About this file

This file is a Questions and Answers amendment to a federal solicitation for hazardous waste services at Yosemite National Park. The solicitation, numbered 140P8526Q0044, establishes an Indefinite Delivery/Indefinite Quantity (IDIQ) contract vehicle for hazardous waste treatment and disposal services under NAICS 562112. The solicitation is structured as a 100% Total Small Business Set-Aside, requiring the prime contractor to be a small business.

The amendment clarifies two critical compliance issues for potential contractors. First, regarding subcontracting, the prime contractor may subcontract up to 50% of the award amount to "other than small" businesses and may subcontract more than 50% to similarly situated small businesses, provided that no more than 50% of the total award amount goes to "other than small" businesses. The contractor is not required to self-perform all work. Second, regarding pricing evaluation, the Government will evaluate and award based on the total aggregate pricing across all five years of the contract period, rather than evaluating responsiveness on a line-item basis. The price sheet includes approximately 50 or more distinct waste line items (drums, batteries, lab packs, absorbents, and similar hazardous materials) with unit pricing.

Answers to Potential Contractor Questions Hazardous Waste IDIQ Yosemite National Park

1. Question:

Subcontracting ceiling and "similarly situated" rule: The solicitation is a 100% Total Small Business Set-Aside under NAICS 562112 (waste treatment and disposal services). For pricing and performance compliance, we need to confirm: Under FAR 52.219-14, will work performed by "similarly situated" small businesses in the same NAICS (562112) count toward our own performance requirement, or must we self-perform all work to satisfy the small-business prime rule? We anticipate potentially subcontracting portions of transportation and TSDF coordination to licensed haulers and permitted facilities but want to ensure we structure our approach correctly to avoid the ostensible subcontractor/affiliation issue.

Answer: According to RFO FAR 52.219-14, the prime contractor can subcontract up to 50% of the award amount to “other than small” businesses. The contractor can subcontract more than 50% of the award amount to small businesses (similarly situated entities) but cannot exceed 50% of the award amount to “other than small” businesses. The contractor does not need to perform all the work to satisfy the rule.

2. Question:

Award basis by line item vs. aggregate: The price sheet lists approximately SO+ distinct waste line items (drums, batteries, lab packs, absorbents, etc.) with unit prices.

Will award and evaluation be based on total aggregate pricing across all items, or will the Government evaluate and potentially score responsiveness line-by-line? This affects how we manage pricing risk and cost allocation. We appreciate your assistance and look forward to submitting a compliant and competitive proposal.
