About this file
This document is a Certification Relating to the Hardening of State Government, specifically tied to Executive Order GA-48, involving a college and potential respondents. The certification requires respondents to confirm they are not listed on certain national defense authorization act sections, are not owned by governments on the U.S. Department of Commerce's foreign adversaries list, and are not controlled by regulatory bodies from countries on that list. The document provides a binary choice for respondents to either agree or disagree with these stipulations, with space for signature, printed name, title, and date.
The certification is designed to prevent the college from entering into new contracts, contract extensions, or renewals with companies that meet the specified criteria, effectively creating a screening mechanism for potential vendors or service providers. The document references specific legal sections including Section 889 of the 2019 National Defense Authorization Act and Section 1260H of the 2021 National Defense Authorization Act, as well as 15 C.F.R. Section 791.4, which outlines the U.S. Department of Commerce's foreign adversaries list. Respondents must carefully review and attest to their compliance with these requirements before signing.
