52.209-5 Certification Regarding Responsibility Matters (May 2026) (a)

(1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals—

(A) Are □ are not □ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have □ have not □, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract;

violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are □ are not □ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision; and

(D) Have □, have not □, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied. Federal taxes are considered delinquent if both of the following criteria apply:

(1) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if a pending administrative or judicial challenge remains. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(2) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) The Offeror has □ has not □, within a 3-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager;

plant manager; head of a division or business segment; and similar positions).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

52.209-11 Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under and Federal Law (February 2016) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that—

Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

The Offeror represents that—

It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and

It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months.

(end of provision)

52.252-3 Alterations in Solicitation (Apr 1984) Portions of this solicitation are altered as follows:

Deviated provisions and clauses as annotated below.

52.252-5 Authorized Deviations in Provisions (Nov 2020)

(a) The use in this solicitation of any Federal Acquisition Regulation (48 CFR Chapter 1) provision with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the provision.

(b) The use in this solicitation of any Department of Interior Acquisition Regulation(48 CFR Chapter 14) provision with an authorized deviation is indicated by the addition of "(DEVIATION)" after the name of the regulation.

Factor 2: Key Personnel (Limited to 2 pages per member identified) Qualifications of management and Key Personnel to be assigned and estimated level of effort to be spent on proposed tasks. Resumes must be provided for key personnel and should not exceed two pages.

Resumes should identify specific skills and experience in response to the solicitation requirements as well as meet the minimum education requirements for the identified Key Personnel. All assigned Key Personnel

SHALL BE EMPLOYED BY THE PRIME CONTRACTOR.

The Contractor shall assign to this IDIQ contract the following key personnel:

Data Analyst Bachelors Degree and one (1) or more years experience in a related field.

Factor 3: Experience – (Limited to 10 pages) The offeror shall identify the proposed team, including all subcontractors it may utilize under this IDIQ contract. For the prime Contractor and any important Subcontractor firm proposed, the offeror shall provide a description of each firm’s qualifications and experience, particularly as it pertains to ion analysis from filter samples, and data management. The offeror shall provide experience information for up to three

(3) projects performed by the prime Contractor within the last three (3) years that are proposed to be of similar size, scope, and complexity.

Factor 4: Past Performance – (Limited to 15 pages) The offeror shall complete the included Past Performance Questionnaire for up to three (3) substantially complete projects performed by the prime Contractor within the three (3) years that are proposed to be similar scope, size, and complexity. The submitted projects may be the same projects submitted under Factor 3 or the offeror may elect to include different projects for this submission. The offeror shall fill out Section A and coordinate completion of Section B with the respective reference. Completed Past Performance Questionnaires shall be included in the offeror’s proposal and not sent directly to the agency.

If the prime Contractor does not have relevant past performance history, the proposal may include past performance information involving predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement.

Past Performance should address the following:

Recency: Recency is generally expressed as a time period during which past performance references are considered relevant, and it is critical to establishing the relevancy of past performance information.

Relevance: In establishing what is relevant for the acquisition, consideration should be given to those aspects of an Offeror’s history of contract (or subcontract) performance that would provide the most context and give the greatest ability to measure whether the Offeror will successfully satisfy the current requirement. Common aspects of relevancy include, but are not limited to, the following: similarity of product/service/support, complexity, dollar value, contract type, use of key personnel (for services), and extent of subcontracting/teaming.

Quality: The past performance evaluation, conducted in support of a current source selection, does not establish, create, or change the existing record and history of the Offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the Offeror performed those past contracts. Factors 1-5 are listed in descending order of importance:

Non-Price Factors Rating Factor 1: Technical Approach Adjectival Factor 2: Key Personnel Adjectival Factor 3: Experience Adjectival Factor 4: Past Performance Adjectival Factor 5: Small Business Participation Adjectival

All non-price factors, when combined, are significantly more important than price.

FACTOR RATING PROCEDURES

Non-Price Factor Rating Procedures:

The Government will assign one overall rating for each non-price factor, except Past Performance, which will be evaluated using the confidence ratings described below. The rating depicts how well the bidder’s proposal meets the objectives in accordance with the stated evaluation criteria and solicitation requirements.

Factor 1: Technical Approach (Limited to 50 pages) The proposal must fully address all aspects of the criterion. The proposal will be evaluated for significant strengths, significant weaknesses, and the degree of relevance to the criterion. The offeror must demonstrate that the Government's performance requirements will be met or exceeded as described herein to receive the applicable evaluated rating.

Submissions that clearly outline an approach for effectively extracting and analyzing anions from IMPROVE nylon filters, with detection limits which meet or exceed those obtained using current methods and ensure robust data collection will have a more favorable rating. Submissions that propose a comprehensive quality assurance program that will ensure a high-quality dataset will receive a more favorable rating. Submissions that provide a clear framework for data reduction and data reporting will receive a more favorable rating. Submissions that demonstrate the ability to complete analysis on the large number of filters expected in a timely manner will receive a more favorable rating.

Factor 2: Key Personnel (Limited to 2 pages per key personnel) Key personnel that possess higher qualifications with regard to relevant education, experience, demonstrated technical knowledge and expertise to fulfill the scope requirements, and possession of substantial, relevant knowledge within their respective areas will receive a more favorable rating. Such specialized expertise includes that directly related to ion chromatography, analytical chemistry, data processing, and quality assurance methods. Personnel may demonstrate expertise in the field through experience in the field, or through publications, presentations and/or other professional activities on topics related to the relevant analysis techniques, with a specific focus on measurements of atmospheric aerosols.

Minimum education and experience requirements for each key personnel position are included in IDIQ Pricing Schedule. If a proposed individual does not meet the minimum requirements, offerors may provide supplemental information about qualifying education and experience as a substitution for the stated minimum requirements. Any substitution shall demonstrate how the proposed individual’s knowledge, skills and abilities to successfully perform the duties of the key personnel position are commensurate with the identified minimum requirements.

Factor 3: Experience (Limited to 10 pages) The qualifications and prior experience of the offeror will be evaluated to determine the proposed team’s capability to successfully carry out the required filter analysis. Offerors demonstrating experience on recent, relevant projects similar to those required under this solicitation in size, scope and complexity will be more favorably rated. Clear evidence of past experience in which the proposed project team worked together and showed a record of completing tasks on schedule will be favorably rated.

Offerors with experience in extraction of ambient aerosol samples from nylon filters and related ion analysis of these samples will be more favorably rated. Offerors with experience related to method development, particularly as it pertains to extraction and analysis of ions from ambient aerosol samples, will be more favorably rated.

Factor 6: Price Price: In accordance with FAR 15.304(e), all evaluation factors other than cost or price, when combined, are significantly more important than cost or price; however, cost/price will contribute to the selection decision. The evaluated price will not be rated or scored but will be considered for reasonableness in the final source selection decision.

Unit prices in the proposed labor schedule will be evaluated to determine price reasonableness. The offeror will provide pricing for the base period as well as all ordering periods, including the 6-month extension.

The Government will evaluate the extension under Ordering Period Five Rates unless the extension rates were established with escalation at the time of award based upon quoted rates for this period.

The price proposal submitted for the Task Order will be utilized to verify the offeror’s application of its rates and understanding of the contract requirements. Price reasonableness will be determined considering other competitive prices received, comparison to the Independent Government Estimate, historic pricing and utilization of other price analysis techniques.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
