About this file
This is a Questions and Answers document for Amendment P0002 to federal contract 140FC126Q0031, concerning the demolition of a greenhouse at the San Joaquin River National Wildlife Refuge in California.
The document addresses two technical clarifications regarding hazardous materials handling during the demolition project. Question 1 clarifies asbestos abatement requirements for joint compound containing 0.25% Chrysotile Asbestos in drywall. The answer specifies that California Regulations define Asbestos Containing Construction Materials at 0.1% or greater asbestos by weight, making abatement of all materials exceeding this threshold mandatory for this California-based project, regardless of the federal 1% threshold. Question 2 addresses lead handling procedures, where the contractor inquires about performing TCLP/toxicity analysis or Leaching Characterization instead of lead abatement since the structure is being demolished. The answer permits the contractor to provide this testing analysis but requires strict compliance with State of California requirements, which are more stringent than federal standards, and mandates documentation of the specific testing hierarchy established by California's Department of Toxic Substances Control.

B09 Amend-P0002 Questions and Answers-CA-SAN JOAQUIN RIV NWR-GREEN HOUSE
DEMOLITION-140FC126Q0031
1. QUESTION: The Asbestos Survey for the greenhouse has joint compound (JC) listed as .25% Chrysotile Asbestos; However, the federal regulations state that anything less than 1% does not have to be abated. Nevertheless, it is a huge liability to handle such without following standard abatement protocols. Would you like for the drywall to be abated to diminish the liability issues, or leave it intact with the demo. This is basically an Owner's preference. I have worked on many federal projects in which we abated Asbestos less than 1% dealing with drywall, and vermiculite insulation. If fact, there is case law showing where the federal gov't has been sued because of such. It is my recommendation that the drywall be abated, but it is not mandatory. Please advise accordingly.
ANSWER: California Regulations define Asbestos Containing Construction Materials as 0.1% or greater asbestos by weight. Since the project is located in California, the abatement of all materials containing greater than 0.1% of asbestos by weight is required by the scope of work.
2. QUESTION: Can we provide a TCLP/toxicity analysis or a Leaching Characterization be performed to handle the lead. Since the structure is being demolished, that is acceptable protocol versus the abetment of the lead. This will inform our waste disposal site that all material is below the lead threshold and can be disposed of as C&D material.
ANSWER: Contractor may provide TCLP/toxicity analysis or a Leaching Characterization for the lead. Contractor must comply with State of California requirements (which are more stringent than federal). Must navigate (and document) specific testing hierarchy under California's Department of Toxic Substances Control.
