3.1a Project Program , Current description is outdated. Suggest using language that is in the EA, deleting the current bullets and adding a bullet for Northern Long-Eared Bat: "On November 29, 2022 the USFWS published a final rule to reclassify the northern long-eared bat as endangered under the Endangered Species Act. On January 26, 2023, the USFWS published that they are delaying the effective date of a final rule published on November 30, 2022, reclassifying the northern long-eared bat as an endangered species. The effective date of the final rule amending 50 CFR part 17, published November 30, 2022, at 87 FR 73488, is delayed until March 31, 2023. Additional consultation with FWS related to the Northern Long-Eared Bat will be needed."
Revised to include this text: "On November 30, 2022 the USFWS published a final rule to reclassify the northern long-eared bat as endangered under the Endangered Species Act. The bat faces extinction due to the range-wide impacts of white-nose syndrome, a deadly disease affecting cave-dwelling bats across the continent. On January 26, 2023, the USFWS published that the effective date of the final rule amending 50 CFR part 17, published November 30, 2022, at 87 FR 73488, is delayed until March 31, 2023. Additional consultation with USFWS related to the northern long-eared bat will be needed."
3.1a Project Program, A time-of-year restriction for the protection of spawning anadromous fishes that prohibits in-water construction activities, including cofferdam installation, between February 15 and June 15 of any year may be imposed from February 15 to June 15 of any year to receive a not likely to adversely affect determination from NMFS."

Thank you for the preliminary work that was provided as part of this submittal. The information provided was very comprehensive. It is appreciated.

ACKNOWLEDGED AND APPRECIATED.

Access routes-both road and foot/material/ equipment traffic, staging, existing utility capabilities, water restrictions, will need to be very clear for the CD's, given the location. Please be clear to identify storage and stockpile-(meaning refuse and demo) locations as well as limitations to Contractor parking and equipment and proposed fueling location. Thank you 11/15/2022: COMMENT WILL APPLY FOR NEXT SUBMITTAL, BASED ON RESPONSE. LOOKING FORWARD TO THE
DRAWINGS AND THANK YOU FOR THE ATTENTION. THANK YOU
12/13/2022: Comment still applies for next submittal, based on response. How does the information not provided work into the requirements in 01 11 00, 1.3.A.3? The parking, stockpile, etc. will also affect visitor access won't it?
Based on what is written in 1.3.A.3, this information should be needed as well. Thank you for the efforts so far...

Please consider how salvage…and the possibility of salvage not yielding enough material for reconstruction…will be addressed. It will be critical to make sure that there is enough material to perform the work one way or another. Multiple or sole sources will need to be identified for acceptable material. Thank you

12/13/2022: Comment still applies, based on response. Thank you for the detailed response....however, it still doesn't fully address the question. What happens if there is not enough salvage stone? Is this virtually impossible based on the amount to be salvaged, or does the project come to a halt? Thank you for the consideration.
1/17/2023: PLEASE SIMPLY CONFIRM THAT THERE ARE KNOWN LOCATIONS FOR SOURCING ACCEPTABLE STONE. THIS IS NEEDED TO MAKE SURE THAT THE DB IS NOT STUCK WITH PLAYING "WHICH ROCK" WHEN
TRYING TO MEET THE PROPOSED CONTRACT DURATION. THANK YOU
Addressed with additional wording and clarification in Spec Section 04 20 00; per JV and NPS team meeting discussion held on 01/31/23 with Krystal Krull, Marcello B., Brent N
Please take the time to consider what precautions and safety procedures should be provided in case there were to be what seems to be a relatively normal event of above average moisture. The comment is not trying to say, plan for the impossible.
This is simply a question about additional "planned" protection regarding above average precipitation during the construction.
Reviewer will gladly discuss...and thank you for the consideration.

Please review the Department of the Interior Automated Controls Design Standard on the Workflows Website, and discuss with the Park with regard to any communications, automation, SCADA, etc. Any information obtained during this conversation should be integrated into the project needs. Consider if there will be multiple substantial completions- how the sites will be broken down to be accepted when completed.
It is important to proclaim this in the Summary of Work. It will also be important to identify how final acceptance will take place. Will the expectation be video representation from Contractor hired divers or will there be separate Government inspection- which is not normal. These costs need to be part of the estimate. Thank you 11/15/2022:COMMENT WILL APPLY FOR NEXT SUBMITTAL, BASED ON RESPONSE. PLEASE CONTINUE TO WORK

THE SPECIFICATIONS PROVIDE CONFUSING DIRECTION AND INCORRECT DIRECTION IN MULTIPLE AREAS. THE "OWNER" WILL NOT BE PROVIDING TESTING, AND SPECIFICATION SECTIONS NEED TO BE VERY CLEAR....NOT PROVIDING CONFLICTING INFORMATION ON QUALITY CONTROL....WHEN REFERRING TO TESTING. Please provide a Park or location specific weather/evacuation/emergency procedure. This is critical in establishing good pricing and good procedure in case of unexpected events and material/work security. Working hours, noise restrictions, turbidity, and testing will be very important for the work. Given recent inflation characteristics, there will be a good amount of discussion about specificity of design vs. obligation timing, vs. design necessity. The reality is that there isn't likely a "right" answer. This is an NPS asset and that should be important to all parties. The key will be to provide the best estimate possible. Acceptance needs will also end up being critical. Consider these issues when creating the Contract Line Items and consider if unit pricing may be beneficial in containing cost.

Recommend retaining an arborist to assess and evaluate the condition and value of the existing trees to be impacted by the proposed improvements prior to the commencement of construction.
Response: Coordination with NPS Arborist to evaluate and value of the existing trees to be impacted by the proposed work.
An arborist evaluation was not part of the current project scope. If NPS Arborist can provide the evaluation and value for each tree the replacement calculations can be incorporated into these plans. Alternatively, a note can be added to the plans to state "Contractor to retain arborist to evaluate and value existing trees to be impacted in coordination with NPS Arborist.
Contractor responsible for finalizing replacement calculations."

02-1 - 02-9 Slope Analysis & 05-8 - 05-11 Vegetation Plan and Key Map Construction Impact Analysis
Understanding that these are preliminary sections the impact upon the existing tree plantings appears to be significant. Are there any proposed strategies to maintain the existing grades at the base of the trees such as tree wells?
Response: Trees within the project grading area will be removed and replaced. All grading will be modified for storm water considerations. Adding protection wells at each tree would be unsightly and not consistent with the goal of reestablishing the pattern of trees and character and landform of the cultural landscape. Tree wells would trap water flowing toward the river which would have a negative impact to preserving trees. Therefore tree wells are not recommended.
