About this file

This is a Questions and Answers document for solicitation 15BBR026Q00000034, an interior repairs project for the sallyport on the 1st and 3rd floors at the Metropolitan Detention Center (MDC) Brooklyn. The work involves tile removal, concrete preparation, resinous flooring installation, and cove work. The Davis-Bacon Act applies under WD # NY2026003 with the classification of laborer/cement concrete worker. Work must be performed during night hours from 8:00 PM to 6:00 AM when facility traffic is minimal, with any alternative work hours requiring written COR approval five working days in advance.

The contractor must complete the project in two phases with only half of each lobby floor closed at a time, with epoxy materials scheduled for Friday nights to minimize weekend traffic disruption. No asbestos tiles are anticipated as the facility was constructed in 2000. Surface preparation and crack repair are required per the Statement of Work but no specific footage allowance is stipulated. The government will provide 220-volt power on both floors. A bid bond equal to at least 20 percent of the bid price (not exceeding $3 million) is required, along with performance and payment bonds covering the full contract amount. Construction contracts require specific insurance policies per FAR Part 52.228-5 and FAR Subpart 28.3. The anticipated Notice to Proceed is September 15, 2026, with a 45-day window for government acceptance of bids. The contractor may propose faster-curing decorative flake broadcast flooring systems as alternatives to the specified metallic system.

SOLICITATION NO. 15BBR026Q00000034

INTERIOR REPAIRS SALLYPORT 1st & 3rd FLOORS

MDC BROOKLYN

QUESTIONS AND RESPONSES

1. Davis-Bacon / Trade Classification- Could you please confirm the applicable Davis-Bacon trade classification for this project, as well as the required base wage and fringe benefit rate? I want to make sure we are using the correct classification and rates for the tile removal, concrete preparation, resinous flooring, and cove work.

Under the DBA WD # NY2026003, the correct classification for this project is laborer/cement concrete worker.

2. Flooring System- As we discussed during the walkthrough, because the work needs to be performed at night while there is still traffic through the hallways, we believe a faster-curing decorative flake broadcast system would be more practical than the specified metallic system. I am attaching some pictures of the flake option we are considering. Could you please confirm whether this system would be acceptable as an alternate to the specified metallic flooring system? If not, I can try offering you a few other decorative fast cure options.

The Bureau is not against other options as it relates to the metallic color and using a faster-curing time such as the flake broadcast.

3. Insurance Requirements- Could you please provide the specific insurance requirements and coverage limits required for this project? In particular, I would like to confirm the required general liability, workers’ compensation, auto liability, umbrella/excess liability, and any other required coverage or endorsements.

Construction contracts require specific, non-negotiable insurance policies. Please refer to FAR Part 52.228-5 and FAR Subpart 28.3.

4. Bonding Requirements- Please also confirm the bonding requirements, including the required bid bond amount and any performance and payment bonds that will be required if awarded. Also, please confirm that we will have access to 220 volt power for our equipment on each floor.

The penal sum of the bid bond should be at least 20% of the bid price, not to exceed 3 million.

However, performance and payment bonds shall cover the full amount of the contract. Yes, we will provide 220 volts for the 1st and 3rd floors.

5. Please confirm the permitted work hours for this project, including the allowable start and end times for construction activities.

As per page # 6, 2.3.1, Work Hours for the contractor are 8:00 PM – 6:00 AM, as this is the time when the areas are less used. Any work required to be completed at any other time than noted above must be requested in writing to the COR five (5) working days prior to the start of the work. In the event of any equipment being replaced that would result in downtime of the normal orderly running of the institution, alternate work hours may be authorized in accordance with the time frame stated above.

6. Please confirm whether asbestos materials are anticipated to be encountered during construction and if so, whether an asbestos survey or abatement is required prior to commencement of work.

MDC Brooklyn was built and opened in 2000. To the best of the Bureau's knowledge there are no asbestos tiles.

7. Please confirm that the 1st and 3rd lobby floors are to be completed in two phases, with only one-half of the area closed and worked on at a time. Also, clarify whether each half may remain closed to traffic for more than 48 hours to allow sufficient curing time for the epoxy flooring.

8. The laying of the actual epoxy materials should be scheduled for Friday nights as the traffic over the weekend in the area is less. The areas will need to be completed in sections to allow access to the areas on the floor.

9. Please confirm that the contractor is to include an allowance of 50 LF of concrete floor crack repair in the base bid.

The SOW requires the contractor to perform surface preparation and to repair cracks, spalls, and defects as identified during that process using compatible repair materials; however, no footage or estimated quantity is provided within the solicitation.

10. What is the anticipated NTP date for this project?

We are hoping to issue an NTP by September 15, 2026.

11. Section 13(d) of SF 1442 form appears to have been left blank. We respectfully request that the Government confirm the minimum number of calendar days bidders must allow for Government acceptance of their offers.

45 Days

12. Please confirm whether a bid bond is required for this proposal.

Yes, a Bid Bond is required.

13. Please provide a copy of the site visit sign-in sheet for our records.

The sign-in sheet and site visit meeting minutes are attached to the solicitation.
