1. Standard Form 1442, Block 13, Line a: Extend the proposal submission date by 7 days to 1530 on 03/04/2024.

2. In Part I – Section C, Division 02, remove Section 02 83 30 in its entirety and replace it with Revised Section 02 83 30. The specific change is: Section 02 83 30, Paragraph 1.07A3 “Current certification by KDHE as a Lead Activity Firm” has been deleted from the specifications.

For convenience, essential changes on the revised solicitation page are indicated by a vertical line within the margin, whereby the lines or paragraphs are changed from the previous version.

SECTION 02 83 30

REMOVAL AND DISPOSAL OF COATINGS CONTAINING REGULATED METALS

PART 1 GENERAL

1.01 MEASUREMENT AND PAYMENT

A. Removal and Disposal of Coatings Containing Regulated Metals:

1. Payment: Lump-sum price offered in the Price Schedule.

2. Include in price offered in the Price Schedule the following items requiring removal of coatings containing regulated metals (refer to Section 09 96 20 – Coatings, Section 51 02 83 – Existing Coatings Analysis, and Section 52 00 00 – Drawings for details):

a. Spot repairs on the exterior surfaces of each of the radial gate hoist assemblies located on the hoist deck, as well as the floatwell cover frames, weirwell cover frames, and pier platform frames.

b. Full recoat of the wire rope clamps and sockets, sheave assemblies, floatwell and weirwell covers, and platforms for each of the radial gates.

3. Include the prices for On-site Certified Industrial Hygienist (CIH) oversight and laboratory costs.

4. On-site CIH oversight costs for coatings application shall be included in Section 09 96 20 – Coatings.

5. Include the cost of characterizing, handling, and disposing of nonhazardous waste. For cost estimating purposes, the Contractor may assume that some waste streams may be rendered nonhazardous (e.g. by dilution with abrasive media) during the removal process. Refer to Articles 1.11 and 3.05 of this Section for further details.

1.02 DEFINITIONS AND ABBREVIATIONS

A. ABIH: American Board of Industrial Hygiene.

B. ACGIH: American Conference of Governmental Industrial Hygienists.

C. AIHA: American Industrial Hygiene Association.

D. Background Monitoring and Sampling:

1. Sampling conducted in and around regulated areas prior to commencing on-site work, and outside of regulated areas during on-site work.

2. Used as a baseline for other sampling.

E. CIH: Certified Industrial Hygienist.

F. Clearance Sampling:

1. Sampling conducted in and around regulated areas prior to relocation or removal of the containment system, or after a potentially uncontrolled release.

2. Compared with background samples or other baselines to confirm clearance for continued work.

G. Coatings containing regulated metals:

1. Coatings which could generate the release of airborne contaminants during removal, in concentrations which exceed the OSHA PEL or the ACGIH TLV for regulated metals.

2. Coatings which, upon removal, generate solid waste that could be found toxic when tested in accordance with EPA Test Method 1311.

H. Competent Person:

1. As defined in 29 CFR 1926.32(f).

2. Capable of identifying existing and predictable hazards in connection with the removal and disposal of coatings containing regulated metals.

3. Has authorization to take prompt corrective measures to eliminate hazards.

4. Experienced in administration and supervision under OSHA and EPA regulations.

5. Familiar with the applicable standards and regulations listed in Article 1.06 of this

Section.

J. Hazardous waste: As defined in 40 CFR 261.3.

K. HEPA: High Efficiency Particulate Absolute filtration efficiency of 99.97% at 0.3 microns.

1.05 PROJECT CONDITIONS

A. Existing coatings contain regulated metals. Refer to Section 51 02 83 – Existing Coatings Analysis and Section 52 00 00 – Drawings for details.

B. Work will be conducted in areas where drainage enters a waterway. Release of contaminants into this waterway is prohibited.

C. The remote location of the work site requires additional planning for outside emergency assistance and timely laboratory support.

D. Work activities will require controlling the temperature and humidity inside the containments to account for changing weather conditions. Refer to Section 09 96 20 – Coatings.

E. The Contractor will be considered the co-generator of any hazardous waste, in accordance with KAR 28-31-262 and 40 CFR 260.10. The Contractor will need to obtain an EPA Identification Number per KAR 28-31-4 and 40 CFR 262.18.

1.06 STANDARDS AND REGULATORY REQUIREMENTS

1.08 AUTHORITIES, DUTIES, AND RESPONSIBILITIES

A. Coatings Removal Project Designer:

1. Review and sign the Coatings Removal Plans.

2. On jobsite during all coating removal activities. Available for emergencies.

3. Control entry to and from any regulated area.

4. Ensure that employees wear appropriate PPE, are trained in the use of appropriate methods for exposure control, use proper hygiene methods and decontamination procedures.

5. Ensure that engineering controls in use are in proper operating condition and are functioning properly.

6. Responsible for compliance with applicable Federal, State of Kansas, and local requirements; and the approved Coatings Removal Plans.

1.09 COATINGS REMOVAL PLANS

A. Submit plans, for approval, which detail the engineering controls, administrative controls, and procedures to be implemented during coating removal operations. The plans shall be:

1. Prepared and signed by the Coatings Removal Project Designer.

2. Reviewed and signed by the On-site CIH and Coatings Removal Supervisor.

B. Containment System Plan:

1. Detailed plan to prevent the release of coatings, metals, and dusts into the environment during the disturbance, removal, and reapplication of coatings in accordance with Article 3.02 and the applicable regulations and standards listed in Article 1.06 of this Section.

2. Include (but do not limit to) the following information:

a. Coatings removal methods to be conducted within each containment (refer to Section 09 96 20 – Coatings).

b. Detailed project drawings and descriptions of the proposed containment structure, device, or method of containment, showing the SSPC Containment System Class (see Table 02 83 30A – Containment Criteria for Removal of Paint Containing Regulated Metals, below), general layout, attachment to the structure, and relationship to the structure.

c. Details and locations of decontamination units, temporary storage facilities, and boundaries of each regulated area.

d. Load analysis for the containment system on the structure, including wind loads and dead load from debris.

e. Performance criteria for the containment. Emission of dusts, metals, toxic vapors, or gases into the surrounding environment is prohibited.

f. Inspection criteria for the containment system.

g. Specifications on sheet plastic, prefabricated decontamination units, and other materials or equipment specific to containment. Include (but do not limit to) manufacturer/supplier contact information, model, capacity, performance characteristics, safety data sheets, etc.

C. Ventilation Plan:

Detailed plan to ventilate, maintain negative pressure, and monitor pressure within the containment system; and to filter exhaust from the containment system during the disturbance, removal and reapplication of coatings in accordance with Article 3.02 and the applicable regulations and standards listed in Article 1.06 of this Section.

2. Include (but do not limit to) the following information:

a. Detailed project drawings and descriptions of the proposed ventilation equipment that will be used (see Table 02 83 30A – Containment Criteria for Removal of Paint Containing Regulated Metals, below), as well as any temporary utilities. Include performance criteria and specifications for equipment.

b. Plan for maintaining negative pressure and monitoring pressure.

c. Detailed description and calibration data for instrumentation that will be used to test ventilation system performance.

d. Testing procedures.

a. Specifications for the filtration system. Emission of dusts or vapors into the facility is prohibited. Dust collection system shall filter exhaust air to HEPA efficiency.

b. Detailed system performance calculations for air flow, air changes in the containment, velocity, and static pressures in ducting, and fan performance.

c. Specifications on ventilation units, HEPA filters, and other applicable materials or equipment. Include (but do not limit to) manufacturer/supplier contact information, model, capacity, performance characteristics, safety data sheets, etc.

D. Worker Protection Compliance Program:

1. Detailed plan to protect workers from and monitor worker exposure to regulated metals in accordance with the approved Safety Plan (refer to Section 01 35 20 – Safety and Health), Articles 3.03 and 3.04 of this Section, and the applicable regulations and standards listed in Article 1.06.

2. Include (but do not limit to) the following information:

a. Procedures, equipment, and training of workers on hazards involved with handling and disposing of regulated metals.

b. Plan for monitoring worker exposure to airborne contaminants using personal and area air monitors.

c. Plans for decontamination procedures, equipment, and facilities to be used during coating removal activities.

d. Specifications on respirators, personal air monitors, PPE, protective clothing, and other applicable materials or equipment, including (but not limited to) manufacturer/supplier contact information, model, capacity, performance characteristics, safety data sheets, etc.

4. In lieu of including medical surveillance program details, provide certification, signed by a licensed physician, that the workers are being tested as part of a medical surveillance program in accordance with 29 CFR 1926.62(j).

a. Blood level testing shall include lead and zinc protoporphyrin (ZPP) tests, as well as monitoring for the other regulated metals present in the existing coatings.

b. Do not include personally identifiable information (PII) or medical information protected under the Health Insurance Portability and Accountability Act (HIPAA).

E. Emissions Monitoring Plan:

1. Detailed plan to monitor emissions of regulated metals in accordance with Article

3.04 of this Section, and the applicable regulations and standards listed in Article 1.06.

1. Detailed plan to properly characterize, handle, and dispose of all waste generated from coatings removal operations in accordance with Article 3.05 of this Section and the applicable regulations and standards listed in Article 1.06.

2. Include (but do not limit to) the following information:

a. Estimated quantity and planned disposal location for each type of waste to be generated.

b. Plan for the sampling, testing, and characterization of waste:

1) Include sample collection and analytical test methods that will be used to characterize the waste.

2) Include the required method detection limits.

3) Describe the analytical data delivery package including quality control and quality assurance.

c. Plan for the handling, storage, transportation, and disposal of waste from coating removal operations, and the cleaning of reusable items.

d. Plan for the disposal of wastewater (see Section 01 57 00 – Water

Pollution Control).

e. Name, contact person, address and telephone number of proposed independent testing laboratory, transporter, disposal facility, and wastewater treatment facility.

f. Written notice from owner or operator of disposal facility documenting permits and agreement to accept hazardous waste generated under this contract.

g. Specifications on storage and disposal containers and other applicable materials or equipment. Include (but do not limit to) manufacturer/ supplier contact information, model, capacity, performance characteristics, safety data sheets, etc.

G. Contamination Contingency Plan:

1. Detailed contingency plan to handle a confirmed contamination over reportable quantities due to a breach in containment or storage, in accordance with Article

3.06 and the applicable regulations and standards listed in Article 1.06 of this Section.

2. Include (but do not limit to) the following information:

a. Plan for monitoring and reporting reportable releases. Include personnel to contact, telephone numbers, email addresses, time frames for contacting, and methods of contact.

b. Plan for decontamination of contaminated areas and surfaces.

1.10 LABORATORY TEST RESULTS

A. Submit exposure, emissions, and waste characterization test results for all monitoring and sampling conducted during coating removal operations. All test result submittals shall be:

1. Provided by an approved independent testing laboratory.

2. Reviewed, signed, and prepared for submittal by the On-site CIH.

3. Reviewed and signed by the Coatings Removal Supervisor.

B. Except for waste characterization samples, include a map indicating the location of each sample.

C. Provide appropriate quality control information to supplement analytical data. Include from blanks, laboratory control samples with percent recovery, duplicates, matrix spike samples with percent recovery, and other appropriate quality control measures.

D. Refer to Articles 3.04 and 3.05 of this Section for more details.

1.11 DISPOSING HAZARDOUS WASTE

A. The following applies if a waste stream containing regulated metals tests as hazardous waste (these provisions would be a modification to this specification):

1. Assemble a written plan to submit to the Reclamation CO for additional funds upon acceptance.

2. Obtain EPA Identification number (if not already obtained) before treating, storing, or transporting hazardous waste.

3. Handle and dispose of hazardous waste in accordance with Article 3.05 and the applicable regulations and standards in Article 1.06 of this Section.

PART 3 EXECUTION

3.01 COATINGS REMOVAL

A. Refer to Section 09 96 20 – Coatings for removal methods to be used.

B. Handle and dispose of coatings containing regulated metals in accordance with applicable Federal, State, and local regulations as well as the approved Coatings Removal Debris Abatement Plans.

3.02 CONTAINMENT AND VENTILATION

A. The containment and ventilation systems shall control emissions to the environment in conformance with applicable Federal, State, and local regulations and the following criteria:

1. Comply with the approved Containment System and Ventilation Plans during coating removal and coating application.

2. Do not exceed ambient air quality standards.

3. Prevent contamination of any reservoir, watercourse, or water system.

4. Prevent any contamination of sediment in any reservoir or watercourse.

5. Prevent any contamination of soil.

6. Suitable for surface preparation methods specified in Section 09 96 20 – Coatings.

7. Containment and ventilation components in accordance with SSPC Guide 6, as summarized in Table 02 83 30A – Containment Criteria for Removal of Paint Containing Regulated Metals, as well as the other standards and regulations listed in Article 1.06 of this Section.

8. Ventilate within the containment and filter exhaust air to HEPA efficiency.

9. Maintain and monitor negative pressure within the containment.

a. Record and submit pressure differential measurements in conjunction with personal air monitor sampling (refer to Article 3.02 of this Section).

b. Additional recordings may be taken at the discretion of the On-site CIH.

c. If pressure differential results fall below the minimum allowable pressure difference, stop work until appropriate corrective measures are taken, and perform additional monitoring as necessary until the required standards are met.

B. Perform the following activities within the containment system:

1. Coating removal.

2. Surface preparation.

3. Waste and debris containerization.

4. Activities which may spread contamination outside the Regulated Area.

5. Application, touch-up, and repair of new coatings (see Section 09 96 20 –

Coatings).

C. Provide signs and barriers at each point of entry to containment area to prevent unauthorized personnel access.

3.03 WORKER PROTECTION

A. Limit employee exposure to airborne contaminants in accordance with the applicable standards and regulations listed in Article 1.06 of this Section, and the approved Worker Protection Compliance Program.

3.04 EMISSIONS AND EXPOSURE MONITORING

A. General:

1. Sampling protocol shall be in accordance with the applicable standards listed in

Article 1.06 of this Section, as well as the approved Worker Protection Compliance Program and Emissions and Exposure Monitoring Plan.

2. All samples shall be analyzed by an approved independent testing laboratory.

Test results shall be reviewed for compliance by the On-site CIH and submitted.

3. Sampling and testing techniques shall conform to industry-standards and regulations, and shall be approved by Reclamation prior to the commencement of on-site work.

B. Preconstruction, Clearance, and Post-Construction Sampling:

1. Collect surface and high-volume air samples in and around all regulated areas and analyze samples for regulated metals.

2. Collect water samples in a transect across the spillway stilling basin, and analyze samples for regulated metals.

3. Clearance and post-construction levels shall meet the following requirements:

a. High-Volume Air Samples: At or below preconstruction levels.

b. Surface Samples: At or below 200 μg/ft2 (measured as an average concentration of all metals present in preconstruction samples, in micrograms per square foot of surface area sampled)

c. Water Samples: At or below preconstruction levels.

C. Working Level Monitoring:

1. Initial Exposure Assessment: At the commencement of coatings removal operations, the On-site CIH shall conduct and submit an initial exposure assessment for regulated metals in accordance with 29 CFR 1926.62(d).

2. Periodic Monitoring: Whether or not a Negative Exposure Assessment (NEA) has been made by the On-site CIH, the Contractor shall conduct periodic monitoring for regulated metals in accordance with 29 CFR 1926.62(d).

3. Collect and submit emissions samples in conjunction with personal air monitor sampling.

4. Do not exceed the emissions or exposure limits referenced in Article 1.06 of this Section.

5. If sample results exceed the specified emission or exposure limits, stop work until appropriate corrective measures are taken, and perform additional monitoring as necessary until the required standards are met.

6. Perform additional monitoring if there has been a change of equipment, process, control, or personnel, or a new task has been initiated that may result in emissions or exposures above the specified limits.

3.05 WASTE CHARACTERIZATION, HANDLING, AND DISPOSAL

A. Characterize, handle, transport, and dispose of solid waste debris generated from removal operations in accordance with the regulations and standards listed in Article 1.06 of this Section; the approved Waste Characterization, Handling, and Disposal Plan; and Section 01 74 00 – Cleaning and Waste Management.

1. Presume waste is hazardous until characterized.

a. The assumption that a particular waste stream will be nonhazardous for cost estimating purposes shall not relieve the Contractor of the responsibility to verify this through testing.

2. Transport waste in secured sealed labeled containers in such a manner to prevent leakage during transport to disposal site.

3. Reclamation reserves the authority to observe the sampling, transportation, and disposal of all components of the waste stream.

B. Nonhazardous Waste:

1. Store, transport, and dispose of nonhazardous waste debris in accordance with

Federal, State, and local requirements. In case of conflict, the most stringent regulation shall apply.

2. Store nonhazardous coating debris in closed containers separate from hazardous waste storage areas.

3. Obtain and submit bills of lading from solid waste transporter and solid waste disposal facility.

C. Hazardous Waste:

1. Seal, label, and store hazardous coating debris in DOT-approved weatherproof, watertight steel containers (refer to HW 2005 G1 for details).

2. Do not co-mix different types of hazardous and non-hazardous waste materials.

3. Dispose of all hazardous waste at EPA-permitted RCRA Subtitle C TSD facility.
