Amendment 0002 Information Page Solicitation No. 140R4021Q0036
AIS Inspection and Decontamination Services IDIQ
THE PURPOSE OF THIS AMENDMENT IS TO PUBLISH THE QUESTIONS AND
ANSWERS FROM VENDORS:
1. Will BOR extend the due date for responses?
Response: BOR will extend the date for responses to 8/30/2021
2. How many awards does BOR expect to make for this IDIQ? Is there a limit?
Response: BOR anticipate making 3 awards
3. For the last solicitation, in 2016, Solicitation # R16PS00492, we noted that the acquisition was “Unrestricted.” However, for this solicitation, which is for the same services, there is a 100% small business set aside with a maximum size of $16.5m annual revenues. Why has BOR made this change from the previous solicitation to this one?
Response: Each acquisition/procurement is separate, determination was made based on the small business determination at the agency level.
4. Will BOR please explain the NAICS codes restrictions for this solicitation? What happens if an entity without the proper NAICS codes submits a response?
Response: NAICS code was determined based on the type of work to be performed. If entity without the proper NAICS code submit a response, they will be determined responsive based on the size standard in number of dollars or in number of employees as stated by Small Business Administration (SBA).
5. What happens if an entity who has the proper NAICS codes registered, but who also exceeds the $16.5m annual revenue limit, responds to this solicitation? Is that entity automatically disqualified? What happens in this case if they are the ONLY entity who responds to this solicitation?
Response: Entity who has the proper NAICS code but exceeds the annual revenue limit will be determined non-responsive. This solicitation is advertised as 100% small business based on the NAICS code, if only one vendor responds and exceeds the annual revenue limit, they will be determined non-responsive to the solicitation.
6. Why is there a small business set-aside for this solicitation? Does BOR believe that a small business would be able to better perform the work given under each task order?
Response: Based on market research, BOR made the determination that small business will be able to perform the contract. Determination was made based on the small business determination at the agency level.
7. What are the restrictions in terms of timing for the formation of a new entity in order to qualify to bid on this solicitation?
Response: Quotes have to be submitted on or before the due date in order to be determined responsive. All vendors must be registered and current with SAM.GOV at the time of quote submission.
8. Did BOR intend to exclude any company from this competitive process? Please provide an explanation as to why there is a new 100% small business set-aside that was not included in the previous solicitation.
Response: Each solicitation is a stand-alone procurement. 100% small business set-aside was determined at the agency’s small business determination level.
9. Does the small business size standard apply to a parent company or just the subsidiary?
Response: In accordance with SBA requirements, "You must include the employees or receipts of all affiliates when determining the size of a business. Affiliation with another business is based on the power of control, whether exercised or not. The power to control exists when an external party has 50% or more ownership. It may also exist with considerably less than 50% ownership by contractual arrangement or when one or more parties own a large share compared to other parties."
In short, yes. A subsidiary must include its parent in the size standard determination.
