About this file
This document comprises specifications for the Willow Beach National Fish Hatchery (NFH) Hatchery Building HVAC Upgrade project, a federal construction contract managed by the U.S. Government.
The specifications establish comprehensive administrative and execution requirements for project delivery. Section 01 32 01.00 (Project Schedule) requires the contractor to submit an Initial Project Schedule within 21 calendar days of award, demonstrating a reasonable and realistic sequence covering the entire contract performance period. The schedule must serve as both a forward planning and project monitoring tool, with activity cost loading that is reasonable and without front-end loading. Mandatory activities include submission and approval of preconstruction submittals, design packages, O&M manuals, as-built drawings, contractor and government pre-final inspections, punch list corrections, and final inspection. Cost loading requirements specify minimum allocations of 1 percent of contract value for government punch list corrections and for as-built drawings (if no separate CLIN exists) and O&M manuals. Weekly progress meetings with the Government are required to jointly review actual versus planned progress. Section 01 33 00 (Submittal Procedures) governs all submittals, requiring contractor and Designer of Record approval before submission to the Government. Submittals designated with "G" classification require Government approval; others are for information only. The contractor must use the R2EN-021 transmittal form and provide submittals in PDF format with electronic bookmarks for files exceeding 30 pages. Key submittal types include SD-01 Preconstruction Submittals, SD-06 Test Reports, SD-07 Certificates, SD-10 Operation and Maintenance Data, and SD-11 Closeout Submittals. Section 01 35 26 (Governmental Safety Requirements) mandates compliance with NFPA 70, NFPA 70E, NFPA 241, Federal and State OSHA regulations, and ANSI/ASSP A10.44 standards. Contractors must apply for utility outages at least 3 days in advance, establish a Hazardous Energy Control Program (HECP), and obtain energized work permits when de-energizing introduces additional hazard. Electrical work must be conducted in a de-energized state as the preferred method.
Section 01 45 00 (Quality Control) requires the contractor to establish and maintain an effective QC system compliant with FAR 52.246-12, with QC costs included in bid pricing. The contractor is responsible for quality of all work, including subcontractor work, covering both onsite and offsite operations. QC procedures must include field verification of dimensions and component characteristics prior to Government submittal. Completion inspections include contractor punch-out inspection, Government pre-final inspection, and final acceptance inspection (with notification required 14 days in advance). Section 01 78 00 (Closeout Submittals) requires operation and maintenance manuals and as-built drawings marked with red, green, and blue color coding for deletions, additions, and special items respectively, maintained as hard copies on site throughout construction. Section 01 78 23 (Operation and Maintenance Data) specifies that the O&M manual be assembled as an electronically bookmarked PDF containing seven parts: Facility Design and Construction, Facilities/Systems/Assemblies Information (including manufacturer specifications and approved drawings), Wiring and Control Diagrams, Warranty Information, Facility Operations (testing and performance data), Training materials, and Commissioning reports. Comprehensive training must be provided to hatchery management and maintenance personnel, with 95 percent of instruction time devoted to operation and maintenance data, covering start-up, normal operation, shutdown, troubleshooting, safety issues, system interactions, maintenance, and tenant interaction issues. Training validation requires signed class rosters and a validation letter documenting attendee participation, systems covered, trainer information, training dates and locations.

Prepare and maintain a submittal register, as the work progresses. This list may not be all-inclusive and additional submittals may be required.
1.7.2 Design-Build Submittal Register
The Designer of Record develops a complete list of submittals during design and identify required submittals in the specifications and use the list to prepare the Submittal Register. The approved submittal register will serve as a scheduling document for submittals and will be used to control submittal actions throughout the contract period. Coordinate the submit dates and need dates with dates in the Contractor prepared progress schedule. Submit monthly or until all submittals have been satisfactorily completed, updates to the submittal register showing the Contractor action codes and actual dates with Government action codes. Revise the submittal register when the progress schedule is revised and submit both for approval.
1.8 VARIATIONS
Variations from contract requirements require Contracting Officer approval pursuant to contract Clause FAR 52.236-21 Specifications and Drawings for Construction and will be considered where advantageous to the Government.
1.8.1 Considering Variations
Discussion of variations with the Contracting Officer before submission will help ensure that functional and quality requirements are met and minimize rejections and resubmittals. For variations that include design changes or some material or product substitutions, the Government may require an evaluation and analysis by a licensed professional engineer hired by the contractor.
Specifically point out variations from contract requirements in a transmittal letter. Failure to point out variations may cause the Government to require rejection and removal of such work at no additional cost to the Government.
1.8.2 Proposing Variations
1.8.3 Warranting that Variations are Compatible
When delivering a variation for approval, the Contractor warrants that this contract has been reviewed to establish that the variation, if incorporated, will be compatible with other elements of work.
1.8.4 Review Schedule Extension
In addition to the normal submittal review period, a period of 14 calendar days will be allowed for the Government to consider submittals with variations.
1.9 SCHEDULING
SECTION 01 33 00 Page 8 of 10
Schedule and submit concurrently product data and shop drawings covering component items forming a system or items that are interrelated. Submit pertinent certifications at the same time. No delay damages or time extensions will be allowed for time lost in late submittals.
a. Coordinate scheduling, sequencing, preparing, and processing of submittals with performance of work so that work will not be delayed by submittal processing. The Contractor is responsible for additional time required for Government reviews resulting from required resubmittals. The review period for each resubmittal is the same as for the initial submittal.
b. Submittals required by the contract documents are listed on the submittal register. If a submittal is listed in the submittal register but does not pertain to the contract work, the Contractor is to include the submittal in the register and annotate it "N/A" with a brief explanation.
1.9.1 Government Reviewed Design
The Government will review design submittals for conformance with the technical requirements of the Solicitation. Government review is required for variations from the completed design. Review will be only for conformance with the contract requirements.
1.10 GOVERNMENT APPROVING AUTHORITY
When the approving authority is the Government, it will:
a. Note the date on which the submittal was received.
b. Review submittals for approval within the scheduling period specified and only for conformance with project design concepts and compliance with contract documents.
c. Identify returned submittals with one of the actions defined in paragraph REVIEW NOTATIONS and with comments and markings appropriate for the action indicated.
If the Government performs a conformance review of other Designer of Record approved submittals, the submittals will be identified and returned, as described above.
1.10.1 Review Notations
Submittals will be returned to the Contractor with the following notations:
a. Submittals marked "approved" authorize proceeding with the work covered.
b. Submittals marked "approved as noted" authorize proceeding with the work covered provided that the Contractor takes no exception to the corrections.
SECTION 01 33 00 Page 9 of 10
c. Submittals marked "disapproved" or "revise and resubmit" indicate incomplete submittal or noncompliance with the contract requirements or design concept. Resubmit with appropriate changes. Do not proceed with work for this item until the resubmittal is approved.
d. Submittals marked "no action" indicate that submittals have been received by the Government. This applies only to "information-only submittals" as previously defined.
1.11 DISAPPROVED SUBMITTALS
Make corrections required by the Contracting Officer. If the Contractor considers any correction or notation on the returned submittals to constitute a change to the contract drawings or specifications, give notice to the Contracting Officer as required under the FAR clause titled CHANGES.
The Contractor is responsible for the dimensions and design of connection details and the construction of work. Failure to point out variations may cause the Government to require rejection and removal of such work at the Contractor's expense.
If changes are necessary to submittals, make such revisions and resubmit in accordance with the procedures above. No item of work requiring a submittal change is to be accomplished until the changed submittals are approved.
1.12 APPROVED SUBMITTALS
The Contracting Officer's approval of submittals is not to be construed as a complete check, and indicates only that the general method of construction, materials, detailing, and other information are satisfactory and the design, general method of construction, materials, detailing, and other information appear to meet the Solicitation and Accepted Proposal.
Approval or acceptance by the Government for a submittal does not relieve the Contractor of the responsibility for meeting the contract requirements or for any error that may exist, because under the Quality Control (QC) requirements of this contract, the Contractor is responsible for ensuring information contained within each submittal accurately conforms with the requirements of the contract documents.
After submittals have been approved or accepted by the Contracting Officer, no resubmittal for the purpose of substituting materials or equipment will be considered unless accompanied by an explanation of why a substitution is necessary.
1.13 CERTIFICATION OF SUBMITTAL DATA
Certify the submittal data as follows on Form ENG 4025: "I certify that the above submitted items had been reviewed in detail and are correct and in strict conformance with the contract drawings and specifications except as otherwise stated. ______NAME OF CONTRACTOR ______ SIGNATURE OF

1.2 GENERAL REQUIREMENTS
Establish and maintain an effective quality control (QC) system that complies with FAR 52.246-12 Inspection of Construction. QC is comprised of plans, procedures, and organization necessary to produce an end product that complies with the Contract requirements. The QC system covers all design and construction operations, both onsite and offsite, and must be keyed to the proposed design and construction sequence. The Prime Contractor is responsible for the quality of work, including work performed by all sub-contractors.
1.3 SUBMITTAL AND DELIVERABLES REVIEW AND APPROVAL
Procedures for submission, review and approval of submittals are described in Section 01 33 00 SUBMITTAL PROCEDURES. Procedures must include field verification of relevant dimensions and component characteristics by the QC organization prior to submittal being sent to the Contracting Officer.
The CQC organization is responsible for certifying that all submittals and deliverables are in compliance with the Contract. When Section 01 91
00.15 BUILDING COMMISSIONING are included in the Contract, the submittals required by those sections have to be coordinated with Section 01 33 00 SUBMITTAL PROCEDURES to ensure adequate time is allowed for each type of submittal required.
1.4 COMPLETION INSPECTIONS
1.4.1 Punch-Out Inspection
Near the completion of all work or any increment thereof, established by a completion time stated in the Contract Clause entitled "Commencement, Prosecution, and Completion of Work," or stated elsewhere in the specifications, the QC Manager must conduct an inspection of the work and develop a "punch list" of items which do not conform to the approved drawings, specifications, and Contract. Include in the punch list any remaining items on the "Deficiency/Rework Items List", that were not corrected prior to the Punch-Out Inspection as approved by the Contracting Officer in accordance with the paragraph DEFICIENCY/REWORK ITEMS LIST.
Include within the punch list the estimated date by which the deficiencies will be corrected. Provide a copy of the punch list to the Contracting Officer.
The QC Manager, or staff, must make follow-on inspections to ascertain that all deficiencies have been corrected. All punch list items must be confirmed as corrected by the QC Manager and concurred by the Contracting
SECTION 01 45 00 Page 1 of 2
Officer. Once this is accomplished, notify the Government that the facility is ready for the Government "Pre-Final Inspection".
1.4.2 Pre-Final Inspection
The Government and QC Manager will perform this inspection to verify that the facility is complete and ready to be occupied. A Government "Pre- Final Punch List" will be documented by the QC Manager as a result of this inspection. The QC Manager will ensure that all items on this list are corrected and concurred by the Contracting Officer prior to notifying the Government that a "Final" inspection with the Client can be scheduled.
All items noted on the "Pre-Final" inspection must be corrected and concurred by the Contracting Officer in a timely manner and be accomplished before the Contract completion date for the work, or any increment thereof, if the project is divided into increments by separate completion dates unless exceptions are directed by the Contracting Officer.
1.4.3 Final Acceptance Inspection
Notify the Contracting Officer at least 14 calendar days prior to the date a final acceptance inspection can be held. State within the notice that all items previously identified on the pre-final punch list will be corrected and acceptable, along with any other unfinished Contract work, by the date of the final acceptance inspection. The Contractor must be represented by the QC Manager, the Project Superintendent, and others deemed necessary. Attendees for the Government will include the Contracting Officer, other Government QA personnel, and personnel representing the Client. Failure of the Contractor to have all Contract work acceptably complete for this inspection will be cause for the Contracting Officer to bill the Contractor for the Government's additional inspection cost in accordance with the Contract Clause entitled "Inspection of Construction."
