Green Mountain Penstock Amendment 0003 Questions and Answers

25. Was the previous contract cancelled due wholly or in part to any means and methods that were proposed by the contractor or any of its subcontractors to accomplish any of the contract work? This is very relevant information that should be shared with all prospective bidders and their prospective subcontractors. If it was determined after award of the previous contract that using any means and methods to accomplish the work would not be acceptable to the government, the parties involved will have superior knowledge to all other bidders and will have a substantial competitive advantage over any contractor that submits a proposal without that information. We contend that all prospective bidders should be made aware of any proposed means and methods that had any bearing on the government’s decision to cancel the previous contract prior to drafting their technical proposals for consideration.

A: No. The previous contract was cancelled for the convenience of the Government due to significant technical changes prior to contractor mobilization.

26. Is the previous contractor or any of its subcontractors in possession of any engineered systems, equipment, materials or supplies that were paid for by the government on the previous contract that was cancelled? Specifically, who is in possession of the walkways, ladders and stairways that were fabricated, delivered and paid for by the government on the last contract?
