Performance Location: Work is located approximately 46 miles northeast of Reno, Nevada, in Washoe County.
Brief Description of Work:
1. Install cofferdam upstream of gates to be recoated.
2. Remove and dispose of sediment and control water leakage into cofferdam during construction.
a. Sediment removed may contain hazardous substances.
b. Sample and analyze removed sediment prior to disposal.
3. Replace seals.
4. Remove and replace metalwork.
5. Blast and recoat gates and metalwork with vinyl coating system.
6. Furnish and install cathodic protection for gates.

Pre-Bid Site Visit:
An organized site visit has been scheduled for August 5, 2020 at 11:00a.m.. Interested bidders shall make arrangements to attend the site visit by contacting Todd Dooley at 916-537-7313 or via e-mail tdooley@usbr.gov. Section L FAR Part 52.236-27 Site Visit Alt I (Feb 1995) contains detailed information on the site visit.
Prospective bidders are strongly encouraged to attend the pre-bid site visit to gain a better understanding of the work requirements and site conditions.
This is not an active construction site. Hard hats and steel toe boots are not required.
Attendees do need to wear long pants, closed toe shoes, and safety vests.
Any questions asked at the site visit must be submitted in writing. Questions must be submitted, to the solicitation point of contact, within a reasonable time to allow for a reply prior to the bid due date. Section l FAR Part 52.214-6 Explanation to Prospective Bidders (Apr 1984) specifies oral explanations or instructions given before the award of Contract will not be binding.
Responses to questions will be issued as an amendment of the IFB. Amendments must be acknowledged on the SF1442, Block 19 or by one of the methods identified on the SF30, Block
11. Failure to do so will disqualify the bid.
This project requires compliance with the latest edition of the Reclamation Safety and Health Standards (RSHS). Section I, WBR 1452.223-81 Safety and Health – Bureau of Reclamation (Jun 2015). http://www.usbr.gov/ssle/safety/RSHS/rshs.html. A review of this guidance is recommended prior to the site visit.
Submitting Bid:
Bids are due on the date and time specified on the SF1442, Solicitation, Offer, and Award, Block 13 to the address identified in Block 8. Include the Solicitation Number, point of contact name, and date and hour of the bid opening on the outside of the sealed bid.
If the IFB requires a bid on all items listed in the Price Schedule in Section B, a failure to do so will disqualify the bid.
Any bid, modification, or withdrawal received at the Government office designated in the IFB after the exact time specified for receipt of bids is “late” and will not be considered unless there is acceptable evidence to establish that it was received at the Government installation designated for receipt of bids and was under the Government’s control prior to the time set for receipt of bids. FAR Part 52.214-7 Late Submissions, Modifications, and Withdrawals of Bids (Nov 1999) contains additional information on late bids.

Bids submitted by mail should be sent allowing a reasonable delivery time. Mail distribution to the point of contact is often later than receipt of mail in the mailroom due to size of our facility.
The mailroom does date/time stamp mail upon receipt. Bids received date/time stamped before the bid opening will be considered.
Bids submitted in person or individuals attending the bid opening should arrive allowing adequate time to find a parking spot in the Federal Buildings large parking lot and be prepared for security screening.
All individuals attending the bid opening should report to the main entrance of the California Great Basin Regional Office located at 2800 Cottage Way Sacramento, California 95825. The bid opening will be held outside the cafeteria in the seating area.

g. Information on vegetative practices, structural control, silt fences, straw dikes, sediment and operator controls, stormwater controls, and solid waste controls. Address stormwater controls for appropriate stormwater management measures including velocity dissipators. Address solid waste controls for building materials and offsite tracking of sediment.
C. RSN 01 57 30-2, Spill Prevention, Control, and Countermeasure (SPCC) Plan:
1. Submit when SPCC Plan is required in accordance with 40 CFR, Part 112.
a. SPCC Plan is required where release of oil and oil products could reasonably be expected to enter into or upon navigable waters of the United States or adjoining shorelines in quantities that may be harmful (40 CFR, Part 110), and aggregate on site oil storage capacity is over 1,320 gallons. Only containers with capacity of 55 gallons and greater are included in determining on site aggregate storage capacity.
2. Reviewed and certified by a registered professional engineer in accordance with 40 CFR, Part 112, as required by section 311 of the Clean Water Act (Public Law 92-500 as amended).
D. RSN 01 57 30-3, Permit Monitoring Results.
1.04 REGULATORY REQUIREMENTS
A. Construction Safety Standards: Comply with sanitation and potable water requirements of section 7 of RSHS.

B. Laws, Regulations, and Permits:
1. Perform construction operations to comply, and ensure subcontractors comply, with:
a. Applicable Federal, State, Tribal, and local laws, orders, regulations, and water quality standards concerning control and abatement of water pollution; and terms and conditions of applicable permits issued by permit issuing authority.
b. If conflict occurs between Federal, State, Tribal, and local laws, regulations, and requirements; Tribal have jurisdiction to the part as follows:
1) If conflict occurs between Federal, State, Tribal, and local laws, regulations, and requirements, the most stringent having jurisdiction shall apply.
C. Contractor Violations:
1. If noncompliance should occur, immediately (verbally) report noncompliance to the CO. Submit specific written information within 2 days.
2. Violation of applicable Federal, State, or local laws, orders, regulations, or water quality standards may result in the CO stopping site activity until compliance is ensured.
3. The Contractor shall not be entitled to extension of time, claim for damage, or additional compensation by reason of such a work stoppage.
4. Corrective measures required to bring activities into compliance shall be at the Contractor's expense.
1.05 REQUIRED PERMITS
A. Wastewater Discharge:
1. Application: If a point source (pipe, ditch, channel) discharge of pollutants
(wastewater or stormwater) into waters of the United States is anticipated by the Contractor, apply and submit any required fees for a National Pollutant Discharge Elimination System (NPDES) permit as required under section 402 of the Clean Water Act (CWA; Public Law 92-500 as amended).
2. Terms and Conditions: Comply with terms and conditions as stated in the permit.
3. Monitoring and Treatment:
a. Provide monitoring and water treatment, if necessary, to achieve compliance with permit conditions.
b. Provide recordkeeping required of the permittee, as stated in the NPDES permit.

4. Sampling: Include sampling in monitoring required of the Contractor to meet section 402 requirements, as well as required laboratory tests to determine effluent characteristics.
5. Monitoring Results:
a. Provide monitoring results to the CO 2 weeks prior to submittal deadline to appropriate State representative or Environmental Protection Agency (EPA) Regional Administrator.
b. Send copies of all information transmitted to the State or EPA to the CO.
6. Effluent limitations and monitoring requirements of the wastewater discharge permit are listed in the permit.
7. NPDES Permit: If Reclamation is the NPDES permit holder (permittee), Reclamation will make known the terms and conditions of the permit to the Contractor and then may transfer the permit to the Contractor.
B. Dredge and Fill Discharge:
1. Applications:
a. If discharge of dredged or fill material into waters of the United States (including wetlands) is anticipated by the Contractor, Reclamation shall apply to the U.S. Army Corps of Engineers (Corps) for a permit under section 404 of the CWA.
b. The U.S. Army Corps of Engineers (Corps) determined the project is exempt from permit requirements under Section 404 of the Clean Water Act. A copy of the exemption letter is included in Section J of the Solicitation. The Contractor shall comply with all requirements and conditions of the exemption.
c. If discharge of dredged or fill material into tribal surface waters (all water bodies and perennial, intermittent, and ephemeral streams) is anticipated by the Contractor, Reclamation shall apply to the Pyramid Lake Paiute Tribe (Tribe) for water quality certification under section 401 of the CWA.
2. Terms and Conditions:
a. Reclamation will make known the terms and conditions of the 404 permit and 401 certification to the Contractor.
b. The Contractor shall comply with all terms and conditions in
Reclamation’s 404 permit and 401 certification, including implementation of erosion and sedimentation pollution control measures and compliance with Pyramid Lake Paiute Tribe Water Quality Ordinance 53.
3. Monitoring:
a. The Contractor shall implement monitoring, if necessary, to achieve compliance with applicable 404 permit and 401 certificate terms and conditions issued to Reclamation.

b. The Contractor shall provide recordkeeping, if required in the 404 permit and 401 certification issued to Reclamation.
c. The Contractor shall provide monitoring results to the CO 2 weeks prior to submittal deadlines to the Corps and Tribe.
d. The Contractor shall send copies of all information transmitted to the Corps and Tribe to the CO at the same time.
4. Sampling: The Contractor shall provide soil and water sampling, if necessary, to meet requirements in the 404 permit and 401 certification issued to Reclamation, as well as provide required laboratory testing to determine sample characteristics.
1.06 ADMINISTRATIVE RESPONSIBILITIES
A. Permits: Any permits obtained by Reclamation are exceptions to the clause at FAR 52.236-7, Permits and Responsibilities, which requires the Contractor to obtain necessary licenses and permits.
B. Monitoring:
1. Conduct monitoring in order to meet the requirements of the permits which may include:
a. Sampling.
b. Site inspections.
c. Required laboratory tests to determine effluent characteristics.
C. Reporting Results:
1. The Government will report required monitoring results to appropriate agencies.
2. The section 402 wastewater discharge permit has specific reporting requirements for the permittee for noncompliance when effluent limitations are exceeded.
D. Recordkeeping: Retain records and data required by permits.

3.01 POLLUTION CONTROLS
A. Control pollutants by use of sediment and erosion controls, wastewater and stormwater management controls, construction site management practices, and other controls including State and local control requirements.

1. Establish methods for controlling sediment and erosion which address vegetative practices, structural control, silt fences, straw dikes, sediment controls, and operator controls as appropriate.
2. Institute stormwater management measures as required, including velocity dissipators, and solid waste controls which address controls for building materials and offsite tracking of sediment.
C. Stormwater Management Controls:
1. Pollution Prevention Measures:
a. Use methods of dewatering, unwatering, excavating, or stockpiling earth and rock materials which include prevention measures to control silting and erosion, and which shall intercept and settle any runoff of sediment-laden waters.
b. Prevent wastewater from general construction activities such as drainwater collection, aggregate processing, concrete batching, drilling, grouting, or other construction operations, from entering flowing or dry watercourses without the use of approved turbidity control methods.
c. Divert stormwater runoff from upslope areas away from disturbed areas.
2. Turbidity Prevention Measures:
a. Use methods for prevention of excess turbidity which include, but are not restricted to, intercepting ditches, settling ponds, gravel filter entrapment dikes, flocculating processes, recirculation, combinations thereof, or other approved methods that are not harmful to aquatic life.
b. Water discharged into surface waters shall meet conditions of section 402, the National Pollutant Discharge Elimination System (NPDES) permit.
c. Do not operate mechanized equipment in waterbodies without having first obtained a section 404 permit, and then only as necessary to construct crossings or perform the required construction.
D. Construction Site Management:
1. Contractor Construction Operations:
a. Perform construction activities by methods preventing entrance, or accidental spillage, of solid matter, contaminants, debris, or other pollutants or wastes into streams, flowing or dry watercourses, lakes, wetlands, reservoirs, or underground water sources.
1) Pollutants and wastes include, but are not restricted to, refuse, garbage, cement, sanitary waste, industrial waste, hazardous materials, radioactive substances, oil and other petroleum products, aggregate processing tailings, mineral salts, and thermal pollution.

2. Stockpiled or Deposited Materials: Do not stockpile or deposit excavated materials or other construction materials near or on stream banks, lake shorelines, or other watercourse perimeters where they can be washed away by high water or storm runoff or can in any way encroach upon the watercourse.
3. Petroleum Product Storage Tanks Management:
a. Place oil or other petroleum product storage tanks at least 20 feet from streams, flowing or dry watercourses, lakes, wetlands, reservoirs, and any other water source.
b. Do not use underground storage tanks.
c. Construct storage area dikes at least 12 inches high or graded and sloped to permit safe containment of leaks and spills equal to storage tank capacity located in the area plus sufficient freeboard to contain 2 times the 25-year rainstorm. Line diked areas with an impermeable barrier at least 50 mils thick.
d. Areas for Refueling Operations: Lined with impermeable barrier at least 10 mils thick covered with 2 to 4 inches of soil.

This concerns your proposed Marble Bluff Dam and Fish Passage Facility Sediment Removal Project which would remove sediment from gates at the Marble Bluff Dam and Fish Passage Facility (MBDFPF). The project site is located near, Township 23 North, Range 23 East, Latitude 39.8555°, Longitude -119.3928°, Reno, Washoe County, Nevada.
You propose to remove sediment on the upstream face of the Marble Bluff
Dam on the dam’s concrete apron. The sediment will be removed by using a shovel and transferring the material to five-gallon buckets which are then lifted to the top of the dam. The removed material will then be transported to a Lahontan Basin Area Office (LBAO) waste site that is outside the ordinary high water mark of the Truckee River. If the river conditions warrant it, a water bladder or bulkhead will be used to divert water from the work area and a pump will be used to dewater the work area.
The proposed project is exempt from permit requirements under Section 404 of the Clean Water Act in accordance with 33 CFR 323.4(a)(2). (2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $100,000 at any tie for construction work under the contract resulting from this solicitation. The notification shall list the -
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.

FAR 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT -- MAY 2014
CONSTRUCTION MATERIALS
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American--Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225- 9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.
