About this file
This hazardous materials survey report documents the results of testing building materials at the Lighthouse Apartment Building at Point Reyes National Seashore for asbestos and lead. Asbestos was detected in joint compound, resilient sheet flooring, pipe insulation, and mastic throughout the building. Lead was detected at levels between 1-5% in exterior coatings. The report recommends all removal of asbestos-containing materials be performed by a licensed asbestos abatement contractor. Waste characterization sampling showed some materials would require handling and disposal as hazardous waste under California and federal regulations due to lead levels. The related federal contract opportunity is to replace the roof and repair the building's exterior envelope under solicitation number 140P8420R0001 for the National Park Service Pacific West Region.

RE: Point Reyes National Seashore Lighthouse Apartment Building (Residence 175)
Mr. Demko, Millennium Consulting Associates, (Millennium) was retained by the National Park Service to provide asbestos and lead-related consulting services related an upcoming improvement project at the Lighthouse Apartment Building (Residence 175) at the Point Reyes National Seashore (PORE). The building was built in the 1960’s by the U.S. Coast Guard. Specifically, Millennium was requested to conduct limited sampling of select building materials to determine the presence/absence of asbestos and lead, prior to the repair.
Millennium was provided the proposed scope of work which includes the replacement of the roof, repairing and painting the exterior envelope, and other miscellaneous improvements to the Lighthouse Apartments. Millennium was also provided previous hazardous materials information. The data includes excerpts from a 2011 assessment by MACTEC Engineering and Consulting, Inc. The asbestos-related data from this 2011 assessment is included in this assessment.
Millennium personnel, Mr. Aaron Alvarez (CSST No. 19-6449) under the supervision of Mr. Jeremy Malson (CAC 07-4183) performed the assessment on November 12, 2019. A total of twenty-two (22) samples were collected from the roofing system. In addition, a review of the existing data was performed.
The existing data was sufficient enough for work practice determinations for the other miscellaneous improvements to the building. A summary of the 2011 and 2019 data can be found in Table 1 in the attachments.

LEAD SURVEY SUMMARY
Millennium personnel, Mr. Aaron Alvarez (Lead Inspector-in training) under the supervision of Mr.
Jeremy Malson (LRC 581) performed the assessment on November 12, 2019. A total of four (4) samples were collected from exterior wall surfaces; previous sampling performed by National Park personnel indicated lead-containing paints on the exterior of the building. A summary of the 2019 data indicates lead detected in the exterior coating system ranging from <80-ppm to 50,000-ppm. It should be noted the white paint on the wood trim is classified as lead-based paint.
REGULATORY CONSIDERATIONS
ASBESTOS
The asbestos inspection and bulk sampling procedures were based on the guidelines established by the U.S. EPA in the Guidance for Controlling Asbestos Containing Materials in Buildings, Office of Pesticides and Toxic Substances, DOC #560/5-85-024 and 40 CFR Part 763, Asbestos Hazard Emergency Response Act (AHERA). Field information is organized according to the AHERA concept of Homogeneous Areas (HA). A HA is defined as a suspect material of similar age, appearance, function, and texture. Each material will be grouped together as a specific HA, sampled, and then assessed. The AHERA guidelines represent an industry standard sampling protocol and as such was utilized during the inspection and sampling. For the purposes of this inspection, suspect ACM has been placed in three (3) material categories:
1. Thermal Systems Insulation (TSI);
2. Surfacing Materials; and
3. Miscellaneous Materials.
Samples of friable and non-friable suspect materials were collected to include penetration of the suspect material to its substrate. The bulk samples collected were placed in individual sealed containers and labeled with unique sample identification numbers, then submitted to the laboratory to be analyzed for asbestos content.
Specifically, the inspection involved the following tasks:
O f f i c e L o c a t i o n s i n O a k l a n d , M o n t e r e y , L o s A n g e l e s , S a n D i e g o a n d S a n L u i s O b i s p o
1. Visual determination as to the extent of visible and accessible suspect materials and conditions of the material;
2. Collection and analyses of suspect building materials for asbestos content;
3. Preparation of a Chain-of-Custody form that accompanied the samples to the laboratory.
Chain-of-Custody procedures and records provide a means of tracing each sample from the time of collection through the shipment and final analyses. Proper Chain-of-Custody procedures also provide a written record of all persons handling the samples. The information necessary to relate sample locations for reporting purposes is documented with each sample. This information is essential to proper completion of a sample results report and typically includes client and facility information; unique sample identification number; date and time sampled; sampler name and signature; sample location including the room/area; and field sketches of sample locations.
All sample analyses were performed by EMSL Laboratories in San Leandro, CA, a laboratory which is certified by the State of California Environmental Laboratory Accreditation Program. The laboratory will be requested to retain the samples for at least ninety (90) days in the event re-analyses of samples are required. All disposal of samples will be compliant with established Federal, state, and local regulations.
Asbestos Regulatory Overview for California
Construction materials containing asbestos greater than 1 percent are defined as an ACM and are regulated under both federal and state regulations. Construction materials containing asbestos greater than 0.1% are defined as an Asbestos-Containing Construction Material (ACCM) and are regulated by the State of California. Cal/OSHA regulates the removal of both ACM and ACCM.
Please refer to Title 8 §1529-Asbestos for the regulatory requirements associated with working with both ACM and ACCM. Additionally, refer to §1529(r)-Report of Use and Asbestos-related Work Registration for the registration requirement of contractors involved in asbestos-related work involving over 100 square feet of ACCM/ACM. In instances where a material contains asbestos in concentrations below the ACCM regulatory threshold, the employer is required to comply with Cal/OSHA 5194-Hazard Communication in addition to pertinent sections of §1529-Asbestos.
In California, ACMs that are >1% and friable or will become friable during abatement are classified as a California-Hazardous Waste, and require special handling, packaging and disposal.
LEAD
Regulatory Definitions of lead-containing materials are detailed in 8 CCR, 22 CCR and CFR title 40 regulations. Cal/OSHA 1532.1-Lead regulates the removal of materials with detectable levels of lead.
Please refer to §1532.1-Lead for the regulatory requirements associated with working with lead-containing materials.
It is important to understand that Cal/OSHA does not give a regulatory definition of a “lead-containing material.” Cal/OSHA and Federal OSHA are concerned with “an employee occupationally exposed to lead.” This is understood to mean material disturbed during construction work containing lead in any amount (i.e., lead-containing paint and lead-based paint) is covered under the lead in construction standard. Additionally, Federal OSHA has determined that the uses of XRF data and/or bulk sampling
O f f i c e L o c a t i o n s i n O a k l a n d , M o n t e r e y , L o s A n g e l e s , S a n D i e g o a n d S a n L u i s O b i s p o data (e.g., paint chips) are not acceptable for predicting employee exposures to lead. This fact means that contractors cannot use XRF data, paint chip data, or bulk sample data as a surrogate for employee exposures during construction work (or the bidding process) as defined in 8 CCR 1532.1(a). The two OSHA interpretation letters below should be reviewed.
1. www.osha.gov/pls/oshaweb/owadisp.show_document?p_table=INTERPRETATIONS&p_id=23455
2. www.osha.gov/pls/oshaweb/owadisp.show_document?p_table=INTERPRETATIONS&p_id=22701
Cal/OSHA regulations require employee personnel monitoring at any detectable levels until statistically reliable results indicate that exposure will remain consistently below the OSHA Action Level of 30 micrograms/m3 and the Permissible Exposure Level of 50 micrograms/m3 for an 8-hour day. The employer must then produce a “Negative Exposure Assessment” to indicate that it is not possible with the specific lead-containing paint product to create excessive lead exposure levels.
Current California and Federal regulations do mandate that generators determine if a waste is hazardous or non-hazardous by testing representative samples of the waste. The total lead by Total Threshold Limit Concentration (TTLC), California WET-method Soluble Threshold Limit Concentration (STLC), and Toxicity Characteristic Leaching Procedure (TCLP) analyses should be performed to characterize each waste stream as Federal RCRA hazardous waste, California hazardous waste, non-hazardous waste, or as construction debris. The waste stream must be handled as RCRA environmentally hazardous waste if TCLP lead levels exceed 5.0 milligrams per liter (mg/l), or as California hazardous waste if TTLC lead exceeds 1,000 milligrams per kilogram (mg/kg), and/or STLC lead exceeds 5.0 mg/l, respectively. By calculation, if a sample analyzed for lead by TTLC is found to contain less than 50 mg/kg, then the waste stream represented by the sample result is non-hazardous (a completely soluble waste at this concentration would produce a TCLP lead concentration of less than 5.0 mg/l). Similarly, total lead less than 50 mg/kg will generally produce an STLC lead concentration of less than 5.0 mg/l.
Conclusions and Recommendations
Based on the limited sampling performed, Millennium presents the following conclusions and recommendations:
• There are materials as part of this limited inspection/sampling which are considered as hazardous materials (ACM) and which contain detectable asbestos >1.0%.
All removal/disturbance of asbestos-containing construction materials (> 0.1%) in quantities greater than 100-ft2 shall be performed by a DOSH registered and C-22 licensed asbestos contractor. Materials containing <0.1% asbestos shall be removed in compliance with the requirements of the Cal-OSHA Asbestos in the Construction Industry Standard, 8 CCR 1529, but use of a licensed abatement contractor is not required.
All regulated asbestos-containing materials (RACM) are required to be removed prior to renovation of the subject buildings in compliance with the BAAQMD Regulation 11, Rule 2. Should RACM be removed in quantities greater than 100-ft2, then a permit is required to be filed with the BAAQMD.

• There are materials as part of this limited inspection/sampling which contain lead at quantities greater than 0 ppm but less than 5,000 ppm (Lead-Containing Paint - LCP).
In addition, there are materials as part of this limited inspection/sampling which contain lead at quantities greater than 5,000 ppm (Lead-Based Paint - LBP).
As such, Due to the presence of lead-containing building materials, compliance with Cal/OSHA 8 CCR 1532.1, Lead in the Construction Industry Standard, will be required for the general contractor and all subcontractors. Workers shall have, at a minimum, lead awareness training for any work that disturbs lead containing materials.
Additionally, should any trigger task activity listed in section (d)(2)(A-D) of 8 CCR 1532.1, including, but not limited to, manual demolition, manual scraping, manual sanding, power tool cleaning with or without local exhaust ventilation, abrasive blasting, welding, and cutting where lead-containing paints or components are present, the contractor shall comply with the following requirements:
1. Provide a negative exposure assessment performed within the past 12-months for each anticipated trigger task.
OR
2. Provide workers with interim protections including, but not limited to, provision of a written lead compliance plan, medical surveillance, provision of PPE, a respiratory protection program, provision of hygiene facilities, and performance of exposure assessments in compliance the Lead in Construction Standard.
LIMITING CONDITIONS
Millennium conducted the survey in November 2019, in general accordance with industry standards for asbestos and lead sampling procedures in existence at the time of the project. The survey was limited to selected areas where planned remodeling activities are to be performed. The conclusions and recommendations presented in this report are based on the applicable standards of our profession at the time this report was prepared. Copies of this report are furnished to provide the factual data that were gathered and summarized in the report.
The analysis and recommendations submitted in this report are based in part on the data obtained from specific and discrete sampling locations including representative surfaces where remodeling activities are scheduled to be performed. However, the nature and extent of variations between the sampling locations may not become evident until planned renovation and/or demolition procedures commence.
