About this file
This is a Questions and Answers document for Solicitation 140L1726Q0037, the 2026 NM Range Supply RFQ issued by the Bureau of Land Management, Colorado State Office for range management materials delivery to multiple locations in New Mexico.
The solicitation was initially set as a 100% Indian Small Business Economic Enterprise (ISBEE) set-aside but was reopened via Amendment A0002 as a 100% Small Business set-aside due to receiving no responsive ISBEE quotes at fair and reasonable prices. The revised quote deadline is September 14, 2026, at 0800 Mountain Time. This firm-fixed-price contract is issued under FAR Part 12 for commercial products. Key clarifications provided include: (1) DIAR clauses 1452.280-1, 1452.280-3, and 1452.280-4 no longer apply and are replaced by FAR 52.219-6; (2) all products must conform to small business manufactured end-item standards unless covered by the SBA non-manufacturer rule waiver list (June 2022 version); (3) the government will not make multiple awards by line item—this is an all-or-none solicitation; (4) payment is based on successful receipt, inspection, and acceptance per FAR 52.232-29, with incremental deliveries authorized; (5) the contract period runs September 1 through December 31, 2026, with a revised delivery schedule to be provided post-award; (6) freight may be included in unit prices or on delivery lines at contractor preference, with aggregate price as the evaluation method; and (7) specific product specifications are clarified regarding fusion transitions (DR-9), water tank colors (tan), solar panels (340 watts minimum), drop pipe sizing (1.25"), and rubber tire drinkers (8-foot/500-gallon).

1. Small Business/ISBEE Requirements: Amendment 0002 changed the solicitation from an ISBEE set-aside to a 100% Small Business set-aside. Could you please confirm that the remaining ISBEE requirements and references in the solicitation, including DIAR 1452.280-1, 1452.280-3, and 1452.280-4, no longer apply?
1. The subject DIAR Clauses no longer apply and are replaced by FAR 52.219-6.
2. Products We Can Supply: Since AOC would be purchasing the required products from manufacturers and distributors and supplying them to BLM, we want to make sure this is allowed under the Nonmanufacturer Rule. Are we allowed to supply compliant products manufactured by large businesses, or do the manufacturers of the products also have to qualify as small businesses? If there is an SBA waiver that applies to any of these products, could you please let us know?
1. Unless the specified item is covered by the SBA non-manufacturer rule waiver list, NMR Class Waiver List - version June 2022.pdf; all products must conform to small business manufactured end item product standards. Any requests for exception should be provided within the quotation. A SBA Waiver is not currently contemplated.
3. One Award or Multiple Awards: Do we need to quote and supply the entire requirement, including all items and delivery locations, or can BLM make separate awards by item, CLIN, or delivery location?
1. The government does not anticipate making multiple awards by line item. This solicitation is being posted on an all or none basis.
4. Payments: The solicitation states “14 day prompt pay with progress payments.” Could you please explain how the progress payments would work on this contract? For example, when could we request a payment, how would the amount be determined, and would we need to provide any special documentation or security?
1. Payments will be made based on successful receipt, inspection, and acceptance by the government. Please reference FAR 52.232-29.
5. Partial Deliveries and Invoicing: Since there are multiple delivery locations, can we deliver to the locations at different times and invoice through IPP as each location's order is completed and accepted, rather than waiting until the entire contract has been delivered?
1. Payments will be made based on successful receipt, inspection, and acceptance by the government. Please reference FAR 52.232-29. Incremental deliveries are authorized.
6. Delivery Schedule: Amendment 0002 reopened the solicitation on September 4 and extended the quote deadline to September 14, but the original contract period begins September 1 and ends December 31. Will there be a revised delivery schedule after award, or should we still plan to have all deliveries completed by December 31, 2026?
1. Yes
7. Freight Pricing: We noticed the specifications indicate that freight should be included in the material unit prices, but the quote sheet also has a separate Delivery line for each location. Should we put the freight cost on the Delivery line, include it in the individual product prices, or both?
1. Freight may be included at the contractors preference and will not be excluded from price analysis. As an all or nothing, aggregate price will be the evaluated method.
