About this file
This is a Questions and Answers (Q&A) document for Solicitation 140G0126Q0284, PR 0044013748, addressing contractor inquiries regarding a pond rehabilitation project.
The document provides government and stakeholder responses to eight questions concerning environmental compliance and project execution. Key points include: discharge of water or effluent from the pond onto wooded areas is permitted subject to applicable regulatory requirements and must not impede pedestrian walkways; contractors are responsible for protecting and mitigating runoff from sediment and materials at designated holding areas in compliance with Virginia Department of Environmental Quality (VA DEQ) requirements, including the Erosion and Sediment Control Plan and Stormwater Pollution Prevention Plan; dewatering via pump to existing outfall structures through approved sediment filter bags or dewatering basins is permitted when compliant with MS-11 Virginia dewatering operations standards; tree and vegetation removal from pond embankments is preferred through physical removal, though herbicide treatment is acceptable if nothing remains visible above surface—all trees in riprap, spillways, ornamentally planted areas, and inside the pond must be removed; and herbicide use requires DEQ Applicator Certification for Category 5A Aquatic Pest Control with aquatic-safe formulations compliant with Virginia's Rule of Thirds. Additionally, contractors are prohibited from entering the drain valve chamber prior to bid submission due to confined space regulations governed by Virginia's adoption of federal OSHA standard 29 CFR 1910.146 and VOSH Program Directive 12-124B. The MS4 permit holder must receive a copy of the proposed rehabilitation plan for comment.

Q&A – Part 2 Solicitation 140G0126Q0284
PR 0044013748
Additional Comments for questions 2, 3, 6, and 8:
2. Will the owner allow discharge of water or effluent from the pond onto the wooded areas to the north and/or to the south of the pond?
Answer: This is permitted in accordance with any applicable regulatory requirements. This method shall not impede pedestrian walkways in the pond area.
From SG: I assume this is temporary for the duration of the rehab, but please know that temporarily re-routing the discharge would require coordination with VA DEQ, which we may also need approval from before proceeding. There are peak flows and concentrated flows to consider that VA may require an engineer study. We might also need to update or create amendments to the Erosion and Sediment Control Plan and the Stormwater Pollution Prevention Plan. If a permanent re-route, then there are several other requirements.
3. Will the contractor be responsible for protection and/or any measures to mitigate run-off once the sediment and material has been dumped at the designated holding area on the east side of the campus?
Answer: Yes, as per any applicable regulatory requirements.
From SG: Is the designated holding area temporary? I assume it is. If temporary, then I would say yes if more than a day. Ultimately, someone must be responsible for long or short-term storage of the excavated sediment to conform to VA DEQ sediment control requirements for construction or renovation and to prevent an increase to Reston NC’s MS4 TMDLs.
Requirements are VA Erosion and Stormwater Mgt Program (VESMP) and the MS4 minimum control measures, which are the NC’s written MCMs for construction site runoff control.
6. Dewatering Discharge: Would the Government allow the contractor to dewater the pond by pumping water directly to the existing outfall structure through an approved sediment filter bag/dewatering basin?
Answer: Yes, as per any applicable regulatory requirements.
From SG: If this is an alternative to question number 2 above (re-routing to woods) for the duration of the rehab, this would be a much better solution, this would keep us fully compliant as we would be utilizing the existing outfall that feeds the inter- Ms4 agreement as long as we follow the MS-11 for VA dewatering operations. If this is just a 1-2 day op to remove water before discharging into the woods, then this is acceptable, but please refer back to my responses to Q2 above.
8. Tree & Vegetation Removal Scope: SOW Section 2.1 specifies the removal of "woody vegetation and trees from the pond embankment". Are trees within the top-of-bank to be cut flush and treated with herbicide, or are they required to be grubbed entirely, including the root system?
Answer: Removal is preferred, if herbicide is used there shall be nothing visible above surface. Note, all trees to be removed in riprap, spillways, and ornamentally planted areas as well as inside the pond itself.
From SG: Please do not use herbicide if possible. If herbicide must be used instead of physical removal, please refer to DEQ MCM 6: Applicator certification for the specific category (Cat5A Aquatic Pest Control), ensure the herbicide is safe for aquatic so as not to be toxic to fish or amphibians. Please also refer to VA’s “Rule of Thirds” for herbicides.
In general, please ensure the business or entity that is the MS4 holder post the pond (the agreement) receives a final copy of the proposed rehab plan and provide them a chance to comment.
New Question(s):
19. Do we have permission to enter the chamber to confirm that the drain valve works prior to submitting a bid?
Answer: No. It should have been looked at during the site visit. It is considered confined space.
1. General Industry – Permit-Required Confined Spaces
Virginia has fully adopted the federal OSHA standard 29 CFR 1910.146, mandating procedures for permit-required confined spaces (such as entry permits, atmospheric testing, ventilation, attendant duties, rescue, training). Enforcement and procedures are guided through VOSH Program Directive 12‑124B. [doli.virginia.gov], [ecfr.gov]
This program directive ensures that VOSH personnel enforce requirements equivalent to federal OSHA standards regarding hazard control, entry permits, isolation, testing, ventilation, rescue, and training. [doli.virginia.gov]
