About this file
This is a Questions and Answers (Q&A) document for a federal contracting opportunity.
Contract Overview: Solicitation 140P8326Q0058 is a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside for a lighting retrofit project at T-Woods residence buildings (T-117 and T-118) in Mount Rainier National Park. The contract involves retrofitting lighting systems across 16 apartments with a 60-day period of performance. Currently, 4 apartments are scheduled to remain vacant during performance, though occupancy may change. NPS staff will be on-site daily to coordinate apartment access.
Scope of Work and Technical Requirements: The project includes replacing or retrofitting existing luminaires with LED components and bulbs. For lower floor recessed fixtures, the preferred approach is to retain existing fixtures with internal ballasts removed and direct wire retrofit LED lamps installed, without requiring drywall work. Upper floor replacements or retrofits are acceptable without drywall replacement. Canless style downlights are preferred where feasible. Kitchen can luminaires should be sealed if ballasts are removed, or existing ballasts may be retained if possible. New bathroom lights are not required to be dimmable, and Arc Fault Circuit Interrupters, battery backup lights in stairwells, state inspections, exterior gable lights, and painting touch-up are not included in scope. The contractor is responsible for removing all universal waste (fluorescent lamps and ballasts) offsite and must provide an inventory record of waste type and quantity disposed. Buy American requirements apply to construction materials under FAR 52.225-9, with domestic content testing waived for COTS items except for iron or steel components. The site-specific safety and health plan may be signed by a single qualified individual serving as on-site safety manager, project manager, or superintendent, and must be submitted to NPS for park safety manager review and signature.

1. Dual role for superintendent and safety manager
Attachment 2, Section H.3 requires the site specific safety and health plan to be signed and dated by both the prime contractor's safety and health manager and the site superintendent. On a project of this size and duration, may one qualified individual serve in both capacities and sign the plan in both roles, or does NPS require two separate individuals? The plan may be signed by 1 person serving as on site safety manager, project manager or superintendent. The site specific safety plan will also need to be submitted to the NPS for park safety manager review and signature.
2. Recessed luminaires (Type F) on lower floors http://uscode.house.gov/view.xhtml?req=granuleid%3AUSC-prelim-title41-chapter83&saved=%7CZ3JhbnVsZWlkOlVTQy1wcmVsaW0tdGl0bGU0MC1jaGFwdGVyMzctZnJvbnQ%3D%7C%7C%7C0%7Cfalse%7Cprelim&edition=prelim http://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title41-section1907&num=0&edition=prelim
The SOW (p. 4) states that replacement with a canless style downlight is preferred for recessed luminaires, but that attic access is only available for upper floor apartments. For lower floor units, please confirm the Government's intent:
a. Is full fixture replacement expected, accepting that access will require cutting and patching drywall from below? If so, we note the SOW also states that any modification to the building, including drywall, requires prior approval from the Contracting Officer. Would NPS pre-approve the drywall work necessary to accomplish the canless replacement, and is patch, texture, and paint to match included in the contractor's scope? Drywall or painting is not included in the scope of work, NPS will make touchup paint repairs.
b. Or is the intent that lower floor recessed fixtures be retained with the internal ballast removed and direct wire retrofit LED lamps installed, with no drywall work? This the expected intent, lower floor recessed fixtures be retained with the internal ballast removed and direct wire retrofit LED lamps installed, with no drywall work, upper replacements or retrofit is acceptable without any drywall replacement being required.
3. Unit occupancy
How many of the 16 apartments across T-117 and T-118 are currently occupied? Will any units remain vacant for the full 60 day period of performance, and if so, how many? This affects our sequencing plan, daily access coordination with NPS staff, and labor loading in our quote.
Currently 4 apartments are scheduled to be vacant during the period of performance, the occupancy for apartments may change resulting in more or fewer occupied apartments. NPS staff will be on-site daily for apartment access.
4. Disposal of fluorescent lamps and ballasts
Beyond standard universal waste recycling under 40 CFR Part 273 and Washington State requirements, does DOI or NPS impose any additional handling, transport, or documentation requirements for removed fluorescent lamps and ballasts, including any PCB containing ballasts that may be encountered? Specifically:
a. May the contractor remove universal waste from the Park for recycling at an offsite permitted facility, or must materials be turned over to Park staff? The contractor is responsible for removal of all w universal waste and debris offsite.
b. Are recycling certificates or disposal records required as a closeout deliverable, and if so, in what format? The park requires a record of what type and quantity of universal waste was disposed of, e.g., number and type of fluorescent light bulbs. No formal disposal records required
- just an inventory of type and quantity of universal waste.
5. Buy American, FAR 52.225-9
Does the Park anticipate any exception or nonavailability determination applying to the specified LED luminaires and lamps, or should quoters assume all offered items must qualify as domestic construction material under the clause? FAR 52.225-9(b) Domestic Preference (1) - This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the domestic content test of the Buy American statute is waived for construction material that is a COTS item, except that for construction material that consists wholly or predominantly of iron or steel or a combination of both, the domestic content test is applied only to the iron and steel content of the construction materials, excluding COTS fasteners.
