This contract and employees working on this contract will be subject to the whistleblower rights and remedies in the pilot program on Contractor employee whistleblower protections established at 41 U.S.C. 4712 by section 828 of the National Defense Authorization Act for Fiscal Year 2013 (Pub. L. 112-239) and FAR 3.908.
(b) The Contractor shall inform its employees in writing, in the predominant language of the workforce, of employee whistleblower rights and protections under 41 U.S.C. 4712, as described in section 3.908 of the Federal Acquisition Regulation.

(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts over the simplified acquisition threshold.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. JUSTICE PRISONER & ALIEN TRANSPORTATION SYSTEM (JPATS)
STATEMENT OF WORK
IN-FLIGHT PARAMEDICS
I. Objective: The purpose of this contract is to provide, at a minimum, the In-flight medical services of a licensed Paramedic. The In-flight medical services are for prisoners in the custody of the United States Marshals Service (USMS)/Justice Prisoner and Alien Transportation System (JPATS) Division.
II. Background: The Justice Prisoner and Alien Transportation System (JPATS) transports prisoners in support of the Federal judicial process for the Federal Bureau of Prisons (BOP) and the United States Marshals Service (USMS). JPATS also supports prisoner transportation requests for state and local law enforcement agencies and other federal agencies, including the military, on a space-available basis. Additionally, when called upon, JPATS is prepared to respond to national emergency events or special movements in support of national security.
III. Scope: The Contractor must provide all necessary management, supervision, manpower, transportation, materials, and clothing, to perform Paramedic medical services for the USMS/JPATS. During the term of this contract, including any extensions, the medical coverage required may change (increase or decrease) as deemed necessary by the Government.
In-flight medical services are anticipated to require coverage of a minimum of one to 130 inmates, for any given JPATS flight mission.
IV. General:
A. For the purpose of this Statement of Work (SOW) and the mission of JPATS, the In-flight Paramedics will be referred to as a “Paramedic.”
B. The USMS will provide medical equipment and supplies required for the transport of prisoners upon contract award.
C. Contractor shall inform its own personnel prior to commencement of contractual services of their requisite internal administrative functions and procedures (e.g.
completion / submission of timesheets /travel vouchers).
D. Contractor shall supply proper uniform and ensure appropriate appearance of its own personal attire.
E. The period of performance will be for a base period of nine (9) months with two (2) option years:
Base Period: February 1, 2020 – September 30, 2020
Option Period 1: October 1, 2020 – September 30, 2021
Option Period 2: October 1, 2021 – September 30, 2022
V. Work Location: Paramedics will be based at the JPATS Hangar at the Will Rogers Airport, 5900 Air Cargo Road, Oklahoma City, Oklahoma 73159.

VI. Roles and Responsibilities of Government Personnel
A. Contracting Officer: The Contracting Officer has the overall and primary responsibility for the administration of this contract. Only the Contracting Officer has authority to enter into, administer, or terminate this contract on behalf of the Government. This includes modifying and deviating from the contract terms, conditions, requirements, specifications, and delivery schedules; making final decisions involving such matters as invoice payments or other consideration due to the Government for nonperformance or unsatisfactory performance, interpreting the contract, and resolving disputes; and, terminating the contract for default or convenience. The Contracting Officer also has authority to delegate certain responsibilities to an authorized Government representative.
B. Contracting Officer’s Representative (COR): The Contracting Officer will appoint individuals to act as authorized representatives in the monitoring and administration of this contract. Deputy U.S. Marshals (DUSM)/Aviation Enforcement Officers (AEO) can be designated CORs by the Contracting Officer after an approved course of study. This individual is designated in writing as a (COR), with a copy to the Contractor. An individual designated as a COR is authorized to perform the following functions and those functions in accordance with COR appointment letter:
1. Coordinate the technical aspects of this contract and inspect all required services.
2. Certify, accept and reject invoices deemed improper for payment for the services and/or supplies rendered and allowed under the terms and conditions of this contract.

VII. Schedule
A. The work schedule will be contingent on mission requirements. The guaranteed minimum will be 96 hours per month. JPATS estimates the amount of time required would be two (2) days per week for two (2) hours to sixteen (16) hours per day. The Contractor will be required to provide the services Monday through Friday. JPATS will provide a schedule of the JPATS mission requirements to the Contractor identifying the following week’s mission requirements no later than close of business (COB) Friday. The Contractor shall be required to staff the JPATS mission requirements. JPATS schedules are subject to change on short notice; therefore, the Contractor is required to provide staff within two hours of notification of scheduled changes. The Contractor shall have the capability of providing services within two hours after notification, 24-hours a day, seven days per week, including holidays.
B. Due to scheduled and the potential for unexpected overnight missions, and unforeseen circumstances, it is recommended Paramedics report with appropriate medications, food, clothing, personal hygiene items / necessities, and any other essentials needed.
C. Mission reporting times will be provided by the site COR.

D. The Contractor shall schedule employees so as not to incur overtime to the maximum extent possible. Per FAR 22.103-1, overtime is defined as work in excess of forty hours per week by an individual.
VIII. Qualifications of In-flight Paramedics
A. General Qualification Requirements: The Contractor must provide medical personnel who meet the following minimum qualifications. In addition, each applicant must undergo and pass suitability and background investigation requirements as determined by the USMS.
a) Be a citizen of the United States of America.
b) Be at least 21 years of age. While there is no maximum age limit for medical positions, all applicants must be able to withstand the physical demands of the job and be capable of responding to emergency situations.
c) Be a high school graduate.
d) Be able to read, write, and speak the English language fluently.
e) Possess a valid state driver’s license from their state of residence and have a safe driving record for the past five years.
f) Must be free from conviction of a misdemeanor crime of moral turpitude or domestic violence in accordance with Title 18, Section 922(g)(9) of the United States Code. The term “convicted” is generally defined in the statute as excluding anyone whose conviction has been expunged, set aside, or pardoned.
g) Possess the ability to meet and deal tactfully with people.
h) Possess the ability to understand, explain, interpret, and apply rules, regulations, directives, and procedures.
i) Possess poise, self-confidence, and the ability to make sound decisions and react quickly under stressful conditions.
j) Possess the ability to prepare clear and concise computer generated reports.
k) Possess the ability to be extremely flexible and adapt to changing situations.
l) Possess the ability to accept and respond to instruction and direction.
m) Be physically able to perform the full range of medical duties without limitation as described in this Statement of Work (SOW).
n) Be physically able to maintain the rigors of performing Paramedic duties for an extended period of time.
o) Have no other health-related problems such as alcohol dependency, controlled substance abuse, illegal drug use, mental illness, or psychological disorders which impede their ability to perform the essential functions of the position.
B. Experience Requirements
a) Have at least three calendar years of verifiable experience as a certified Paramedic with the minimum qualifications as a paramedic or higher.

b) Maintenance of requisite certifications is the responsibility of the Contractor.
IX. Performance Requirements:
A. The Paramedic will:
1. Use the acceptable medical industry standards to manage each patient’s (prisoner) care while in the custody of JPATS and during the transition of custody to / from
JPATS.
2. Provide quality medical care to all age groups with the appropriate developmental stage consideration.
3. Administer medications, procedures and/or treatments in accordance with written medical orders and or verbal orders from appropriate medical direction.
4. In preparation for flight verify all required medications, equipment and supplies are available.
5. Maintain all required medical documentation.
6. Assume control of all medical records, medications and required medical equipment to and from appropriate authorities.
7. Provide communicable disease surveillance, immediately notify JPATS of any potential health threats / hazards to the safety and welfare of the crew and public at large.
8. Will coordinate their activities with the Aviation Enforcement Officer In Charge (AEOIC) in matters of custodial concern.
9. Will coordinate their activities with the U.S. Public Health Service (USPHS) Chief, Aeromedical Branch, the JPATS Medical Director, or the Medical Transport Coordinator in connection with medical fitness or suitability of inmates.
10. Review all prisoner medical records, ensures that each prisoner record contains a complete, current medical record. The standard is a completed USMS Form 553, Bureau Electronic Medical Record (BEMR) Bureau of Prisons Health Services Inmate Intra-system Transfer, or BOP Form BP-A0659, Medical Summary of Federal Prisoner/Alien in Transit which will be submitted to the Paramedic upon boarding the aircraft. Medical documentation submitted to the Paramedic is required to be properly completed and signed by appropriate medical personnel.
11. Screen all medical forms and examines other available information to ensure that prisoners are medically stable and appropriately fit to fly.
12. Respond to all medical emergencies (i.e. seizures, chest pain, mental disorder, etc.).
13. Administer prescribed prisoner medications as necessary.
14. Prepare the prisoners medications and medical documentation for delivery to the receiving official at the appropriate debarkation stop and is prepared to report on any specific incidents, during flight as appropriate.

16. Examine any prisoner after any “Use of Force” application, documents findings on USM 210 (Field Report) and provides signed copies to the AEOIC.
17. Prepare appropriate incident reports (USM 210) relating to medical issues with signed copies to the AEOIC and the Chief, Aeromedical Branch, Kansas City.
18. Assume responsibility as the primary medical provider of care for all prisoners with stable, unstable and complex medical conditions during JPATS flights.
19. Anticipate and acquire resources needed for routine and unexpected medical incidents, including medical emergencies during flight.
20. Provide health care services of a scope, quality and quantity consistent with established industry standards.
X. Performance Standards
A. Responsibility:
1. The Contractor must ensure all In-flight Paramedics maintain satisfactory standards of competency, conduct, appearance, and integrity and enforce appropriate disciplinary actions when necessary. The Contractor must also ensure that all Paramedics adhere to the performance standards described below. If any of the standards are violated, the Government may direct the Contractor to remove the individual from duty. The Contractor must initiate immediate action to replace the individual in the time frame required by this contract.
B. General Duties:
1. The Paramedic responds to all medical emergencies, maintains custody of medical records, medications, and related medical equipment of all prisoner(s) at all times.
The Paramedic will also maintain custody and control of USMS owned medical equipment (i.e. oxygen tanks, ZOLL Cardiac Monitors, AEDs, and other medical supplies) while in the performance of their contract duties.
2. The Paramedics shall comply with all special security instructions issued by the USMS (AEOIC) concerning any prisoner being transported. In the event of a physical disturbance, escape attempt or actual escape, the Paramedic must immediately notify the AEOIC of the JPATS mission.
3. In addition, the Paramedic will be required to meet requirements as set forth below at the request of the Contracting Officer or his/her designee:
a) Equipment
• Maintain daily inventory of medical equipment and supplies
• Maintain daily inventory of equipment assigned to specific aircraft (I.E.: cell phone, medical equipment and devices)
• Required to submit to the AEOIC an expenditure form for supplies utilized on the mission

• Comply with all USMS and JPATS policies and procedures to include both aviation and ground safety.
• Cooperate fully with federal, state and local investigators concerning criminal, civil, and safety related investigations.
c) Security
• Bring all security related question and concerns to the attention of the AEOIC and/or Team Lead.
d) Travel
• Be available and prepared for work on any assignment as needed and/or directed.
• At no time is the Paramedic authorized to carry or stow weapons of any kind on board any JPATS operated aircraft
e) Ethics - Adhere to United States Marshals Service (USMS) Directive 1.2E, Code of Professional Responsibility
C. Professional Responsibility: All Paramedics performing under this contract must comply with the following:
1. Be courteous and demonstrate good manners toward Government employees and the public.
2. Maintain a respectful and helpful attitude in all endeavors.
3. Maintain a neat, clean, and businesslike appearance and comply with uniform standards while on duty.
4. Report to work physically fit and mentally alert.
5. Report to their immediate supervisor any circumstances that may adversely affect performance on a particular assignment.
6. Report to their employer if they are detained or become aware that they are under investigation, by any federal, state or local agency, for any legal or ethical violation.
(The Contractor must immediately report the matter to the COR, and the JPATS Security Branch).
7. Not engage in any discussion concerning Government matters, policies, grievances, financial, personal or family matters with prisoners, witnesses, protected persons, family members, the public, or any known associate of the above. Not entertain, socialize, or enter into business arrangements with, give legal advice or grant special favors to, or accept gifts or payments from prisoners, witnesses, protected persons, or family members and friends of the above.
8. Not accept or solicit gifts, favors, or bribes in connection with official duties.
9. Not allow prisoners, aliens, witnesses, protected persons, or their family members and friends into their home or living quarters (temporary or permanent).

10. Not visit the duty site during non-duty hours or allow family members and friends to visit the duty site or other operational areas. An exception may be requested in writing from the COR.
11. Not gamble or enter into games of chance with prisoners, witnesses, or protected persons. Engaging and promoting gambling and unlawful betting on Government-owned or leased property is strictly prohibited.
12. Not disclose any official information (except to the COR, or other officials having a need to know) or make any news or press releases. All press inquiries must be brought to the attention of the COR. This restriction does not prohibit protected “whistle blowing” activities or protected union activities.
13. Refrain from discussions concerning duty assignment, particularly manpower, weapons, security precautions, or procedures, except with those persons having a need to know.
14. Comply with applicable federal, state and local laws while performing official duties.
15. Not knowingly give false or misleading statements or conceal material facts in connection with employment, promotion, travel voucher, any record, investigation, or other proper proceeding.
16. Not discriminate against or sexually harass members of the public, other employees or engage in any prohibited activities.
17. Ensure that financial obligations are met.
18. Abide by all ethical standards of the Department of Justice regarding conflict of interest, outside activities, gifts and use of federal property.
19. Refrain from any activity that would adversely affect the reputation of the Department of Justice, the USMS or JPATS.
20. Avoid personal and business associations with persons known to be convicted felons or persons known to be connected with criminal activities. This restriction does not pertain to immediate family members.
21. Refrain from criminal, infamous, dishonest, immoral, or notoriously disgraceful conduct and habitual use of intoxicants or prescription/nonprescription drugs.
Except in an official capacity, refrain from possessing or using illegal drugs.
22. Do not report for duty or work under any condition that impairs the ability to perform as expected.
23. Always demonstrate the highest standards of personal and moral conduct normally expected of law enforcement officers.
24. Not operate a Government vehicle or any other vehicle while on Government business in an improper manner or under the influence of intoxicants or drugs.
25. Not misuse official authority, identification, or equipment.
26. Not make statements about fellow employees or officials, with knowledge of the falseness of the statement or with reckless disregard of the truth.

27. Report violations of prescribed rules, regulations and any violations of statute or law to the appropriate supervisor and/or management officials.
28. Not violate security procedures or regulations.
29. Always perform assignments in accordance with prescribed regulations to the best of one's ability and in accordance with safe and secure working procedures and practices.
30. Do not fail, unnecessarily delay, or refuse to carry out a proper order of a supervisor or other official having responsibility for your work.
31. Do not possess, use, lose, damage, or otherwise take Government property, including confiscated or abandoned property, without authorization of the COR.
32. Employ no technique that violates the law, such as unauthorized intrusion onto private property, unnecessary destruction of property, unauthorized listening and/or recording devices, or any other activities prohibited by law or regulation.
33. Refrain from surreptitiously recording conversations between Government, law enforcement or Contractor employees.
