The amendment provides questions and answers, a site visit sign-in sheet, a corrected specification section, a presentation to bidders, and an extension to the solicitation due date to May 1, 2024. The National Park Service has secured permits from the Wisconsin Department of Natural Resources and the U.S. Army Corps of Engineers for the work. In-water work has seasonal restrictions, but exemptions have been granted for the 2024 construction season. The contract will be a firm-fixed price award to a small business, with a 335-day period of performance including a winter shutdown. Question: Answer:

Amendment

Number:

Could the performance period be extended to allow all of the 2025 season for construction?

In-water work is seasonally limited by the WIDNR permit. A WIDNR extension to the seasonal start was granted for the 2024 season and can be requested for the 2025 season as it nears. The NPS will consider extending the overall Period of performance based on feedback during this bid period. 1

Can project completion extend to, if not past, 12/1/25? Request due to unknown weather conditions and potentially shorter construction seasons than normal.

Please clarify your request. Are you requesting we extend to December

2025? Can you reasonably assume to execute work during these months? 1

Can we get a 2 week bid extension? Extending the bid period will have an impact on the 2024 construction season. With this in mind we are not going to extend the bid period. 1

4 consider an additional 6 months be added to the period of performance.

See response to #1 above. Please clarify your request. Are you requesting we extend to March 2026? Can you reasonably assume to execute work during these months? 1

Could you please provide a cut section of the demolition required at the

East Breakwater? On Sheet C1.2 there is a detail for Breakwater Extension

Demolition, are we to assume the East and West Breakwater Extension demolition are similar?

No demolition is to occur on east breakwater. CLIN 7 (Bid Option #3)is for sheetpile installation only. For informational purposes, 4/C1.2 illustrates how the east breakwater is constructed. Photo 5/C1.1 provides additional information. 2

Is it acceptable to construct a temporary causeway on the Lake Superior side of the Marina to facilitate construction during the duration of the project?

This is acceptable within the marina as long as it does not conflict with the Town of Russel boat launch or dock. Means and methods of this would be the responsibility of the contractor. 2

Rehabilitate Waterfront at Little Sand Bay and Devils Island, Reconstruct Boathouse

WDNR Permit Appendix E for Devils Island states “To minimize adverse impacts on fish movement, fish spawning, and egg incubation periods, work may not take place during September 15th through April 15th. The second WDNR letter item 6 states: “Fish spawning. No discharges of dredged or fill material below the ordinary high-water mark of a navigable stream as defined by s. 310.03(5), Wis. Adm. Code, may take place during fish spawning periods or times when nursery areas would be adversely impacted. These periods are: September

15th through July 1st for Lake Superior fish spawning refuge”

Specifications section 01 31 00 1.9 C. States no in water work for Devils

Island from Sept 15th to July 15th.

Which is correct?

Previous Projects in this area utilized the April 15th end date for the no in water work period. A longer construction period of April 15th – September

15th is preferred due to the amount of work required on Devils Island.

Add updated 01 31 00 section now as amendment

Time of Year Restrictions: According to the Water Quality Certificates

(WQC) obtained from the WI DNR, in water work can not occur at the project locations with out a fish window exemption from the WI DNR during the following times.

Little Sand Bay- September 15th through June 15th

Devils Island- September 15th through July 1st

Fish Window Exemptions have been secured from the WI DNR for the

2024 construction season. In-water work can occur at the project sites during the following times:

Little Sand Bay- May 26th through September 15

Devils Island- June 3rd through September 15

In-water work outside of the dates listed above shall require approved by the WI DNR Fisheries Biologist prior to in-water work commencing.

Since we are now shifting the Period of Performance to 2025 and 2026 we NPS will request an exemption for 2025, WIDNR will only grant one year at a time. 2

Sheet CT 2.5 shows an anchoring detail for the toe stone and a toe trench detail. Is it the contractor’s option to either anchor the toe stone or create a trench? Either option is acceptable. 2

Sheet CT0.1 States that vibro compaction is required for all material placed in water depths greater than 1 foot. Where is vibro compaction required? Inside the sheetpile. 2

One document says completion date by 4/1/2025, another says 9/15/2025, and recent amendment says performance period 5/01/2024 to 4/01/2025.

Which is the correct completion date and performance period?

The NPS plans to award the construction contract in June of 2024.

However, due to long lead items and contractor completion of Division

1s we now anticipate issuance of the Notice to Proceed on May 1, 2025.

The Period of Performance is 335 days, with a winter shutdown (winter shutdown days not counted against 335). Offerors shall plan for a winter shutdown anticipated 10/31/25 through 4/30/26. The WIDNR permit in water work restrictions are outside of the control of the NPS but additional days under the permit will be sought for 2025 season (to mirror the unused 2024 season). An extension to the WIDNR Little Sand

Bay Permit (which expires in September 2026) will also be sought. 2

Specification section 05 12 00 2.4 A states fabrication according to AISC

Code of Standard Practice for Steel Buildings and Bridges and AISC 360.

Does this require the fabrication to be completed by an AISC certified fabricator? Yes, AISC certified fabrication is required. 2

Specification section 05 12 00 2.6 GALVANIZING. What steel is required to be galvanized? Note on sheet CT0.0 also mentions painting of structural steel shapes. What steel is to be painted? Items which require galvanization and painting are shown on drawings. Only items specifically identified as requiring galvanization/painting are to be treated. 2

Plan notes state that contractor is responsible for clearing drive line 5-ft below existing mudline. Can the government provide the bottom elevation of the existing cribs at Sand Bay? Suggest NPS provide as-builts. 2

Underwater welding is noted in the plans and specifications. Where is underwater welding required on this project? Please refer to 3/CT1.11 2

Sheet CT1.4 detail 1 and 2 Is a toe trench required for placement of the scour stone? Or is that dip in the mudline just depicting a varying mudline?

Yes, a 1-foot-deep toe trench is required for placement of the scour stone. 2

Sheet CT1.4 detail 4. Can you please provide a non-truncated cross section that accurately depicts layer thicknesses of the armor and filter stone? Also, is the “toe stone” note in this detail referring to the larger 5.3-8.8 ton toe stone? Or is this all armor stone 2.2-4.4 ton? Refer to section 31 35 19 2.2.A 2

Sheet CT1.4 detail 2 and sheet CT 1.6 Detail 2. Does the 3/4 “ crushed stone fill come all the way up to the top of the horizontal HP14 Strut? Yes, CT1.6 shows the 3/4" crushed coming all the way to the top. 2

Please confirm that the viewing platform is to be removed, stored, and reinstalled with no additional materials required of the contractor. The contractor is required to furnish and install a new ramp and stairs only.

Incorrect, a new viewing platform is to be provided and installed. NPS to receive salvaged wood for use elsewhere. 2

19 Will a CMR be involved in the construction phase?

Yes, a Construction Management Representative will be part of the team. 2

20 Will the A/E team be involved in vetting the submittals?

Yes, we will have the A/E team on contract to assist with submittals and

RFIs. 2

21 Can the prime contractor utilize the subcontractor's past performance? Yes. 2

It appears that the intent is to issue a notice to proceed in 2025, however can a partial notice to proceed be issued to allow for movement of materials and staging in the 2024 season?

Yes, this is possible provided the permit requirements are met and some key submittals are accepted. 2
