Regarding reimbursable Other Direct Costs (ODCs) for judicial foreclosure proceedings, please indicate if the following costs will be considered reimbursable as ODCs, for they are not in the detailed list of ODCs mentioned in the RFP, subjection J.2.
1. Costs for the posting of the Notice of Sale
1. Postage costs for certified mail when notification via certified mail is required by law as part of due process proceeding
1. Special Master costs for public sale proceeding. Note: The use of the Special Master in judicial sales proceedings is not required by law, yet it is beneficial for the agency because the Special Master can oversee the public sale much earlier than the court Marshall usually can. This can result in the resolution of a matter months earlier than if the Marshall oversees the public sale. Besides, the U.S. Marshall also charges for the services of handling public sale proceedings.
1. Cost for Registry Certification (“Certificación Registral”) to certify who holds title of a loan collateral and/or to certify the status of a lien(s)
1. Costs of certified copies whenever a certified copy is required to be obtained as per order of the court or when required by law or regulations
1. Costs of obtaining documents from the Demographic Registry/Bureau of Vital Statistics
1. Toll expenses, when travel is required
Keep in mind that the above list of costs are common to judicial foreclosure proceedings, yet they may vary significantly from one case to another depending on factors such as the number of defendants in the case, and the number of collaterals offered as loan security. Hence, it is impossible to estimate the foreseeable costs in those areas.
These costs may be reimbursed under CLIN 0002AD provided the Contractor submits proof of costs incurred for each ODCs. As it relates to toll expenses, when travel is required, the Department intends to reimburse travel greater than 50 miles for activities within a widely dispersed geographical district provided the Contractor is traveling to and from the activity from the Contractor’s place of business and submits proof of costs incurred.
Regarding the contract pricing table, please advise how the agency will compensate the task of all the work related to the Deed of Judicial Sale, and for the cancellation of junior liens. That includes the drafting and perfection of said deed. The deed must be prepared by a legal counsel. It is necessary for the transfer of title to the agency (free and clear of liens) when the agency is the successful bidder.
Your proposed flat fee for handling foreclosures (CLIN 0002AA) must include these tasks. Any extraordinary tasks may be reimbursed provided the Contractor obtains written approval prior to incurring the costs.
Regarding Other Direct Costs (ODCs) for bankruptcy proceedings, under subsection J.2, please indicate if the following costs (that are common to bankruptcy proceedings) would be considered reimbursable ODCs
a. Title searches
b. Cost for Registry Certification (“Certificación Registral”) to certify title and/or certify the status of a lien(s). Note: In most cases, the title search is enough, yet sometimes a Registry Certification is necessary
c. Appraisal costs. Note: Appraisals are not required in all cases, yet they are sometimes necessary when there is a dispute as to the amount of the secured value of the loan collateral
d. Toll expenses, when travel is required
These costs may be reimbursed under CLIN 0003AB provided the Contractor submits proof of costs incurred for each ODCs. As it relates to toll expenses, when travel is required, the Department intends to reimburse travel greater than 50 miles for activities within a widely dispersed geographical district provided the Contractor is traveling to and from the activity from the Contractor’s place of business and submits proof of costs incurred.
